DIVISION 01 – GENERAL REQUIREMENTS
SECTION 01 14 00 – WORK RESTRICTIONS
PART 1 - GENERAL
1.1 SECTION INCLUDES
A. This Section specifies work sequence and constraints.
B. The purpose of the milestones, sequence and limitations of construction are to ensure that the Contractor understands the requirements and limitations on its work by the specific characteristics of the Contract, schedules and conducts work in a manner consistent with achieving these purposes, and complies with the construction schedule, the specific sequence, constraints, milestones and limitations of work specified.
C. Sequence of construction: Plan the sequence of construction to accommodate all the requirements of the specifications. The Contract Price shall include all specified requirements as described in this Section.
1.2 SUBMITTALS
A. The Contractor shall, within 5 days after work commences on the contract or another period of time as determined by the Contracting Officer, prepare and submit to the Contracting Officer for approval three copies of a practicable schedule showing the order in which the Contractor proposes to preform the work, and the dates on which the Contractor contemplates starting and completing the several salient features of the work (including acquiring materials, plant, and equipment). The schedule shall be in the form of a progress chart of suitable scale to indicate appropriately the percentage of work scheduled for completing by any given date during that period. If the Contractor fails to submit a schedule within the time prescribed, the Contracting Officer may withhold approval of progress payments until the Contractor submits the required schedule.
B. The Contractor shall enter the actual progress on the chart as directed by the Contracting Officer, and upon doing so shall immediately deliver three copies of the annotated schedule to the Contracting Officer. If, in the opinion of the Contracting Officer, the Contractor falls behind the approved schedule, the Contractor shall take steps necessary to improve its progress, including those that may be required by the Contracting Officer, without additional cost to the Government. In this circumstance, the Contracting Officer may require the Contractor to increase the number of shifts, overtime operations, days of work, and/or the amount of construction plant, and to submit for approval any supplementary schedule or schedules in chart form as the Contracting Officer deems necessary to demonstrate how the approved rate of progress will be regained.
C. Failure of the Contractor to comply with the requirements of the Contracting Officer under this clause shall be grounds for a determination by the Contracting Officer that the Contractor is not prosecuting the work with sufficient diligence to ensure completion within the time specified in the contract. Upon making this determination, the Contracting Officer may terminate the Contractor’s right to proceed with the work, or any separable part of it, in accordance with the default terms of this contract.
1.3 CONTRACTOR ACCESS AND USE OF PREMISES
A. Activity Regulations
1. Ensure Contractor personnel deployed to the project become familiar with and follow all regulations or restrictions established by the Engineer.
B. Aquaculture Operations
1. Protect aquaculture systems and facilities adjacent to the work area to ensure that existing aquaculture operations on the site are not disrupted.
C. Work Site Regulations
1. Keep within the limits of work and assigned avenues of ingress and egress. Do not enter any areas outside the designated work location unless previously approved by the Engineer. The Contractor must comply with the following conditions:
a. Be responsible for control and security of Contractor-owned equipment and materials at the work site.
b. Ensure all materials, tools and equipment will be removed from the site or secured within the designated laydown areas at the end of each shift.
1.4 WORK SEQUENCE AND CONSTRAINTS - GENERAL
A. Electrical Work Constraints
1. Electrical transmission and distribution lines are located along Lower Klamath Lake Road and within the project property. All work by the Contractor shall conform with the regulations of the serving electrical utilities.
2. Areas with low overhead clearances shall be identified and marked by the Contractor.
B. The Contractor shall sequence and prioritize the Work in accordance with the following constraints and requirements.
1. Submit pre-work submittals within 5 days of Contract Execution required for Notice to Proceed and approval to access the site.
2. Contractor to coordinate with USFWS mobilization and schedule. Contractor and USFWS to proceed through a contractor coordination process including Phase 1-3 contractors. The contractor coordination process will be an in person coordination meeting to discuss schedules and arrange for limited disruption to one another while also maintaining necessary hatchery operation.
3. Mobilize on site upon approval of pre-work submittals.
4. Implement SWPPP requirements to begin work on site.
5. Contractor shall preserve access to existing hatchery operation by Owner at existing Tilapia ponds, rearing ponds, influent retention pond, and the existing hatchery buildings.
6. Contractor shall preserve operation of the current ¼ acre ponds in Lease Area 1 and the small “B ponds” in Lease Area 2 until fish can be relocated to the completed Phase 1 ponds. Current estimated completion of Phase 1 ponds is late summer/Fall 2023.
7. Contractor shall prepare and execute a plan that coordinates ponds excavation and lining with placement of excavated material in the areas identified within the Drawings and per Section 31 00 00. The plan should include at a minimum operations and equipment to be used for spreading and drying.
8. Coordinate work with Pacific Power. Permanent power infrastructure included in the Contract shall be complete prior to Pacific Power installing cabling and meter.
