140P2020R0027 Questions and Answers – Amendment #0007 6/26/2020

The following is a consolidated list of the government’s response to vendor questions. Updated responses have been highlighted. All questions submitted prior to the deadline have been incorporated;

however, please note that some of the attached questions are still pending responses, which will be provided in a future amendment.

1. Bid Item 3A, drawing number S430: Note 1 states to remove marine growth to El. -5.5. The tremie concrete is shown to be placed to El. -8.0 for section B. Are we to assume that from El. -5.5 to El-8 that the existing seawall does not have to be cleaned?

Response: Confirmed, water blast cleaning is required to El -5.5’. Preparation of existing surfaces below El -5.5’ shall meet requirements of Specification 03 30 00. Note that listed bottom-of-concrete elevations are approximate. Placement extents shall be to existing mudline, or minimum 2’6” below MLW, whichever is lower. Seabed bathymetry is available on Dwg BS100.

2. Bid Item 3A, drawing number S131: Note 3 says to extract timber pile clusters (plural) while the note and arrow on the plan near Sta 39+00 says cluster. Are we to extract one cluster or multiple clusters?

Can details be provided on the type of cluster?

Response: Two timber pile clusters shall be extracted, as shown in plan. Callout in plan is noted as typical.

3. Drawing number G-002: Note 7 says, in part, "Any obstructions which interfere with combi-wall/toe wall installation shall be removed prior to combi-wall/tow wall installation at no additional cost to the Government." Since the contractor has no way to evaluate how many and what type of obstructions there are to remove, we request that these items be treated as a change to the contract or included in an allowance item.

Response: Known obstructions are detailed in the Contract Documents and their removal/relocation shall be included in Contractor proposals. Obstructions that impede work and could not be reasonably anticipated by the Contractor should be flagged to the Contracting Officer and subject to review. No allowance will be provided.

4. Drawing number G-003: Cast-in place concrete note 6 says concrete cover over reinforcing shall be 3". Rebar coverage will vary due to size of bar, crossing bars, etc... Please, provide a tolerance for example, 3", +/- X".

Response: Specification 03 30 00 stipulates concrete tolerances. Where specified, 3” cover is minimum required, per standard ACI requirement in marine environments.

5. Drawing No EC601-EC606, Note 2, says, in part, "any additional measures or rework required to accommodate the existing deficiencies shall be at no additional cost to the Government." Please confirm that this is limited to existing deficiencies listed on these drawings and that any additional existing deficiencies discovered during performance of the work will be considered a change and an equitable adjustment will be made to the contract.

Response: The known existing deficiencies are noted in the contract documents. Deficiencies not in the contract documents are not proposed as part of the contract.

6. Drawing No D-500, Partial Plan at Fuel Dock Ramp has a note that states "Existing embedded tie-down to be demolished." Please provided details of the existing tie-downs and limits of demolition.

Response: Existing tie-downs are Pacific Marine & Industrial Model P3490-A Aircraft Tie Downs.

Existing installation is like replacement detailed on Dwg S-601.

7. Drawing R-423, note A calls for lap lengths with minimum coverage of 2". Note 5 calls for a minimum coverage of 3". Please clarify the minimum coverage required.

Response: Required concrete cover requirement is 3”.

8. Concerning the temporary birth mooring barge, please confirm that once the barge is commissioned, the Government will take complete and full ownership of the mooring barge and its use and maintenance and the Contractor will have no liability for its use, throughout the life of the project.

Response: The Contractor will have full ownership and liability responsibility of the mooring barge for the duration of the project the same as other temporary construction facilities including installation, maintenance, and removal of facilities. The Government will be responsible for ferry operations, snow removal, and adjustment of queuing facilities in support of ferry operations. This is a temporary facility and is not to-be transferred to the Government at the end of the project. In addition to the other contract documents, see also Permit Application NAN-2019-01326-WCA from the United States Army Corps of Engineers (USACE) for additional permit conditions specific to installation and removal of the temporary facilities.

9. Drawing G-003 Excavation and Backfilling Note 5: "Contractor shall employ a qualified archaeologist, approved by the contracting officer to perform monitoring when excavating within extents indicated on Drawing G-110." In Addenda 2 in ATT03b_ProposalPresentation-projectRqmts on page 6 it says, "Archeological Monitor will be provided by the Govt." Specification section 01 35 13.22, paragraph 1.2.D defines the Archeological Monitor as a Representative of the Government. Please confirm that the Government will supply the Archeological Monitor.

Response: The Government will provide the Archeological Monitor(s). Refer to the Specifications, especially 01 35 13.22 and 01 35 91 for additional information on archeological monitoring requirements.

10. Drawing G-003 Masonry Note 1: The contractor shall reuse salvaged stone from the collapsed portions of the stone seawall to restore the deficiencies in the wall. Stone in addition to the salvaged stone will be required, contractor shall obtain stone from an off-site source. Additional stone obtained shall be consistent with the existing stone in shape, size and color. Stone obtained from an off-site source is subject to the contracting officer's approval." Drawing EC100 Note 2 states "Contractor may find additional or less stone than noted in schedule" Please provide names of suppliers the contracting officer would approve. Also, please provide a specification defining stone quality requirements.

Response: Specification section 04 01 40 has been updated to provide additional clarity to the quality of granite stone and samples to be provided to the Contracting Officer for approval. The Contracting Officer will not pre-qualify suppliers as suitable stone is known to be available from numerous quarries in New England and Kentucky (see Attachment 2a to Amendment 0005).

11. Drawing G-004 under Timber, Timber Piles and Hardware Note 2 it states that 'All timber piles and timber should be under the Guyana Timber Grading Rules for Hardwoods. Guyana Forestry Commission." Please provide the Guyana Timber Grading Rules. Is it the Government's intention that this material be imported from Guyana?

Response: Listed reference is a publicly available document. It is expected that Greenheart piles and chocks can be sourced by domestic suppliers who specialize in marine-grade lumber.

12. Drawing G-150 Work Zone H Note 2: "Scope of construction in work zone H is not expected to require inshore barrier fencing, but if contracting officer deems that infrastructure protection and dust control are not adequately provided, contractor shall install barrier as is required to do so." Will that fence installation be a change to the contract or paid under an allowance?

Response: Temporary fencing is required per the contract documents (see especially Specification sections 01 50 00 and 31 32 10) in addition to dust control provisions (see Specification 02 41 00).

No allowance will be provided.

13. Drawing G-150 Phasing Note 2 "Some work, particularly mudline re-contouring and scour protection installation, may require off-shift work so as not to impact ferry operations." Specification Section 01 11 00 1.9 On-Site Work Hours states: "Seven Days a week 6:00am to 6:00pm." Can any shift be worked during marine operations?

Response: The intent of the On-Site Work Hours is to establish the allowable regular working hours for construction. Please find the below edits and added clarity to Specifications Section 01 11 00 1.9. A (see Attachment 2b to Amendment 0005).

A. On-Site Work Hours:

1. Work is allowed to occur five (5) days per week, Monday-Friday, 6:00am to 6:00pm, without the need for further coordination and subject to limitations on deliveries and hours for passing through USPP security or other situational constraints.

2. All Post 4 canine unit sweeps of incoming deliveries occur between 6:00am and 2:30pm only.

3. Liberty State Park opens at 6:00am and closes at 10:00pm.

4. Restrictions/Accommodation for special events will be addressed to give the contractor as much advance notice as possible.

5. It is understood that due to the dependency on tidal fluctuation and other variables like visitor presence (or absence), ferry schedules or other factors necessitating a change to on site work hours, shifts etc. will be required.

6. Work on Saturdays, Sundays, Federal holidays or at night may not be performed without prior consent of the Contracting Officer. Submit requests 72 hours in advance of the work to the Contracting Officer for approval. See also Specification section 01 11 00 B.

14. Drawing C-101 Grass and Trees Surface Replacement Notes states: "Restoration of underground irrigation system may also be required." Please provide details of the existing irrigation system. How is the contractor to be paid for this work? If the irrigation system is to be repaired in other areas, please confirm that this will be considered a change and an equitable adjustment will be made to the contract.

Response: No specific scope is associated with restoration of the underground utility systems. The Contractor is responsible for any damage to the irrigation system as a result of Contractor activities.

Irrigation facilities are to-be protected in-place. See also Specification 32 92 00 and the provided “Ellis Island Irrigation Head Degree and Location Drawings.” See Attachment 2c to Amendment 0005 for additional information on existing irrigation facilities and locations.

15. Contract Line Item Number (CLIN) 10H-3 Masonry Type 2 - Fill Voids with Grout is paid in CF. This item is difficult to quantify and will likely substantially increase in quantity because contract Drawing R- 431 Repair Type 2 - Reset Block Note 4 states: "Additional blocks may need to be reset to facilitate repair which will occur at no additional cost to the government." In order to keep the cost down in this contract, we asked that only the voids under the identified blocks should be quantified, if other blocks need to be removed and more voids need to be filled out at time of construction, these should be change to the contract or included into an allowance item.

Response: Only the voids identified in the contract documents should be quantified for bid.

Additional blocks may need to be removed and/or reset as part of the contractor’s approach to means and methods and not due to voids/defects (e.g. removing stones in courses above the void/defect). Any difference in quantities shall be brought to the attention of the Contracting Officer. No allowance will be provided.

16. Drawing S-131 Note 5 "Historic items are known to be placed and/or tethered at the mudline between STA 35+49 and STA 37+00. Can the numbers and types of historic items be quantified for the Contractor? How is the Contractor paid for relocation and/or handling of these Historic items?

Response: Weight and dimensions of specific historic items are unknown. Work shall be performed under Contract Line Item 003A. The historic items to be relocated are:

• Two (2) rudders

• One (1) rudder guard

• One (1) propeller shaft

• One (1) propeller

• One (1) propeller mounted on its shaft

• One (1) anchor

• One (1) steel box

• One (1) steel basin

17. Drawing S-141 "Existing pitcher pump and manholes to be demolished as required, refer to drawing D141 note 3 "Install shoring to protect existing utilities and park infrastructure as required, coordinate de-commissioning and removal of existing water and electric lines, including manhole structures and historical components with contracting officer, active electrical services shall be properly terminated at their source panel." Please provide details of existing utilities that may need to be removed. How is the Contractor paid for removal of these items?

Response: See the utility As-Builts provided with addenda.

18. Drawing S-434 Can you tell us the TIP elevation of the existing concrete sheet pile?

Response: Installation logs with documented tip elevations are not available for existing concrete sheet piles. Historical drawings indicate existing concrete sheet piles at west side of island vary in length from 18’6” to 30’-0”.

19. Drawing S-440 Can we get a copy of the as-built drawings of the existing steel sheet piling (AZ13 or Sim.)?

Response: As-Built drawings will not be provided.

20. BS-100 - Please provide a copy of Bathymetric Survey and/or CAD File?

Response: See the provided Bathymetric Survey addenda. The corresponding CAD files will not be provided.

21. Drawing R423 Concrete Repair Notes & Schedules has a concrete repair schedule and a concrete lap splice table. How are these to be worked together as there is no existing re-steel size information?

Response: No reinforcing was encountered at the time of inspection. These details are provided should the concrete deterioration expand to expose reinforcing steel.

22. Drawing R423 note 4 states that re-steel found to have greater than 25 % section loss is to be replaced. Will this be paid as an allowance as it can be not be quantified until the repair work is performed?

Response: At these locations, no reinforcing was encountered at the time of inspection, these details are provided should the concrete deterioration expand to expose reinforcing steel.

Reinforcing steel encountered with greater than 25% section loss shall be brought to the attention of the Contracting Officer. No allowance will be provided.

23. Drawing R 423 note 5 states that the repair may protrude from the side of the seawall to maintain the 3 " of cover required for the reinforcing steel. How will this extra material be paid for?

Response: This note is intended to give the contractor flexibility for fit up of the repair work allowing that it does not have to be flush with the existing wall. This does not require ‘extra material’. The thickness of the repair should be considered part of the detail.

24. Due to the ongoing COVID-19 pandemic, we request that an electronic submission method be made available.

Response: The current requirement remains unchanged. For the Technical Proposal submit one (1) original and three (3) bound hard copies and (2) two separate electronic USB copies, and for the Business & Price Proposal submit one (1) original hard copy and one (1) copy hard copy and two (2) electronic copies on USB flash drives. The NPS requires that the electronic USB copies be provided by the proposal due date and time. Hard copies are required also by the proposal due date and time but will still be accepted up to five (5) business days after the proposal due date to accommodate COVID-19-related issues.

25. Due to the ongoing COVID-19 pandemic, we request a 4-week extension to the bid date.

Response: As of Amendment 0004, to the solicitation the deadline for proposal submissions has been extended to 5:00 pm ET, Tuesday, July 7, 2020. At this time no further proposal due date extensions are being contemplated; however, that may change.

26. Reference Specification Section 01 27 00, paragraph 3.1.L.4.d.2.) Allowance for contaminated material management and disposal. The Contractor is unable to quantify this work. Please provide the Allowance Item and amount for this work.

Response: Handling and disposal of contaminated materials has been updated and provided in the amended Contract Price Schedule with updated quantities under CLIN 11E and Specification 01 27

00. No allowance will be provided (see Attachments 01 and 02d to Amendment 0005). Note:

Attachment 01a to Amendment 0007 supersedes Attachment 01 to Amendment 0005.

27. Please confirm that should hazardous materials be encountered; the Government will be considered the generator and will sign all waste disposal manifests. Please also confirm that handling and disposal of hazardous materials will be considered a change and an equitable adjustment will be made to the contract.

Response: Handling and disposal of hazardous materials is not anticipated nor included in the solicitation documents. If hazardous materials are encountered, immediately inform the Contracting Officer. If hazardous materials are encountered and disposed of under this construction contract, the Government would be considered the waste generator and sign waste disposal manifests.

28. At the virtual visit, photos of laydown area 1 shows that this area is currently being used to stockpile material. Will all this material be removed prior to construction start or must the contractor price the removal of material prior to taking over the laydown area 1?

Response: Photos and imagery from the Preproposal Meeting are out-of-date. No contractors are currently using Laydown Area 1. Equipment and construction materials currently stored in Laydown Area 1 will be removed by the Government prior to the Notice-to-Proceed (NTP). There are Government-owned stones stored in this area for future use and are not to be relocated during this project. The existing stones are within 12-feet of the existing building and numerous other Contractors have used this area without issue with the stones in storage.

29. Seawall Strengthening - Landside Shoring - After review of the seawall strengthening drawings, we have assumed that no bracing will be allowed to be placed against the existing seawall. Please confirm.

Response: Confirmed, no bracing shall be placed against existing seawall.

30. Seawall Strengthening - Landside Shoring - We are assuming that the existing face of the timber cribbing behind the seawall is at least 8 feet off the back of the seawall to allow shoring of adequate size to be installed. Please confirm.

Response: Timber cribbing offsets from seawall are known to vary, but exact dimensions have not been field confirmed. The Historic Structures Report states that along the Slip North Seawall, “the drawings show a recommended distance of 9 feet between wall and crib at the top, tapering to about 3 feet at the bottom.” Offsets at the Slip South Seawall are similarly described.

31. Seawall Strengthening - Landside Shoring - The maximum depth of excavation to the bottom of the crushed stone base we have found is +/- 13.5 '. This will require a cantilever shoring system. Are there any limits on type of pile systems that may be utilized? Are there limits on installation methods? Is it acceptable to remove and reuse the shoring as there is in excess of 1600 LF of seawall strengthening?

Are there limits on removal methods?

Response: Within critical tree root zones, type of shoring installed is subject to Note 2 on Drawing TP501. Contractor’s attention is also called to General Notes, Drawings, and Specifications regarding monitoring and protection of existing structures, such as timber cribbing, seawall anchorage components, and utilities. Placement of a stable slope may be acceptable in lieu of shoring where size of work zone permits. Phasing and re-use of shoring is acceptable. Temporary shoring shall be extracted and disposed by Contractor as required by the Contracting Officer.

32. Seawall Strengthening Reinforcing Steel - What are the requirements for connection of reinforcing steel between adjacent placements? Do they need to be connected as they are acting as weight? Will couplers be required or will lap splices be allowed if connections are required?

Response: Providing either lap splice or couplers per ACI is acceptable. Construction joints shall be a minimum 6” from #10 wall dowels.

33. Seawall Strengthening - Tremie Placement - Since the strengthening concrete behind the seawall is below the MHW elevation in most places are we to assume that these placements will be required to be placed as tremie placements due to infiltration of seawater thru the wall?

Response: Placement of strengthening slab concrete may be by tremie method.

34. Specification Section 03 30 00, calls for concrete with a 4" slump. As much of the concrete is to be placed under water using a tremie mix, a 4" slump is not workable. Please provide a tremie mix spec with a greater slump.

Response: See notes under ”Cast-in-Place Concrete” on Dwg G-003.

35. Boring Reports - If available, please provide the boring reports that correspond with B series documents in drawing package. Please also provide original boring logs of project location.

Response: See Attachment 2e to Amendment 0005, “Subsurface Geotechnical Investigation.”

36. CAD Files: If available, please provide AUTOCAD drawings of site to accurately size equipment necessary for scopes of work.

Response: The CAD files corresponding to the drawings provided with the contract documents will be made available to the Contractor following award of the contract. The CAD files will not be distributed as part of the construction contract solicitation.

37. DWG G002, General note 7 states that the contractor verify the path of the proposed combi-wall to determine if obstruction are in conflict with the wall layout on the mudline. Is it acceptable to provide this as a dive video for submittal?

Response: It is acceptable to provide dive video as a submission. Diver(s) shall probe into mudline to ensure any obstructions covered by silt are identified.

38. DWG G003, Masonry Note 1 says “in addition to the salvaged stone additional stone will be required”. This is a Design Bid Build project. How are we to determine how much stone is required in the pre-bid stage? We suggest adding a unit price be added the bid form which will help level the playing field and ensure responsible bidding.

Response: The Masonry Repair schedules indicate the number of missing blocks that are required for Masonry Repair Type 2. CLIN 10-H2 already represents a unit price for this item. See also the amended Contract Price Schedule and Specification 01 27 00.

It is noted in the contract documents and here again, any salvaged stone retrieved from the mudline must be approved by the Contracting Officer for use in the Type 2 masonry repair, as the condition of that stone is unknown. Therefore, the CLIN quantity represents the full number of missing blocks in the Masonry schedule.

39. DWG G003 Excavation and Backfilling, Note 5 require us to provide a qualified Archeologist for area’s indicated on Drawing G-110. One of the locations noted on the drawing indicates some of the historic items are in the water and may need relocation. In order to determine level of effort to relocate these items can you provide a list of what they are, rough dimensions and weight?

requirements.

Weight and dimensions of specific historic items are unknown. The historic items to be relocated are:

• Two (2) rudders

• One (1) rudder guard

• One (1) propeller shaft

• One (1) propeller

• One (1) propeller mounted on its shaft

• One (1) anchor

• One (1) steel box

• One (1) steel basin

40. The permit approved by NJDEP require the purchase of .012 acres of intertidal and subtidal shallows. Who is responsible for the mitigation bank purchase?

Response: The permit required compensatory mitigation credits were purchased and conveyed to the National Park Service, Statue of Liberty National Monument (STLI), on December 30, 2019. No additional wetland mitigation bank purchases are required.

41. The Solicitation included USACOE permits and NJDEP permits. Is a New York environmental permit required? If so, who is responsible?

Response: Ellis Island is in the State of New Jersey, New York Permitting is not required.

42. DWG sheet 19, Stone Recovery Schedule: Could this be provided in Excel?

Response: Tables in the drawings will not be provided in Excel or any other format in addition to the already provided drawings.

43. DWG sheet 26 to 31, Deficiency Schedule Sheet 1 to 6: Could this be provided in Excel?

44. DWG sheet 78, Tree Protection Schedule: Could this be provided in Excel?

45. DWG sheet 102, Concrete Repair Notes and Schedule: Could this be provided in Excel?

46. DWG sheet 105 to 112, Masonry Repair Schedule Sheet 1 to 8: Could this be provided in Excel?

Response: Tables in the drawings will not be provided in Excel or any other format in addition to the already provided drawings.

47. Are there any existing dewatering monitoring wells available on site?

Response: There are no existing dewatering monitoring wells.

48. Volume of temporary fuel cells which need to be provided (Spec 01 15 00)?

Response: The Contractor shall coordinate with the Park to provide Government vessels uninterrupted access to refueling at Ellis Island during construction activities at the fuel dock. The Contractor shall provide continuity of fueling operations during construction at the fuel dock, including a 500-gallon minimum day tank, hose, pump, and appurtenances. The Contractor shall transfer fuel from the Government’s bulk fuel storage to the day tank up to 500 gallons per day while the fuel dock access is restricted due to construction activities. The Government has an in-place fuel contract and will provide the diesel fuel.

49. Method of execution for field touch-ups for coal tar epoxy is missing (Spec 09 97 13).

Response:

(a) For combi-wall system, touch up areas of coating damage at king piles, sheet piles, and connectors with coal tar epoxy. Use same color as original coating. Follow shop-applied material manufacturer’s instructions for touch-up procedures.

(b) For touch-up of structural steel and miscellaneous steel coatings, see Note 10 under “ Structural Steel and Miscellaneous Steel” on Contract Dwg G-004.

50. Do all sheet piles and also for shoring have to be new as stated (Spec 31 41 16)?

Response: Permanent sheet piles shall be new in conformance with Specification 31 41 16. Piles used for shoring are not required to be new, but Contractor shall ensure condition of all piles is adequate for their intended use.

51. Drawing S-410 shows a king pile designated HZ 680M LT, and drawing S-430 shows a king pile designated HZ880 A. The HZ 880 A is a standard section, the HZ 680 is not a standard section. Is this what is intended?

Response: Installation of (2) different Combination Wall systems is intended per the Contract Drawings. Skyline Steel manual (2018 Edition, used at design stage) indicates HZ680M LT M-12 / AZ- 26-700 is a standard system. In case HZ680M LT is discontinued, an equivalent approved combi-wall section shall be used.

52. The RFP calls for item 11-C Archeology Monitoring per the price schedule issued under addendum 2, but the specifications remain unchanged and call for a certified arborist under this item per 01 27 00-7.

Please clarify.

especially 01 35 13.22 and 01 35 91 for additional information on archeological monitoring requirements. The Contractor is required to provide a certified arborist separate from the archeological monitoring requirements.

(End of Amendment 0005 Q&As)

53. Please consider extending the bid due date to at least July 14, 2020 due to the significant amount of material to be supplied by others, quantifying materials and items, etc.

Response: The due date has been extended to July 14, 2020, per this amendment.

54. Is there a limitation to the amount of concrete poured into the seawall strengthening within a workday? Is this at the contractor’s discretion? There appears to be no detail for construction joints.

Response: There is no limit to the length (linear feet) of seawall strengthening placement allowed, however, Contractor shall adhere to phasing requirements, which is expected to require transverse closures. The Contractor is expected to need to phase this work based on the time between pre-inspection cleaning and each concrete pour. A maximum one week is permitted between pre-inspection cleaning of the wall (before sheet piles are installed) and pumping concrete. Only transverse construction joints will be accepted, concrete placement in vertical lifts is not permitted. Proposed locations of construction joints shall be submitted for approval, per Specification 03 30 00, Section 1.04.F.3. Additionally, see response to Question 32.

55. Is there a designated person of whom is to perform the archeological monitoring? If the Contractor is to provide this service, please provide contact information of respective person.

requirements.

56. In reference to Contract Line Item No. 001, please clarify if Item J “Removal of granite fascia blocks on the mudline as indicated in contract documents” is referencing the Note section in the Masonry Repair Schedule (R-432 to 439). Is this where we base our quantity of removal from? If not, please clarify from where we obtain this information.

Response: A more comprehensive schedule of granite blocks to be recovered from the mudline is provided on Dwg EC100. Quantities for CLIN No. 001 shall be derived from this schedule.

57. Please clarify the discrepancy between the combi-wall types. STA 13+37 to 17+35.7 shows HZ680 LT M-12 and STA 26+85.5 to 40+34.5 shows HZ880 LT M-12. Is this correct?

Response: Installation of (2) different Combination Wall systems is intended per the Contract Drawings. Additionally, see response to Question 51.

58. Please provide more information with regards to the steel formwork required from STA 2+71.3 to 7+37.

Response: Per Note 1 on Contract Dwg S-400, steel formwork shall be steel sheet piles to remain in place. The size and depth of subject sheet pile formwork shall be designed by Contractor.

59. Can the existing handrails at the North Ferry Slip be salvaged prior to demolition and be reused?

Contract drawings call out for removal (D-402) but Definition of Contract Line Item No 001 (k) identifies the removal and storage of handrails.

Response: The intent is to salvage and reuse the existing rails as possible during construction, but no rails will be stored by nor provided to the Government after construction. Replacement handrail along North Ferry Slip shall be continuous and locally offset around each of the (9) new bollard pedestals, per Dwgs S-707 and S-708. In order to accommodate this local offsets configuration, a new railing system is specified between approx. Sta 2+68 and 6+57. Storage of handrails indicated in CLIN No. 001 is in reference to railing at other locations that may be removed at the Contractor’s discretion for performance of work and shall be re-installed in-kind.

60. RFP Specification 04 01 40, Page 2, Paragraph 1.03 E says, “The contractor …….shall furnish documentation of 5 consecutive years of work of this type”. Instead of “5 consecutive years” would you consider non-consecutive completed projects of this type of masonry work?

Response: The specification is re-stated here: "The Contractor shall provide qualified workers, trained and experienced in restoration of masonry in historic structures, and shall furnish documentation of 5 consecutive years of work of this type. A list of similar jobs shall be provided identifying when, where, and for whom the work was done." The successful offeror will be required to comply with this requirement unless an acceptable explanation is provided and accepted by the government.

61. Is the project material tax exempt?

Response: The project is not material tax exempt.

62. Are we required to pay material sales tax to New York or New Jersey or both?

Response: Material sales tax to be paid to state material was obtained from at time of purchase.

63. RFP attachment 4a, 4b and 4c (permits) do not mention moratoriums for any wildlife species. Are there any locations or time periods when work cannot take place on this project due to a species moratorium?

Response: The permits correctly do not reference any moratoriums. There are no species moratoriums associated with the scope of this project.

64. In “140P2020R0027-0005_Att01_ContractPriceSchedule_200605_0005” The revised quantity for 3A

– Combi Wall shows 1,340 LF. Based on “140P2020R0027-0005_Att02d_Response26-RevSpecSection- 01_27_00” Contract Line Item 0003 – 4.a.3 shows the stations STA 13+37 to 17+35 and 26+85.5 to 40+35 total to ~1748 LF. This quantity was shown in Revised Price Schedule Vol II. Please clarify.

Response: Contract Price Schedule quantity for CLIN 0003A should read 1,748 LF. See the revised Contract Price Schedule (Attachment 01a to Amendment 0007).

65. In “140P2020R0027-0005_Att01_ContractPriceSchedule_200605_0005” The revised quantity for 5

– North Island Seawall Strengthening as 596 LF. The revised Contract Line Item Description shows this SOW is from STA 21+34.3 to 23+31. This totals ~197 LF. Again, please clarify where this new total comes from.

Response: Contract Price Schedule quantity for CLIN 0005 should read 197 LF. See the revised Contract Price Schedule (Attachment 01a to Amendment 0007).

66. Does the phasing plan as shown on G-151 denote that the temporary berth is the first item to be completed within the entire scope of work for this project? Are other scopes of work allowed to be performed simultaneously while not interfering with the construction of the berth/north ferry slip restorations?

Response: The phasing plan as shown on Dwg G-151 denotes that the temporary berth is the first item to be completed within the scope of work for Work Zone A only, not necessarily within the entire scope of work for this project. Work may be performed in other Work Zones simultaneously provided that site restrictions/criteria are complied with (see response to #67).

67. Is it permissible to perform multiple scopes of work simultaneously?

Response: Contractor may perform work in multiple Work Zones concurrently, if in compliance with restrictions/criteria on G-series sheets. Contractor shall submit for approval Work Zone dwgs with dimensions, type of equipment to be used, anticipated durations, and other details as required by the CO.

68. Can the contractor perform night work if requested in advance?

Response: See answer to Question 13.

69. For the steel formwork along the North Ferry Slip, the drawings indicate “Steel Formwork”. Note 1 on S-400 denotes “Sheet Pile Formwork to Remain in Place.” Please clarify what type/style of formwork is to be used.

Response: See response to Question 58.

70. Given the significant amount of concrete to be poured throughout the scopes of work of the project, please give some indication as to the amount of concrete trucks that can typically be allowed on the Island throughout a given workday. Can overtime be utilized during tremie/concrete pours?

Response: There is no limit/cap to the total number of concrete trucks that can come to the island.

However, given the work area there may be a physical limitation to how many trucks can fit on the island at any given time. All trucks will need to be swept by USPP canine unit at Post IV prior to crossing the bridge and the access through Liberty State Park is limited to 6:00am to 10:00pm.

Large volume concrete deliveries will just need a higher level of coordination with the local park staff to ensure lanes of travel, temporary closures of park areas (if needed), and sufficient canine coverage at Post IV. Additional concrete wash-out areas may need to be established to ensure the concrete trucks do not get in their own way or obstruct park operations during wash-out. See also response to Question 13.

71. The PAST PERFORMANCE sheet currently has a return date of May 18, 2020. We did not see any amendment that changes that date. Can you confirm per pre-proposal meeting that the information is due by the bid closing date?

Response: PAST PERFORMANCE sheets will be due on the proposal submission date. The proposal submission due date is July 14, 2020 (see Question 53).

72. Due to the large scope of prefabricated steel materials and components, and the limited time given for suppliers, we would like to request an extension of the bid deadline of 2 weeks.

Response: The deadline for proposal submissions has been extended to July 14, 2020, per Amendment 0006. There will be no further deadline extensions.

73. Would the engineer be willing to allow the handling holes and /or hammer teeth marks to still be present on the sheets and/or king piles when driven to grade?

Response: Handling holes below cutoff elevations shall be plugged prior to placement of tremie concrete. Any damage to coatings and/or hammer teeth marks left below cut-off elevation on HZM combi-wall system, resulting from pile handling and/or installation, shall be touched-up per the Contract Documents.

74. Would the engineer allow a flexible tolerance on the final elevation of the king and/or sheet piles?

Due to the heavy corrosive environment, uncoated sheets would disappear over time, as clearly witnessed on the south side of the island.

Response: Top of combi-wall system and sheet pile wall toe walls shall be in accordance with the elevations indicated in the Contract Documents.

75. Can Contractor assume that the dewatering water can be discharged to groundwater? Is there any groundwater quality data available?

Response: To be provided in a future amendment.

76. Toe Wall Repair: During the site visit it was noticed that there are several areas where the existing sheet pile appears to be pulling away from the existing concrete tremie. Some voids appeared to be between 3”-5” in distance. Please advise how the contractor should approach these areas when performing repairs.

77. Drawing S470 requires us to fill/grade the original mudline to provide subgrade for the layer of scour rock to be placed. We are required to fill using native species soils. What type(s) of fill is acceptable under the current permit (E.g. Sand, 57 stone, clay)?

78. When working in the slip area, can dive operations begin at 6:00PM?

Response: See response to Question 13.

79. Could a floating barrier and warning devices (work area closed to ferry’s) be placed across the slip to allow divers to work in the slip during normal work hours?

Response: To be provided in a future amendment.

80. The CONSTRUCTION SCHEDULE is listed as MS Project GANTT CHART format. Our firm utilizes PRIMAVERA P6 GANTT CHART format, is this an acceptable format as long as the information required is maintained?

81. Spec section 01 27 00 “Contract Line Item No. 0006” references subcontract items 006-A, 006-B and 006-C, however the bid form does not indicate those subcontract items. Please clarify if these items are to be included in the item 6 Replace Fender System 370 LF or revise and reissue a correct bid form.

82. Spec Section 31 60 16, Augered Cast-in-Place Piles, Paragraph 3.02.A states that "After the auger has been removed and the hole filled with grout, place required reinforcing steel while the grout is still fluid." However, we are unable to find any required reinforcing steel on the drawings. Is any reinforcing steel required in the auger cast piles? If so, please provide details.

83. Spec Section 31 23 00, Excavation, Filling and Backfilling Paragraph 3.02.C.2 states that "Drainage Water shall be collected in sumps, and pumped, or permitted to flow by gravity, to the discharge or storage areas indicated on the Contract Drawings". We don't see any such discharge or storage areas shown on the Drawings. Please provide.

84. Is the full 13" depth of the existing Heavy Duty Asphalt Pavement from Sta 21+58 to Sta 23+31 all asphalt, or a combination of asphalt and stone sub-base. If it is a combination, do you know how many inches of tone ad how many inches of asphalt?

85. Spec Section 26 42 00, Cathodic Protection Testing, requires the Contractor to test the existing impressed current cathodic protection system used for protection of the gas pipeline that serves the Island. We understand that there are reference drawings available, showing the location and details of this impressed current system. Please provide.

86. Please provide the Ellis Island Artifacts Placed/Tethered in Water Sketch, 2012, listed in Spec Section 01 11 00, Summary of Work, Paragraph 1.12.A.11.

87. On drawing D-121 it shows a 3 pile cluster fender system to remain, on the detail pg. D-403 it shows timber piles bolted to seawall. Which is correct

88. On drawing S-110 shows 6’-9” min distance from wall to inside belly of sheets (as does details 1&3 on S-110) however on section A-3-110 it shows a min distance of from top of wall and 7’-1” to outside Belly of sheet pile. The distance from inside belly to outside belly is approx. 18” so do we figure 7’-1” or 8’-3” to outside belly?

89. If the government will be operating the ferries and managing all the public people on the temporary berth how can we be held responsible and liable for injuries or damage? The contractor can insure the barge for physical damage for construction operations. However, the temporary barge, once installed should not be considered construction operations but an area under Government control. The temporary barge is no different than the permanent ferry berthing and the Government should pick up liability for its operation thus, there should be some type of lease of the temporary dock to the owner that releases us from liability that would include a clear indemnification clause and a waiver of subrogation.

Response: See response to Question 8.

90. The scope of work for the bid items don’t account for all the work shown on D (Demo drawings).

Where do we put those items? Should they go in the demo item 1?

91. Drawing G-002 General Note 19 prohibits construction surcharging within 15 ft of seawall without shoring. However, excavation and installation of shoring requires staging of equipment within 15 ft.

Please clarify if this requirement pertains only to the existing condition or if measures can be taken by the contractor to relieve lateral loading on the seawall to allow staging of equipment, for example fill removal, crane mats, etc.

92. Addendum 5 clarifies that the contractor does not have to retain the services of an archaeologist (to be provided by the Govt.). Is it the sole responsibility of the archeologist to stop work due to a potential archaeological finding during excavation? How is the contractor to be compensated for standby time during any resulting archaeological investigations?

93. Drawing G-150 Work Zone D Note requires Contractor to furnish mobile fuel cells means of transport for Park Police and Maintenance vessels. What are the fueling (type/capacity) requirements for these vessels? Where does the Park propose to fuel vessels during work in Work Zone D?

94. In the case where granite blocks cannot be replaced with materials salvaged from the mudline, are full depth granite blocks (matching original dimensions) required, or is it acceptable to replace with granite facing blocks cast into concrete?

95. Drawing S-420 requires controlled/staged placement of tremie concrete to prevent deflection of the toe wall. Is it acceptable to place the tremie concrete in multiple lifts?

96. Drawing S-431 Section shows under layer stone intermixed with existing soft silty clay soils. Is the Contractor required to excavate this area to El. -19.0 or is the stone fill to be placed directly into the existing soft soil until it no longer sinks? If placed directly into the existing soil, how is depth of placement to be determined?

97. Drawing S-450 Section A: Please provide detail(s) for UHMW facing on outer timber fender pile, showing how it is attached to the timber pile and how the pile is notched to fit.

98. What is the intended source of the “native seabed material” shown in Drawing S-470? Please provide a specification for this fill. Is some of this material intended to be sourced from the cut section to be reused for recontouring?

99. Are all steel railings to be furnished and installed new, or is it intended to salvage and reinstall some sections of existing railing. Please indicate any sections of railing that are intended to be salvaged and reinstalled.

Response: See Response to Question 59.

100. Was a wind/wave study performed to analyze the location/positioning of the floating ferry landing? Is so, please provide a copy of that report.

101. The specifications indicate loading criteria for the temporary steel float but do not specify static or dynamic stability design criteria for sea trials. What are the requirements for pitching/rolling motions and accelerations under the specified environmental/loading conditions?

102. Drawing TB100 shows shallow water between -5 and -6’ (below MLLW) within the footprint of the temporary berth. Drawing TB111 indicates a barge draft of 7’-6”. Is the contractor required to locally dredge this area to prevent the float from “bottoming out” and to prevent contact between the barge and the cut-off 54” casing? Does the environmental permit allow for removal of mudline material in this area?

103. Drawing TB100 shows mudline elevations from STA 27+00 to STA 40+00 that are higher than the -

8.0 shown on S-434. Is the intent of the tremie fill to be from EL -8.0 or only from existing mudline? If from El -8.0 is required is the Contractor to excavate behind the new sheeting to achieve the lower elevation? If so is that operation permitted and are there any analytics for dredge soil disposal?

104. Drawing TB430 shows cut-off of pile and casing at El. -14.50’. According to Drawing TB100 mudline elevations could be as high as El. -7.77’ (-5 MLLW), which would make cut-off at -14.50’ impossible without significant underwater excavation. Can this requirement be changed to cut off pile/casing at - 14.50’ or 2 ft below mudline, whichever is higher?

105. Please clarify which key personnel are required to be on site full-time. Spec Section 01 40 00 requires that the Contractors Quality Control Supervisor be on site full-time and may not have other duties, but requirements for other positions referenced in the solicitation, such as Project Manager, Superintendent, Safety Officer, and Environmental Manager, are not clearly defined.

106. Spec Section 31 41 16 requires submission of WEAP analysis for impact hammer to be used to install steel sheet piling. It is also stated that a vibratory hammer in conjunction with an impact hammer may be used. Please confirm, if Contractor can advance piles to specified tip elevation by vibratory hammer only, that the impact hammer is not required. Further confirm WEAP analysis is not required if piles/sheeting is installed with vibratory hammer only.

107. Spec Section 31 41 16 also states that the Contractor should be prepared to pre-auger “some” of the HZ king piles, but it does not clarify if this additional measure is to be at the contractor’s expense.

How will the contractor be paid for this work? If it is to be included in the unit price, please provide an estimated quantity of piles that may need to be pre-augered or consider a separate unit price for pre-augering.

108. Spec Section 35 10 00 requires turbidity curtain to extend the full depth of the water body, which is impractical and potentially dangerous in exposed/high-current areas and may also cause a hazard to navigation. With the exception of bottom-disturbing activities, can the curtain depth be reduced in these areas?

109. Concrete repair units of measure (SF) do not account for depth of void in and behind the seawall.

Sinkholes and voids between seawall and cribbing are likely. If voids extend beyond what is shown in the drawings, how will the additional repair volume be measured and paid.

110. Is there any environmental permitting required in addition to the Army Corp Letter of Permission and NJDEP Federal Consistency Determination? Please confirm these documents serve as final permits for construction.

111. The proposal is due JULY 7, which is the Tuesday after a 3 day holiday weekend with hardcopies due in DENVER, CO. We are concerned that the holiday will impact delivery services plus will need more time to review responses to questions and finalize bid, therefore we are requesting a postponement of the bid date of 2 weeks.

Response: The deadline for proposal submissions has been extended to July 14, 2020, per Amendment 0006. There will be no further deadline extensions.

112. Drawing G-110, Archaeological Resource Plan, show approximate locations of archaeological resources & historic burial sites. Consequentially Notes on that drawing call for adherence to Specifications Sections 01 35 13.22 & 01 35 91, which in turn delineate areas along Seawall requiring detail plans of Means & Methods of Investigation and Execution of excavation under supervision of Archaeological Monitor. It is impossible to quantify at this juncture time and effort required to comply with subject requirements. We request that excavation and preservation in those locations be treated as work performed by contractor under Direction and Supervision of Archaeological Monitor, and therefore be compensated on actual time spent on those activities. All other work shall remain contract work as originally intended.

113. Drawing S-121, Partial Seawall Strengthening Plan, shows 18” augered cast piles at each of the gap/void between existing precast gravity walls. Specification section 31 60 16, augered cast in place piles calls for placing required reinforcing steel into the grout. Please provide proposed reinforcing steel detail.

114. Drawing S-121, Partial Seawall Strengthening Plan, Note 7, calls for contractor to probe to El. -10 prior to installation of subject 18” augered cast piles for utility lines. Is the intent here to perform test pits at each of the 20 locations to El. -10? Please clarify.

115. Drawing S-420, Seawall Strengthening Sections, shows Section ‘A’ void/gaps between existing precast gravity walls completely filled (Note 7) by grout repairs.
