ADDENDUM TO FAR 52.215-1 INSTRUCTIONS TO OFFERORS--COMPETITIVE
ACQUISITION (JAN 2017) - ALTERNATE I (OCT 1997)
A. Period for Acceptance of Offers. Proposals shall remain valid for acceptance for a minimum of 90 days from receipt of proposal.
B. Proposals are expected to conform to solicitation provisions and be prepared in accordance with this section.
To aid in evaluation, a proposal shall be clearly and concisely written as well as being neat, indexed (cross-indexed as appropriate) and logically assembled. All pages of each part shall be appropriately numbered and identified with the name of the Offeror, the date, and the solicitation number. A one-page transmittal letter signed by an individual authorized to commit the organization shall be transmitted with the proposal to the Government. Each proposal shall be on 8 and ½-inch x 11-inch paper, in a commercially standard font, not smaller than 12-point font. Each page in the proposal shall be separately numbered.
C. Offers must be received prior by the due date and time specified in the Sam.gov Beta (formerly FBO.gov) announcement. Proposals received after this date and time are late and will not be accepted.
The proposals shall be submitted via email to the Contract Specialist, Forest Crumpler at forest.crumpler@nist.gov by the due date and time specified in the Sam.gov Beta (formerly FBO.gov) announcement. Fax, postal, or hand-delivery submissions will NOT be accepted.
PROPOSAL CONTENT:
Each proposal shall consist of two separate electronic files: Volume I: Technical Proposal and Volume II: Business/Price Proposal. The contents of each shall be as follows:
Volume I Technical Proposal: No pricing information shall be included in the technical proposal. The technical proposal shall include the following:
1. Payment and Performance Bond – Offerors must submit a notarized statement or letter from its surety which must include the following:
1. Individual task order bonding capacity equivalent to the maximum task order dollar amount of $3,000,000.
2. Aggregate bonding capacity of $9,500,000.
3. Statement is an original document notarized with a raised seal or embossed stamp.
4. Power of Attorney letter.
2. Multidisciplinary Experience – Offeror must submit information/evidence that demonstrates completion of construction projects in an operational (occupied) commercial, industrial, or Government research laboratory similar to the Statement of Work.
The Offeror must submit at least three relevant construction contracts/task orders. The Offeror shall include a narrative describing their experience planning, organizing, and executing the project to ensure completion of work and allowed the sustainment of building occupancy during work. For each project submitted, the Offeror shall describe its method for construction sequencing, work control, quality assurance and inspection/testing protocols.
The Relevant Multidisciplinary Experience Criteria is as follows:
1. The work must have been completed with the past 72 months prior to May 2021.
2. The minimum value of the contract /task order must be greater than $200,000.
3. In order to be considered relevant, project must demonstrate the Offeror's experience in an operational (occupied) laboratory with at least six of the following elements:
a. Fire Alarm modifications.
b. Fire Protection System modifications
c. Industrial Alarm and Safety Systems
d. Communication Systems
e. HVAC Equipment and Ductwork.
f. HVAC Piping and Insulation (steam, chilled water, heating hot water, etc.).
g. Plumbing Systems (potable water, industrial water, laboratory waste, sanitary sewer, storm drainage, etc.)
h. Electrical Equipment and Distribution.
i. Exterior wall penetrations
j. Door modifications: interior, exterior (including entry and exit card readers), and coiling.
k. Flooring
l. Exterior Envelope Changes (exterior walls (masonry and other), glazing, roofing, foundations)
m. Interior Wall Changes that are either metal or drywall
n. Ceiling Modifications.
4. High school and other teaching laboratories will not be deemed as research laboratories in a scientific or industrial setting.
Each relevant construction contract/task orders shall include the following information:
1. Project title and location.
2. Contract value at both award and completion.
3. Project start date.
4. Project completion date both planned and actual.
5. Provide the name of the project manager and construction superintendent for the project.
6. Provide the Company Name and Role for subcontractors used on the project.
7. Name, email address, and current telephone number for project owner and/or project owner's construction manager.
3. Specialized Experience – The Government will evaluate evidence the Offeror submitted that demonstrates completion of construction projects in an operational (occupied) commercial, industrial, or Government research laboratory similar to the Statement of Work.
The Offeror must submit three relevant construction contracts/task orders. The Offeror shall include a narrative describing their experience planning, organizing, and executing the project to ensure completion of work. For each project submitted, the Offeror shall describe its method for construction sequencing, work control, quality assurance and inspection/testing protocols.
The Relevant Specialized Experience criteria is as follows (specialized experience must meet all stated below):
1. The work must have been completed with the past 72 months prior to May 2021.
2. The minimum value of the contract /task order must be greater than $150,000.
3. In order to be considered relevant:
a. The project must demonstrate specialized experience with Electrical Systems (various voltages preferred - US and European) and phases as well as uninterruptable power systems.
b. The project must demonstrate specialized experience with at least one of the following additional elements:
i. Mechanical Systems including steam, chilled water, and HVAC.
ii. Process Gas distribution and storage.
iii. Cryogenic fluid distribution and storage.
4. High school and other teaching laboratories will not be deemed as research laboratories in a scientific or industrial setting.
Each relevant construction contract/task orders shall include the following information:
1. Project title and location.
2. Contract value at both award and completion.
3. Project start date.
4. Project completion date both planned and actual.
5. Name, email address, and current telephone number for project owner and/or project owner's construction manager.
4. Technical Approach – The Offeror shall provide any and all materials required to adequately describe its approach to planning, organizing, and executing associated tasks, in general and the tasks specified in Task Order 001 to ensure successful completion. The Offeror's technical approach shall include its method for construction sequencing, work control, meeting specific critical schedule milestones in the task order, purchasing materials, quality assurance and inspection/testing protocols included in both drawings and specification sets. The Offeror shall describe the specific control measures for sustaining critical operation throughout each phase of construction with minimal downtime. Additionally, offerors shall include any information to demonstrate the ability to perform multiple task orders concurrently, allowing for the potential to expedite the task schedule.
5. Past Performance – In addition to the information provided for the Multidisciplinary and Specialized Experience sections above, offeror shall include any past performance information to assess the quality, timeliness, and ability to control cost and schedule. Additionally, offeror must include a letter submitted from the Nation Council on Compensation Insurance (NCCI) or its calculating state agency verifying the Offeror's EMR for the most recent rating period only.
Volume II Business/Price Proposal:
Price Proposal shall include the following:
The Offeror must provide an itemized price proposal to perform Task Order 001, Building 235 - Roof Access Improvements.
Other Required Items:
1. Completed price schedule (see Section B of solicitation) and all applicable documentation to price breakdown for Task Order 001, Building 235 – Roof Access Improvements.
2. Completed SF1442 including Offeror’s DUNS no., point of contact information with name, telephone number, and email address. The person signing the SF1442 shall have the authority to commit the Offeror to all of the provisions of the proposal, fully recognizing that the Government has the right, by the terms of the solicitation, to make an award without further discussion if it so elects.
3. Signed amendments to the solicitation, if any are issued.
4. Completed Offeror Representations and Certifications, which can be referenced in the Offerors SAM registration at www.SAM.gov.
5. Acceptance of terms: This is an Open-Market Solicitation for services as defined herein. The Government intends to award a single award contract as a result of this solicitation that will include the terms and conditions that are set forth herein.
Acceptance of Terms and Conditions (Addendum to FAR 52.212-1(b) (11)):
If the contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:”
[Contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the contractor to identify in their quote any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor’s acceptance of the Government’s terms and conditions for inclusion into the resultant purchase order.

Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the quoted price. However, the terms and conditions stated herein will be included in any resultant purchase order, not the terms and conditions of the Offeror’s FSS or GWAC contract, and the statement required above shall be included in the quotation.
