140P2020R0027 Questions and Answers – Amendment #0006 6/19/2020
The following is a consolidated list of the government’s response to vendor questions. Please note that a number of vender questions received prior to the deadline are not included in this attachment and that some of the attached questions are still pending responses, which will be provided in a future amendment.
1. Bid Item 3A, drawing number S430: Note 1 states to remove marine growth to El. -5.5. The tremie concrete is shown to be placed to El. -8.0 for section B. Are we to assume that from El. -5.5 to El-8 that the existing seawall does not have to be cleaned?
Response: Confirmed, water blast cleaning is required to El -5.5’. Preparation of existing surfaces below El -5.5’ shall meet requirements of Specification 03 30 00. Note that listed bottom-of-concrete elevations are approximate. Placement extents shall be to existing mudline, or minimum 2’6” below MLW, whichever is lower. Seabed bathymetry is available on Dwg BS100.
2. Bid Item 3A, drawing number S131: Note 3 says to extract timber pile clusters (plural) while the note and arrow on the plan near Sta 39+00 says cluster. Are we to extract one cluster or multiple clusters?
Can details be provided on the type of cluster?
Response: Two timber pile clusters shall be extracted, as shown in plan. Callout in plan is noted as typical.
3. Drawing number G-002: Note 7 says, in part, "Any obstructions which interfere with combi-wall/toe wall installation shall be removed prior to combi-wall/tow wall installation at no additional cost to the Government." Since the contractor has no way to evaluate how many and what type of obstructions there are to remove, we request that these items be treated as a change to the contract or included in an allowance item.
Response: Known obstructions are detailed in the Contract Documents and their removal/relocation shall be included in Contractor proposals. Obstructions that impede work and could not be reasonably anticipated by the Contractor should be flagged to the Contracting Officer and subject to review. No allowance will be provided.
4. Drawing number G-003: Cast-in place concrete note 6 says concrete cover over reinforcing shall be 3". Rebar coverage will vary due to size of bar, crossing bars, etc... Please, provide a tolerance for example, 3", +/- X".
Response: Specification 03 30 00 stipulates concrete tolerances. Where specified, 3” cover is minimum required, per standard ACI requirement in marine environments.
5. Drawing No EC601-EC606, Note 2, says, in part, "any additional measures or rework required to accommodate the existing deficiencies shall be at no additional cost to the Government." Please confirm that this is limited to existing deficiencies listed on these drawings and that any additional existing deficiencies discovered during performance of the work will be considered a change and an equitable adjustment will be made to the contract.
Response: The known existing deficiencies are noted in the contract documents. Deficiencies not in the contract documents are not proposed as part of the contract.
6. Drawing No D-500, Partial Plan at Fuel Dock Ramp has a note that states "Existing embedded tie-down to be demolished." Please provided details of the existing tie-downs and limits of demolition.
Response: Existing tie-downs are Pacific Marine & Industrial Model P3490-A Aircraft Tie Downs.
Existing installation is like replacement detailed on Dwg S-601.
7. Drawing R-423, note A calls for lap lengths with minimum coverage of 2". Note 5 calls for a minimum coverage of 3". Please clarify the minimum coverage required.
Response: Required concrete cover requirement is 3”.
8. Concerning the temporary birth mooring barge, please confirm that once the barge is commissioned, the Government will take complete and full ownership of the mooring barge and its use and maintenance and the Contractor will have no liability for its use, throughout the life of the project.
Response: The Contractor will have full ownership and liability responsibility of the mooring barge for the duration of the project the same as other temporary construction facilities including installation, maintenance, and removal of facilities. The Government will be responsible for ferry operations, snow removal, and adjustment of queuing facilities in support of ferry operations. This is a temporary facility and is not to-be transferred to the Government at the end of the project. In addition to the other contract documents, see also Permit Application NAN-2019-01326-WCA from the United States Army Corps of Engineers (USACE) for additional permit conditions specific to installation and removal of the temporary facilities.
9. Drawing G-003 Excavation and Backfilling Note 5: "Contractor shall employ a qualified archaeologist, approved by the contracting officer to perform monitoring when excavating within extents indicated on Drawing G-110." In Addenda 2 in ATT03b_ProposalPresentation-projectRqmts on page 6 it says, "Archeological Monitor will be provided by the Govt." Specification section 01 35 13.22, paragraph 1.2.D defines the Archeological Monitor as a Representative of the Government. Please confirm that the Government will supply the Archeological Monitor.
Response: The Government will provide the Archeological Monitor(s). Refer to the Specifications, especially 01 35 13.22 and 01 35 91 for additional information on archeological monitoring requirements.
10. Drawing G-003 Masonry Note 1: The contractor shall reuse salvaged stone from the collapsed portions of the stone seawall to restore the deficiencies in the wall. Stone in addition to the salvaged stone will be required, contractor shall obtain stone from an off-site source. Additional stone obtained shall be consistent with the existing stone in shape, size and color. Stone obtained from an off-site source is subject to the contracting officer's approval." Drawing EC100 Note 2 states "Contractor may find additional or less stone than noted in schedule" Please provide names of suppliers the contracting officer would approve. Also, please provide a specification defining stone quality requirements.
Response: Specification section 04 01 40 has been updated to provide additional clarity to the quality of granite stone and samples to be provided to the Contracting Officer for approval. The Contracting Officer will not pre-qualify suppliers as suitable stone is known to be available from numerous quarries in New England and Kentucky. See Attachment 2a.
11. Drawing G-004 under Timber, Timber Piles and Hardware Note 2 it states that 'All timber piles and timber should be under the Guyana Timber Grading Rules for Hardwoods. Guyana Forestry Commission." Please provide the Guyana Timber Grading Rules. Is it the Government's intention that this material be imported from Guyana?
Response: Listed reference is a publicly available document. It is expected that Greenheart piles and chocks can be sourced by domestic suppliers who specialize in marine-grade lumber.
12. Drawing G-150 Work Zone H Note 2: "Scope of construction in work zone H is not expected to require inshore barrier fencing, but if contracting officer deems that infrastructure protection and dust control are not adequately provided, contractor shall install barrier as is required to do so." Will that fence installation be a change to the contract or paid under an allowance?
Response: Temporary fencing is required per the contract documents (see especially Specification sections 01 50 00 and 31 32 10) in addition to dust control provisions (see Specification 02 41 00).
No allowance will be provided.
13. Drawing G-150 Phasing Note 2 "Some work, particularly mudline re-contouring and scour protection installation, may require off-shift work so as not to impact ferry operations." Specification Section 01 11 00 1.9 On-Site Work Hours states: "Seven Days a week 6:00am to 6:00pm." Can any shift be worked during marine operations?
Response: The intent of the On-Site Work Hours is to establish the allowable regular working hours for construction. Please find the below edits and added clarity to Specifications Section 01 11 00 1.9. A (see Attachment 2b).
A. On-Site Work Hours:
1. Work is allowed to occur five (5) days per week, Monday-Friday, 6:00am to 6:00pm, without the need for further coordination and subject to limitations on deliveries and hours for passing through USPP security or other situational constraints.
2. All Post 4 canine unit sweeps of incoming deliveries occur between 6:00am and 2:30pm only.
3. Liberty State Park opens at 6:00am and closes at 10:00pm.
4. Restrictions/Accommodation for special events will be addressed to give the contractor as much advance notice as possible.
5. It is understood that due to the dependency on tidal fluctuation and other variables like visitor presence (or absence), ferry schedules or other factors necessitating a change to on site work hours, shifts etc. will be required.
6. Work on Saturdays, Sundays, Federal holidays or at night may not be performed without prior consent of the Contracting Officer. Submit requests 72 hours in advance of the work to the Contracting Officer for approval. See also Specification section 01 11 00 B.
14. Drawing C-101 Grass and Trees Surface Replacement Notes states: "Restoration of underground irrigation system may also be required." Please provide details of the existing irrigation system. How is the contractor to be paid for this work? If the irrigation system is to be repaired in other areas, please confirm that this will be considered a change and an equitable adjustment will be made to the contract.
Response: No specific scope is associated with restoration of the underground utility systems. The Contractor is responsible for any damage to the irrigation system as a result of Contractor activities.
Irrigation facilities are to-be protected in-place. See also Specification 32 92 00 and the provided “Ellis Island Irrigation Head Degree and Location Drawings” (see Attachment 2c) for additional information on existing irrigation facilities and locations.
15. Contract Line Item Number (CLIN) 10H-3 Masonry Type 2 - Fill Voids with Grout is paid in CF. This item is difficult to quantify and will likely substantially increase in quantity because contract Drawing R- 431 Repair Type 2 - Reset Block Note 4 states: "Additional blocks may need to be reset to facilitate repair which will occur at no additional cost to the government." In order to keep the cost down in this contract, we asked that only the voids under the identified blocks should be quantified, if other blocks need to be removed and more voids need to be filled out at time of construction, these should be change to the contract or included into an allowance item.
Response: Only the voids identified in the contract documents should be quantified for bid.
Additional blocks may need to be removed and/or reset as part of the contractor’s approach to means and methods and not due to voids/defects (e.g. removing stones in courses above the void/defect). Any difference in quantities shall be brought to the attention of the Contracting Officer. No allowance will be provided.
16. Drawing S-131 Note 5 "Historic items are known to be placed and/or tethered at the mudline between STA 35+49 and STA 37+00. Can the numbers and types of historic items be quantified for the Contractor? How is the Contractor paid for relocation and/or handling of these Historic items?
Response: Weight and dimensions of specific historic items are unknown. Work shall be performed under Contract Line Item 003A. The historic items to be relocated are:
• Two (2) rudders
• One (1) rudder guard
• One (1) propeller shaft
• One (1) propeller
• One (1) propeller mounted on its shaft
• One (1) anchor
• One (1) steel box
• One (1) steel basin
17. Drawing S-141 "Existing pitcher pump and manholes to be demolished as required, refer to drawing D141 note 3 "Install shoring to protect existing utilities and park infrastructure as required, coordinate de-commissioning and removal of existing water and electric lines, including manhole structures and historical components with contracting officer, active electrical services shall be properly terminated at their source panel." Please provide details of existing utilities that may need to be removed. How is the Contractor paid for removal of these items?
Response: See the utility As Builts provided with addenda.
18. Drawing S-434 Can you tell us the TIP elevation of the existing concrete sheet pile?
Response: Installation logs with documented tip elevations are not available for existing concrete sheet piles. Historical drawings indicate existing concrete sheet piles at west side of island vary in length from 18’6” to 30’-0”.
19. Drawing S-440 Can we get a copy of the as-built drawings of the existing steel sheet piling (AZ13 or Sim.)?
Response: As-Built drawings will not be provided.
20. BS-100 - Please provide a copy of Bathymetric Survey and/or CAD File?
Response: See the provided Bathymetric Survey addenda. The corresponding CAD files will not be provided.
21. Drawing R423 Concrete Repair Notes & Schedules has a concrete repair schedule and a concrete lap splice table. How are these to be worked together as there is no existing resteel size information?
Response: No reinforcing was encountered at the time of inspection. These details are provided should the concrete deterioration expand to expose reinforcing steel.
22. Drawing R423 note 4 states that resteel found to have greater than 25 % section loss is to be replaced. Will this be paid as an allowance as it can be not be quantified until the repair work is performed?
Response: At these locations, no reinforcing was encountered at the time of inspection, these details are provided should the concrete deterioration expand to expose reinforcing steel.
Reinforcing steel encountered with greater than 25% section loss shall be brought to the attention of the Contracting Officer. No allowance will be provided.
23. Drawing R 423 note 5 states that the repair may protrude from the side of the seawall to maintain the 3 " of cover required for the reinforcing steel. How will this extra material be paid for?
Response: This note is intended to give the contractor flexibility for fit up of the repair work allowing that it does not have to be flush with the existing wall. This does not require ‘extra material’. The thickness of the repair should be considered part of the detail.
24. Due to the ongoing COVID-19 pandemic, we request that an electronic submission method be made available.
Response: The current requirement remains unchanged. For the Technical Proposal submit one (1) original and three (3) bound hard copies and (2) two separate electronic USB copies, and for the Business & Price Proposal submit one (1) original hard copy and one (1) copy hard copy and two (2) electronic copies on USB flash drives. The NPS requires that the electronic USB copies be provided by the proposal due date and time. Hard copies are required also by the proposal due date and time but will still be accepted up to five (5) business days after the proposal due date to accommodate COVID-19-related issues.
25. Due to the ongoing COVID-19 pandemic, we request a 4-week extension to the bid date.
Response: As of Amendment 0004, to the solicitation the deadline for proposal submissions has been extended to 5:00 pm ET, Tuesday, July 7, 2020. At this time no further proposal due date extensions are being contemplated; however, that may change.

00. No allowance will be provided. See Attachments 01 and 02d.
27. Please confirm that should hazardous materials be encountered; the Government will be considered the generator and will sign all waste disposal manifests. Please also confirm that handling and disposal of hazardous materials will be considered a change and an equitable adjustment will be made to the contract.
Response: Handling and disposal of hazardous materials is not anticipated nor included in the solicitation documents. If hazardous materials are encountered, immediately inform the Contracting Officer. If hazardous materials are encountered and disposed of under this construction contract, the Government would be considered the waste generator and sign waste disposal manifests.
28. At the virtual visit, photos of laydown area 1 shows that this area is currently being used to stockpile material. Will all this material be removed prior to construction start or must the contractor price the removal of material prior to taking over the laydown area 1?
Response: Photos and imagery from the Preproposal Meeting are out-of-date. No contractors are currently using Laydown Area 1. Equipment and construction materials currently stored in Laydown Area 1 will be removed by the Government prior to the Notice To Proceed (NTP). There are Government-owned stones stored in this area for future use and are not to be relocated during this project. The existing stones are within 12-feet of the existing building and numerous other Contractors have used this area without issue with the stones in storage.
29. Seawall Strengthening - Landside Shoring - After review of the seawall strengthening drawings, we have assumed that no bracing will be allowed to be placed against the existing seawall. Please confirm.
Response: Confirmed, no bracing shall be placed against existing seawall.
30. Seawall Strengthening - Landside Shoring - We are assuming that the existing face of the timber cribbing behind the seawall is at least 8 feet off the back of the seawall to allow shoring of adequate size to be installed. Please confirm.
Response: Timber cribbing offsets from seawall are known to vary, but exact dimensions have not been field confirmed. The Historic Structures Report states that along the Slip North Seawall, “the drawings show a recommended distance of 9 feet between wall and crib at the top, tapering to about 3 feet at the bottom.” Offsets at the Slip South Seawall are similarly described.
31. Seawall Strengthening - Landside Shoring - The maximum depth of excavation to the bottom of the crushed stone base we have found is +/- 13.5 '. This will require a cantilever shoring system. Are there any limits on type of pile systems that may be utilized? Are there limits on installation methods? Is it acceptable to remove and reuse the shoring as there is in excess of 1600 LF of seawall strengthening?
Are there limits on removal methods?
Response: Within critical tree root zones, type of shoring installed is subject to Note 2 on Drawing TP501. Contractor’s attention is also called to General Notes, Drawings, and Specifications regarding monitoring and protection of existing structures, such as timber cribbing, seawall anchorage components, and utilities. Placement of a stable slope may be acceptable in lieu of shoring where size of work zone permits. Phasing and re-use of shoring is acceptable. Temporary shoring shall be extracted and disposed by Contractor as required by the Contracting Officer.
32. Seawall Strengthening Reinforcing Steel - What are the requirements for connection of reinforcing steel between adjacent placements? Do they need to be connected as they are acting as weight? Will couplers be required or will lap splices be allowed if connections are required?
Response: Providing either lap splice or couplers per ACI is acceptable. Construction joints shall be a minimum 6” from #10 wall dowels.
33. Seawall Strengthening - Tremie Placement - Since the strengthening concrete behind the seawall is below the MHW elevation in most places are we to assume that these placements will be required to be placed as tremie placements due to infiltration of seawater thru the wall?
Response: Placement of strengthening slab concrete may be by tremie method.
34. Specification Section 03 30 00, calls for concrete with a 4" slump. As much of the concrete is to be placed under water using a tremie mix, a 4" slump is not workable. Please provide a tremie mix spec with a greater slump.
Response: See notes under ”Cast-in-Place Concrete” on Dwg G-003.
35. Boring Reports - If available, please provide the boring reports that correspond with B series documents in drawing package. Please also provide original boring logs of project location.

36. CAD Files, If available, please provide AUTOCAD drawings of site to accurately size equipment necessary for scopes of work.
Response: The CAD files corresponding to the drawings provided with the contract documents will be made available to the Contractor following award of the contract. The CAD files will not be distributed as part of the construction contract solicitation.
37. DWG G002, General note 7 states that the contractor verify the path of the proposed combi-wall to determine if obstruction are in conflict with the wall layout on the mudline. Is it acceptable to provide this as a dive video for submittal?
Response: It is acceptable to provide dive video as a submission. Diver(s) shall probe into mudline to ensure any obstructions covered by silt are identified.
38. DWG G003, Masonry Note 1 says “in addition to the salvaged stone additional stone will be required”. This is a Design Bid Build project. How are we to determine how much stone is required in the pre-bid stage? We suggest adding a unit price be added the bid form which will help level the playing field and ensure responsible bidding.
Response: The Masonry Repair schedules indicate the number of missing blocks that are required for Masonry Repair Type 2. CLIN 10-H2 already represents a unit price for this item. See also the amended Contract Price Schedule and Specification 01 27 00.
It is noted in the contract documents and here again, any salvaged stone retrieved from the mudline must be approved by the Contracting Officer for use in the Type 2 masonry repair, as the condition of that stone is unknown. Therefore, the CLIN quantity represents the full number of missing blocks in the Masonry schedule.
39. DWG G003 Excavation and Backfilling, Note 5 require us to provide a qualified Archeologist for area’s indicated on Drawing G-110. One of the locations noted on the drawing indicates some of the historic items are in the water and may need relocation. In order to determine level of effort to relocate these items can you provide a list of what they are, rough dimensions and weight?
requirements.
Weight and dimensions of specific historic items are unknown. The historic items to be relocated are:
• Two (2) rudders
• One (1) rudder guard
• One (1) propeller shaft
• One (1) propeller
• One (1) propeller mounted on its shaft
• One (1) anchor
• One (1) steel box
• One (1) steel basin
40. The permit approved by NJDEP require the purchase of .012 acres of intertidal and subtidal shallows. Who is responsible for the mitigation bank purchase?
