About this file

This document outlines the requirements for a federal solicitation seeking proposals to stabilize the Ellis Island Seawall at the Statue of Liberty National Monument. Offerors must provide pricing to complete base requirements including demolition, seawall strengthening, repair work, and monitoring programs by October 2022. There are also optional line items for additional seawall work. Proposals are due by June 2020 with award anticipated for August 2020.

The solicitation will be awarded on a best value basis evaluating technical experience, approach, personnel, schedule, and past performance. Offerors must demonstrate experience with similar coastal construction projects involving public areas. The technical proposal should address logistics, regulatory compliance, means and methods, and provide schedules, staffing plans and descriptions of firm capabilities. Pricing will be evaluated for reasonableness against the IGCE. The solicitation is set aside for small businesses and includes goals for subcontracting percentages. The National Park Service is the contracting agency.

BASIS FOR AWARD

1. The Government will conduct a source selection using the Best Value Continuum Tradeoff Process defined at FAR Part 15.1. The Contracting Officer (CO) will obligate and award a contract to the offeror who submits a proposal the Source Selection Authority (SSA) determines conforms to solicitation requirements; is fair and reasonable; and provides the best value to the government considering all evaluation factors combined as detailed below. For this acquisition, the CO is the SSA.

2. The Government may accept other than the lowest priced proposal when the perceived benefits of a higher priced proposal merit the price differential.

3. Additionally, pursuant to FAR 52.215-1(f), Contract Award, contained herein:

• The Government may reject any or all proposals if such action is in the Government’s interest.

• The Government may waive informalities and minor irregularities in proposals received.

• The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a cost or price and technical standpoint. The Government reserves the right to conduct discussions if the CO later determines them to be necessary.

EVALUATION FACTORS

RELATIVE IMPORTANCE: FACTOR 1 – Project Experience is the most important factor followed in descending order of importance by FACTOR 2 – Project Technical & Management Approach, by FACTOR 3 – Key Personnel & Key Subcontractors, and by FACTOR 4 – Construction Schedule. The rating scheme for Technical Factors 1-4 is numerical. FACTOR 5, Past Performance is approximately equally important to Technical Factors 1 – 4 when combined, and its rating scheme is adjectival.

Overall: All evaluation factors other than price (technical and past performance), when combined are significantly more important than price.

The offeror shall be responsible for any follow-up communication required to ensure that all the forms are completed by the reference and are emailed to the NPS point of contacts no later than the date and time proposals are due.

Factor 5: PAST PERFORMANCE (continued) The TEP will evaluate past performance of offerors on projects provided in the Project Experience section (FACTOR 1) and on contracts with the Federal Government, other public agencies, or private organizations. Sources other than submitted references may be contacted.
