About this file
This document is an Amendment (0002) to a Request for Proposal (RFP) for the Washita Battlefield National Historic Site (WABA) containing responses to Request for Information (RFI) queries. The solicitation (140P1325Q0034) involves replacing six existing roof-mounted HVAC systems with 5-ton R410a heat pump package units, each featuring 20kw electric heat strips. The amendment provides technical clarifications about the replacement units, including specific details such as voltage (208/230v), existing equipment brand (Trane), and refrigerant specifications. The government confirmed the units will be all-electric and addressed Buy American Act considerations, noting that 5-ton HVAC units are considered commercially available off-the-shelf (COTS) items. The project is being managed by the Department of the Interior National Park Service Intermountain Region, with the amendment issued on 6/10/2025 to provide additional guidance to potential contractors.

Clarification: On page 16, 52-225-1. Can we get a clarification on the for Buy American Act – Construction and Materials, as it pertains to HVAC equipment. There is also a BABA, Build American Buy American Act.
A 52.225-1 is not on page 16, however, 52.225-9 Buy American -Construction Materials (Oct 2022) is. The Clause defines COTS as commercially available off the shelf (COTS). In accordance with 41 U.S.C. 1907, the domestic content test of the Buy American statute is waived for construction material that is a COTS item, except that for construction material that consists wholly or predominantly of iron or steel or a combination of both, the domestic content test is applied only to the iron and steel content of the construction materials, excluding COTS fasteners. (See FAR 12.505(a)(2)). A 5-ton HVAC unit would be something considered commercially available off the shelf because anyone can buy one if it were in stock. Considering the government is no expert on the content of what HVAC units a contractor may propose, the contractor must determine if what they are offering is wholly or predominantly iron or steel or the combination of both. It is highly likely that the COTS 5-ton units’ contractors will likely provide, do have some iron and steel or even a combination of both, but it is not likely the units will be wholly or predominantly made of iron or steel as there are wires, coils, or condensers, which may be aluminum or copper.
