Amendment 001

Questions and Responses from Pre‐Bid Meeting on 11‐30‐17

Question 1: Will the existing spud barge be accessible for construction?

Response 1: The existing spud barge located on the north end of the island is currently slated for demolition, but will likely be in place during the contract. If this is the case, contractors will be permitted to utilize it. If the barge has been demolished prior to or during the contract, contractors may bring in a temporary barge. Barge deliveries will be subject to USPP Canine Team screening prior to entering maritime security zone (Refer to Specifications, pp. 12‐13, Barge Deliveries and Access).

Contractors will not be permitted to use the boat ramp on the north side of the island.

Question 2: Clarify the 44% Goal for Small Business vs. 20% Goal for Small Business.

Response 2: There are 2 separate small business requirements. The first requirement is referenced in Solicitation Special Clause 3: Small Business Participation. The Contractor shall ensure a minimum 20% of the total contract value is performed by Small Business. This requirement may be met by i. Self‐ performance by small business prime Contractors and / or ii. Subcontracting portions of the work to small businesses. The second requirement is a small business subcontracting requirement for large business. 2017 Subcontracting goals for large business are as follows:

Small Business ‐ 44.5% of total subcontracts (the 20% of total contract small business requirement may be counted for both requirements) Small Disadvantage Business ‐ 5% of total subcontracts Woman‐Owned Small Business ‐ 5% of total subcontracts Service Disabled Veteran Owned Small Business ‐ 3% of total subcontracts.

Per Section M in the Solicitation ‐ If the apparent successful offeror is a large business the NPS will evaluate the apparent successful Offeror's proposed Subcontracting Plan. An acceptable plan must be negotiated prior to award. If an acceptable plan cannot be negotiated the apparent successful Offeror shall be eliminated from further award consideration. Large business Offerors submitting a proposal without a subcontracting plan will be considered nonresponsive and will not be considered for award.

The current 2017 subcontracting goals may or may not change for FY 2018.

Offerors may find small business partners using market research to include the Small Business Administration’s Dynamic Small Business database found at http://dsbs.sba.gov/dsbs/search/dsp_dsbs.cfm.

Question 3: What is the length of time needed for a background check for contractor employees?

Response 3: Approximately 1‐2 weeks is needed for a security check and clearance. (Refer to

Specifications, p. 10, “Guidelines for Park Access & Credentialing” dated 5/13/15).

Question 4: Are there other contracts/contractors on the island?

Response 4: Yes, there are other active contracts on the island. There is an active contract that has a

Period of Performance through July 2018 (Refer to Note 12, Sheet C2 of Powerhouse Site Improvements

Plans).

Question 5: Can the PowerPoint presentation be published as an addendum?

Response 5: The PowerPoint presentation is a part of this Amendment No. 001

Question 6: Employees park at Liberty and have to ferry over to Ellis Island. What time is the first ferry over to Ellis Island and will they have to go through security there IE: metal detectors etc.?

Response 6: Contractors will be permitted to park, make deliveries, etc. on Ellis Island per the guidance in the Division 1 Specifications (coordination, carpooling, K9 sweeps, etc.). If there are any portions of the work (e.g. the paving) that makes it impossible to park on parts or all of Ellis Island for some period of time, contractors would be responsible for finding offsite parking for their personnel and shuttling people to the job site. Liberty State Park (LSP) is one nearby location with parking that may be available for contractor parking. Any such arrangement would be between LSP and the contractor. It is anticipated that most contractors will either drive to Ellis Island or take the staff ferry from Battery Park throughout much of the project and that any offsite parking would be limited to times that this work itself makes parking on Ellis Island impossible.

Contractors can take the staff ferry from Battery Park. The first ferry from Battery Park to Ellis Island is at 6:30 am. There is no staff ferry from LSP to Ellis Island. The first visitor ferry is either 8:30 a.m. or 9 a.m., depending on season.

Regardless of which ferry, contractors will need to go through airport‐style security (including metal detectors) before boarding the boat. This generally means that it is preferable to bring any tools or supplies across the bridge to Ellis Island and not via staff boat from Battery Park.

Any vehicles that drive across the bridge to Ellis Island will need to be inspected by K9 teams. Any boats that will be entering the Maritime security zone will need to be inspected by K9 teams prior to entry, usually at their point of origin. This information is in more detail in the park access plan that is part of the Specifications.

Question 7: Can we leave a spud barge under the bridge (platform) when not working?

Response 7: That will be allowed provided it meets all applicable safety and security requirements.

Question 8: In addition to SBE’s can MBEi and WBE’s be utilized towards 20% goal?

Response 8: Any designation of small business may be utilized toward the 20% contract small business goal but for the small business subcontracting plan the goal is for Small Disadvantaged Business and the

Small Disadvantaged Business is a SBA certified designation.

Question 9: Is the prevailing wage requirement applicable to NJ/NY?

Response 9: Work occurring in New York, New York is covered under the NY Davis‐Bacon Wage rate determination and work occurring in New Jersey, Hudson County is covered under the NJ Davis‐Bacon

Wage rate determination (Refer to Specifications, p. 4, Section 01 11 00 ‐ Summary of Work, Section 1.2)

Question 10: Can we bring electrical/painting subs for additional site visits?

Response 10: Yes. Offerors should send their names and vehicle information to Noah Lumsden

(noah_lumsden@nps.gov ) and Rob Parrish (robert_parrish@nps.gov) at least 48 hours before they wish to attend. Subcontractors will not be allowed to meet with Park staff to discuss the project.

Question 11: S20 reflects HP FRP Jacket filled with concrete. S21 mentions Denso Epoxy Grout at Bent

8. Please confirm whether concrete or grout is used.

Response 11: The concrete filled jacket shown on S20 reflects an existing condition. Refer to S21 for plans to repair the auxiliary pile at Bent 8.

Question 12: Will overnight work be allowed? Is there any night activity that will need to be taken account for?

Response 12: Overnight work will be allowed and must be coordinated with Park and approved by the

Contracting Officer (Refer to Specifications, Page 7, 1.8 Work Restrictions and Time Restrictions and

Suggested Time for Performing Work on sheet S2 of the Bridge Plans). There are no specific dates listed for blackout days for overnight closures.

Question 13: Who do we speak to for access into park?

Response 13: Robert Parrish (robert_parrish@nps.gov) and Noah Lumsden (noah_lumsden@nps.gov).

Question 14: 44% SBE?

Response 14: See response to question 2.

Question 15: Permit – “in the water work”

Response 15: The restriction on in‐water work is from March 1 to June 30. While that is not specifically called out in the permit, it is one of the conditions for exemption in the Nationwide Permit (NWP) 3 from US Army Corps of Engineers. The exemption under NWP 3 is the authorization from USACE under which this project is being performed.

Question 16: Clarify “debris removal” under Span 1 and west abutment area.

Response 16: Removal and disposal of debris refers to large timbers and other items that have the potential to damage or stress any structural components of the bridge. Debris removal and disposal does not refer to general trash (can/bottles) clean‐up. (Refer to Specifications, p. 39)

Question 17: Shielding requirements.

Response 17: Shielding, catches and other means of waterway protection should be part of contractor safety plan. Depending on the means and methods, the system may be hazardous in high‐wind conditions. If that is the case, then provisions should be in place for its removal in the event of a high wind forecast (Refer to Specifications, p. 39, 01 27 00 ‐1).

Question 18: Access to bridge during the day.

Response 18: The Park has stressed the need to keep the bridge open and operable during the day. Full shutdown of the bridge must be scheduled in advance with the Contracting Officer two weeks in advance. At least one lane must be operational at all times during Park operation hours, 7:00 am – 5:00 pm during winter hours and 7:00 am – 7:00pm during extended summer hours. (Refer to Specifications,

pp. 5‐6). Contractor shall at all times conduct his operations to ensure the least inconvenience to the public. Road closures will be permitted, when required, upon specific approval of Contracting Officer for a maximum of six hours. Offerors shall provide a technical approach to construction and sequencing and should be reflected in their construction schedule.

Proposals are due 3:00 pm MT, December 21, 2017.

An exhibit is included showing the general location of the existing natural gas pressure regulator that will be relocated (Refer to Specifications, p. 43).
