C.1. Statement of Work

1) GENERAL

The United States Geological Survey (USGS) requires services for renovation of the existing 7,600 S.F. Fish Holding Area located on the lower level of Building Segment ‘C’ of the Upper Midwest Environmental Sciences Center (UMESC) located at 2630 Fanta Reed Road, La Crosse, Wisconsin. The work will include the removal and replacement of damaged portions of the existing formed concrete trench drains, water piping distribution system, refurbishing of concrete slab flooring, and install an invasive species containment system.

Renovate Fish Holding Area using plans and specifications provided, including:

A. Selective demolition of sections of trench drains B. Relocation of piping out of the trench drains and routing at the ceiling C. Upgrades to electrical, plumbing and compressed air systems D. Installation of an invasive species containment system

2) BACKGROUND

The Upper Midwest Environmental Sciences Center (UMESC) is an ecological research center administratively positioned within the Department of Interior, U.S. Geological Survey (USGS). Built on a 65-acre campus, the UMESC office and laboratory complex, originally constructed and occupied during the period of 1975 thru 1978, initially consisted of three interconnected building segments (designated A, B, and C), each with two levels (upper, lower).

Segment C was constructed and occupied first, in 1975; Segments A and B, along with the connections between A and B and between B and C, were completed and occupied in 1978. Renovation of the Fish Holding Area will be performed within this contract. Replacing the deteriorated water supply system, the emergency aeration system, and repairing the trench and grate system in the fish holding facilities will substantially reduce the risk of losing critical test organisms and the subsequent delay of critical research activities due to a water supply outage. Renovations to the water circulation piping will add containment system to allow one section of the Fish Holding Area to be utilized for rearing invasive fish species without risk of containment loss.

3) WORK TO BE PERFORMED

a) Renovation of the existing 7,600 S.F. Fish Holding Area including all work indicated on Plans according to project

Specifications.

b) Temporary power and utilities according to these Specifications.

4) CONTRACTOR REPORTS

a) Contractor to submit daily reports of construction status to COR

i) Reports to automatically be uploaded to a secure location and accessed remotely.

ii) Reports to be created and forwarded with use of a cell phone, tablet, or computer.

iii) Reports to include the following into one complete pdf document:

(1) Date, time, weather, location, project

(2) Work performed, delays, problems,

(3) Daily pictures of task performed, pictures of problems/critical items

(4) Manpower detailed to each subcontractor and their manpower hours

(5) Visitors to site

iv) Reporting software to be used shall be one of the following or equal to

C.2. Construction Waste Management:

1. The Offeror shall maintain a recycling program to dispose of or recycle construction waste. Recycling construction waste means providing all service necessary to furnish construction materials or wastes to organizations which will employ these materials or wastes in the production of new materials. Recycling includes required labor and equipment necessary to separate individual materials from the assemblies of which they form a part. The program shall cover the following requirements:

a) The contractor shall provide continuous facilities for the recycling of incidental construction waste during initial construction.

b) Products may be excluded from the recycling program when the small quantity of material involved, the extraordinary complex nature or the waste disposal method, or prohibitive expense for recycling would represent a general hardship.

c) Records of construction materials recycled shall be maintained and accessible to the Contracting Officer. Records shall include materials recycled or land filled, quantity, date, and identification of hazardous wastes.

d) If any waste materials encountered during the demolition (construction) phase are found to contain mercury, radioactive materials or other harmful substances, they are to be handled and removed in accordance with State and Federal laws and requirements concerning hazardous waste

C.4. Environmentally Preferable Building Products and Materials

(a) The contractor shall use environmentally preferable products and materials where economically feasible. Environmentally preferable products have a lesser or reduced effect on human health and the environment when compared to other products and services that serve the same purpose.

(b) Refer to EPA's environmentally preferable products web site, www.epa.gov/opptintr/epp. In general, environmentally preferable products and materials do one or more of the following -

(1) Contain recycled material, are biobased, or have other positive environmental attributes;

(2) Minimize the consumption of resources, energy, or water;

(3) Prevent the creation of solid waste, air pollution, or water pollution;

(4) Promote the use of non-toxic substances and avoid toxic materials or processes.

C.5. Hazardous Material Identification

(a) In accordance with clause FAR 52.223-3, Hazardous Material Identification and Material Safety Data, Alternate I, the contractor shall provide Materials Safety Data Sheets (MSDS) for the following products prior to their use under this contract: adhesives, caulking, sealants, insulating materials, fireproofing or firestopping materials, paints, carpets, floor and wall patching or leveling materials, lubricants, clear finish for wood surfaces, janitorial cleaning products, pesticides, rodenticides, and herbicides.

(b) The Government reserves the right to review such products at any time. The Contracting Officer may eliminate from permitted use under this contract products with significant quantities of toxic, flammable, corrosive or carcinogenic material and products with potential for harmful chemical emissions.

C.6. Energy Efficient Products

(a) When acquiring energy-using products, the contractor shall purchase ENERGY STAR® or other energy-efficient items listed on the Department of Energy’s Federal Energy Management Program (FEMP) Product Energy Efficiency Recommendations product list. This clause applies to any power-consuming equipment to be installed or used in USGS facilities, whether title to the equipment will pass to the Government or be retained by the Contractor.

(b) For products that consume power in a standby mode (as listed on FEMP’s Standby Power Devices product listing), the contractor shall -

(1) Purchase items which meet FEMP’s standby power wattage recommendation or document the reason for not purchasing such items; or

(2) If FEMP has listed a product without a corresponding wattage recommendation, purchase items which use no more than one watt in their standby power consuming mode. When it is impracticable to meet the one watt requirement, purchase items with the lowest standby wattage practicable.

(c) The requirements of this clause do not apply if (1) no compliant product’s utility and performance can meet the contractor’s need or contract specifications, (2) compliance would not be life-cycle cost-effective, or (3) compliant solutions are otherwise not available.

C.7. Environmental Requirements – Selected Construction Materials

Asbestos - No asbestos-containing fireproofing or insulation on building structEures, acoustical treatment, molded or wet-applied ceiling or wall finishes/decorations, or pipe and boiler insulation (including duct, tank, etc.) is permitted in new materials provided by the contractor.

New installations of wood products used under this contract must not contain wood from endangered wood species, as listed by the Convention on International Trade and Endangered Species (CITES). The list of species can be found at www.certifiedwood.org/Resources/CITES/ CITESContent.html.

Particle board, strawboard and plywood materials shall comply with HUD Standards for VOC emissions (particleboard: 0.2 ppm of formaldehyde, plywood: 0.3 ppm of formaldehyde).

Adhesives and Sealants - All adhesives employed on this project (including, but not limited to, adhesives for carpet, carpet tile, plastic laminate, wall coverings, wood adhesive, or sealants) shall be those with the lowest possible Volatile Organic Compound (VOC) content below 20 g/L. and which meet the requirements of the manufacturer of the products adhered or involved. The contractor shall use adhesives and sealants with no formaldehyde or heavy metals.

Insulation - Thermal, Acoustic, and HVAC - All insulation products shall contain recovered materials as required by EPA's Comprehensive Procurement Guideline and related recycled content recommendations. No insulation installed with this project shall be material manufactured using chlorofluorocarbons (CFCs), nor shall CFCs be used in the installation of the product.

SECTION G. CONTRACT ADMINISTRATION DATA

G.1. 1452.201-70 Authorities and Delegations (SEP 2011)

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.

(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.

(c) The COR is not authorized to perform, formally or informally, any of the following actions:

(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;

(2) Waive or agree to modification of the delivery schedule;

(3) Make any final decision on any contract matter subject to the Disputes Clause;

(4) Terminate, for any reason, the Contractor's right to proceed;

(5) Obligate in any way, the payment of money by the Government.

(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.

(f) The Contractor shall provide copies of all correspondence to the Contracting Officer, COR

G.2. DOI ELECTRONIC INVOICING Electronic Invoicing and Payment Requirements - Internet Payment Platform (IPP) (September 2011)

Payment requests must be submitted electronically through the U. S. Department of the Treasury's Internet Payment Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts. Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice:

The Contractor must use the IPP website to register, access and use IPP for submitting requests for payment. G.4. Unilateral Deobligation of Unexpended Funds

The contractor shall submit all invoices under the award no later than 90 calendar days after the period of performance has expired, unless a request for extension has been submitted to the Contracting Officer. After 120 days has passed since the expiration of the performance period, the government reserves the right to issue a unilateral modification deobligating any unexpended funds, and to initiate closeout procedures.

SECTION H. SPECIAL CONTRACT REQUIREMENTS

H.1. GS1125 Schedule Of Prices (Construction)

In accordance with the clause FAR 52.232-05, Payments under Fixed-Price Construction Contracts, the contractor shall, 140G0118R0016 Page 14 of 37 within 7 days after receipt of notice of award, submit to the Contracting Officer for approval, a Schedule of Prices. This schedule shall consist of a detailed breakdown of the contract price, segregated under each of the significant construction categories. It shall state the quantities for each of the various types of work, the unit prices, and extended totals.

Subcontractors who may be involved in more than one category of work must provide the same breakout data for each category. The submission of the required data shall not otherwise affect the contract terms.

H.2. GS1305 Contractor Performance Assessment Reporting System

(a) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of the Interior (DOI) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR 41.15

(b) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluation past performance as part of a source selection action.

(c) DOI will utilize the Primary and Alternate Points of Contact shown in central Contractor Registration (CCR) as the past performance contacts for your company that will be notified to complete the performance evaluation on behalf of your firm.

If you have not yet designated Past Performance Points of Contact in CCR, we recommend that you do so, and request that you furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award.

Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.

(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically-generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at http://www.cpars.csd.disa.mil/. The CPARS User Manual, registration for On Line Training for Contractor Representatives, and a practice application may be found at this site.

(e) Within 60 days after the end of the performance period(s) specified in paragraph (a), the Contracting Officer will complete and interim or final past performance evaluation, and the report will be accessible at http://www.cpars.csd.disa.mil/.

Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment. Comments are limited to the space provided in Block 22. Your comments should focus on objective facts in Assessing Official's narrative and should provide your views on the causes and ramifications of the assessed performance. In addition to the ratings and supporting narratives, blocks 1 - 17 should be reviewed for accuracy, as these include key fields that will be used by the Government to identify your firm in future source selection actions. If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating "Not comment" in Block 22, and then signing and dating Block 23 of the form. Without a statement in Block 22, you will be unable to sign and submit the evaluation back to the Government. If you do not sign and submit the CPAR within 30 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment." Your response is due within 30 calendar days after receipt of the CPAR.

(f) The following guidelines apply concerning your use of the past performance evaluation:

(1) Protect the evaluation as "source selection information." After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the Contracting Officer for instructions.

(2) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.

(3) Prohibit the use of or reference to evaluation data for advertising, promotional material, preaward surveys, responsibility determinations, production readiness reviews, or other similar purposes.

(g) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the Contracting Officer no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 30-day review period.

(h) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.

H.3. GS1310 Organizational Conflicts of Interest—General

(a) The term “organizational conflict of interest” means a situation where a contractor has interests, either due to its other activities or its relationships with other organizations, which place it in a position that may be unsatisfactory or unfavorable

(i) from the Government’s standpoint in being able to secure impartial, technically sound, objective assistance and advice from the contractor, or in securing the advantages of adequate competition in its procurement; or (ii) from industry’s standpoint in that unfair competitive advantages may accrue to the contractor in question.

(b) The contractor agrees that, if after award he discovers an organizational conflict of interest with respect to this contract, he shall make an immediate and full disclosure in writing to the Contracting Officer, which shall include a description of the action which the contractor has taken or proposes to take to avoid, eliminate, or neutralize the conflict. The Government may, however, terminate the contract for the convenience of the Government if it would be in the best interests of the Government.

(c) In the event that the contractor was aware of organizational conflict of interest prior to the award of this contract and failed to disclose the conflict to the Contracting Officer, the Government may terminate the contract at no cost to the Government.

H.4. GS1330 KEY PERSONNEL JULY 2001

During contract performance, the Contractor must utilize the key personnel proposed or replace with personnel who have the same or better qualifications, subject to Government approval.

H.5. GS1338 Notice to the Government of Delays

In the event the contractor encounters difficulty in meeting performance requirements, or when it anticipates difficulty in complying with the contract delivery schedule or date, or whenever the contractor has knowledge that any actual or potential situation is delaying or threatens to delay the timely performance of this contract, the contractor shall immediately notify the contracting officer and the COR, in writing, giving pertinent details. This data shall be informational only in character.

Notice under this provision shall not be construed as a waiver by the Government of any delivery schedule or date or of any rights or remedies provided by law or under this contract.

H.6. GS1348 Accident Reporting

If an accident occurs on Government-controlled facilities, a report must be provided to the Contracting Officer's Representative and the Contracting Officer within 48 hours. An accident is defined as an event which causes injury, illness, or loss or damage to Government-owned or private property. The contractor will cooperate with any ensuing Government accident investigation.

H.7. GS1354 List of Subcontractors (Construction)

For purposes of monitoring compliance with the insurance and payroll reporting requirements of this contract, the contractor

H.8. GS1414 Contractor Personnel Clearance and Identity Credentials

(a) During all operations on Government premises, contractor personnel shall comply with the rules and regulations governing the conduct of personnel and the operation of the facility.

SEE SECURITY REQUIREMENTS AT SPECIFICATION SECTION 017960. All work performed at the USACE location designated as the place of performance will comply with Specification Section 017960. The security requirements at Specification Section 017960 take precedence over the security requirements provided within this clause.

(b) USGS rules regarding physical security and personnel security apply to all personnel in USGS facilities. The rules are contained in the following directives, available at http://www.usgs.gov/usgs-manual/handbook/index.html:

(c) Each contractor (or subcontractor) employee requiring recurring access to USGS facilities will be required to obtain a USGS-issued identification badge. Government-issued identity credentials must be worn upon entry and displayed at all times while on federally controlled property, unless otherwise instructed by the COR. Prior to obtaining the badge, the contractor is required to initiate a background suitability check on each such employee in accordance with USGS National Security Position Handbook. The type of background investigation required is based on the risk/sensitivity level designation, as described in the Statement of Work. This clearance/credential requirement does not apply if the contractor does not have any unsupervised IT system access and will only need building access for less than 6 months or only occasional building access (such as for periodic equipment maintenance). In those cases, building procedures for visitors will be applied.

(d) At least 2 weeks before starting work, the contractor will provide a listing to the COR/technical liaison identifying contractor and subcontractor employees requiring access to USGS facilities or systems for performance of work hereunder.

(e) The contractor employees are required to complete the applicable clearance request forms provided by the COR. The following forms, or their equivalent may be used to initiate the credentialing process: SF 85 or SF 85-P (which includes authorization for credit check), SF 86, OF-306, and/or other forms designated for this purpose by the Office of Personnel Management (OPM), Federal Protective Service, or other federal agency in whose space work will be performed under this contract.
