Pier Romeo Recapitalization North Charleston, SC

Amendment 0006

The purpose of this Amendment is to accomplish the following:

(1) Include “Floating Pier Pile Design Sheet Pile Seawall and

Approach Ramp Retaining Wall Design - 2022” in Section J.6 of the solicitation.

(2) The Proposal Template has been updated to reflect a requirement for Unit Pricing for Contaminated Soil Removal & Disposal. The task shall be for Contaminated Soil Removal & Disposal per cubic yard (CY)and shall include:

1. All construction, design, and procurement services to remove and dispose of potentially contaminated onsite soil at a Subtitle D Landfill. Including bringing back and placing imported fill material as required.

2. Price is required in Price Proposal Template and in Section B - Unit Pricing for Contaminated Soil Removal & Disposal.

3. THIS PER CY PRICE SHALL NOT BE INCLUDED IN OVERALL TOTAL

PRICE FOR BASE CLIN AND Optional CLINs (2, 3, 4, 5, and 6)

AND IS INTENDED TO ESTABLISH A CY RATE SHOULD THIS ACTIVITY

BE REQUIRED.

(3) Provide Offeror’s Questions and Government’s Responses.

Offeror’s Question: Amendment 0004, page 14 RFI asks what CLIN should concrete resilient curbing go and response was for fencing - please confirm concrete resilient curbing goes in CLIN 0001?

Government’s Response: Confirmed resilient curbing is to be included in CLIN 0001.

Offeror’s Question: Amendment 0004, page 15 states the pier is now to be designed for CAT 4 hurricane with two ships moored. The current RFP bridging documents are not designed for this requirement and will require us to fully re-design the piling and floating pier which is a major undertaking for bid pricing which will take 4 weeks between the DOR and the Pier Vendor. Please confirm the validity of this with AECOM. Please extend the bid due date two additional weeks to allow this to occur from 4/18/23 to 5/2/23?

Government’s Response: Pier Pile Clarification: The pier and the associated structural members were designed in the Concept Documents to include two (2) ships the size of the Ronald H. Brown during a Category IV Hurricane condition. Preliminary pile structural design includes loading from Category IV storm condition current, wave, and wind coupled with sea level rise as well as an increase in water level from the storm surge to ensure pile capacity will be sufficient in extreme conditions. These loads were applied to both the floating structures and two design vessels (Ronald H. Brown) assumed to be docked at the pier during the storm event contributing to higher loads. A 50% sheltering factor was used in determining wind loads on

PAGE 3 OF 9 1305M423RNAAJ00040006

1305M423RNAAJ0004

the second moored vessel when the wind is blowing in a broadside direction to the vessels. Load combinations per UFC 4-152-01 Tables 3- 7 and 3-8 were used to determine the loads on the piles. The Ratio of demand load on pile to capacity of pile was calculated to be 0.93 which is less than 1.0. The 0.93 ratio would be acceptable per the aforementioned Tables 3-7 and 3-8. The design build contractor will be responsible for final design of the pier and associated piles above and beyond the information provided in the Concept Documents. Please reference the updated structural calculations for reference.

Mooring Analysis Clarification:

Preliminary mooring analysis was done in Optimoor software only to determine mooring loads to design bollard size and location. The software only allows for one (1) ship to be modeled for the mooring analysis. Due to these software limitations for running with two vessels on opposite sides of the floating dock only one vessel was used for analysis. The 100 Ton Mooring bollards have been placed on both sides of the floating dock to accommodate two design vessels (Ronald H. Brown) to be moored to floating dock during a Category IV storm condition. Note: the Optimoor software only applies to the mooring bollards and does not affect the pier structural design with regards to the piles and floating structure. The mooring calculations would be the same for both sides of the pier since the ship being considered is the same size. The design building contractor will be responsible for a final detailed analysis and design of the bollard and mooring system. Final sizes and locations to be determined by the design build contractor. Please reference the updated structural calculations for reference.

This information provided is accurate and meets the narrative and Solicitation requirements. No extension of time is warranted.

Offeror’s Question: Amendment 0004, page 19 states to cut piles 3 ft below dredging depth which cannot be since dredging is not in scope.

Please confirm to cut piles 3 ft below the mudline?

Government’s Response: Confirmed, the contract will be required to cut piles 3ft below existing, or the contractor can fully remove the pile.

Offeror’s Question: Amendment 0004, page 20/21 states it is the contractor and designer decision to determine if the existing soils are unsuitable. We agree, but that is, post award. For bidding purposes please either provide an allowance, an unit price and quantity to carry, or have us exclude unsuitable soils since this scope cannot be quantified during bid?

Government’s Response: A Unit Pricing for Contaminated Soil Removal & Disposal has been added to the Price Proposal Template and Section B per this Amendment.

PAGE 4 OF 9 1305M423RNAAJ00040006

1305M423RNAAJ0004

Offeror’s Question: Amendment 0004, page 22 states satisfaction means a fully functional and operational facility. Please confirm this means in accordance with the RFP documents and Amendments?

Government’s Response: E.4.1.1 “Final Completion and Acceptance” means the stage in the progress of the work as determined and certified by the CO or COR, in writing to the Contractor, on which work required under the contract has been completed in an acceptable manner in accordance with the contract requirements, subject to the discovery of latent defects after final completion and except for items specifically excluded in the notice of final acceptance.

Offeror’s Question: Amendment 0004, page 23/24 RFI response did not answer if the design submission comments can just be addressed in the next design submission in lieu of having to resubmit as outlined in Section F Schedule of Deliverables? Two design submissions for every design submission (35 / 65 / 95 / IFC) is not typically done.

Government’s Response: The intent of the 35%/65%/95% Design Submittal and approval is to capture any comments or changes that arise from the 35%/65%/95% design meetings and can be captured and documented within the subsequent submittal. For instance, the comments from the 35% Design Meeting should be captured and documented within the 65% submission, and the comments from the 65% Design Meeting, will be captured and documented in the 95% submission and so on.

Offeror’s Question: Amendment 0004 does not include all the responses to critical outstanding RFIs. Due to the significant pier design change of having two ships moored during a CAT 4 hurricane and not having all the remaining RFI responses, please consider extending the bid 4 weeks after receipt of RFI responses to provide adequate time to re-design pilings and pier, incorporate RFIs into design and technical, time to relay all the changes to the trade subcontractors for pricing, and to make any adjustments to a significant technical requirement?

Government’s Response: This information provided is accurate and meets the narrative and solicitation requirements. Preliminary mooring analysis was done in Optimoor software only to determine mooring loads to design bollard size and location. The software only allows for one

(1) ship to be modeled for the mooring analysis. Due to these software limitations for running with two vessels on opposite sides of a floating dock only one vessel was used for analysis. The 100 Ton Mooring bollards have been placed on both sides of the floating dock to accommodate two design vessels (Ronald H. Note: the Optimoor software only applies to the mooring bollards and does not affect the pier structural design with regards to the piles and floating structure. The mooring calculations would be the same for both sides of the pier since the ship being considered is the same size. The design building contractor will be responsible for a final detailed

PAGE 5 OF 9 1305M423RNAAJ00040006

1305M423RNAAJ0004

analysis and design of the bollard and mooring system. Final sizes and locations to be determined by the design build contractor. Please reference the updated structural calculations for reference. No extension of time is warranted.

Offeror’s Question: Amendment 0004, page 31 states the contractor is responsible for any damages found during post award TV utility inspection. How can we be responsible for discovered underground existing utility damages that are unknown? Page 34 RFI states SW to have a 50 year life. For bidding purposes, is NOAA stating to assume replacing all existing stormwater piping/system with new?

Government’s Response: As stated in Amendment #4: A post installation TV inspection is required to ensure the final product is working and free of any damage or blockages. Should the contractor plan to reuse the existing storm water system that is a risk the contractor is taking. The Government would NOT pay for that as a changed site condition.

Offeror’s Question: Amendment 0004, page 34 states the DBT is to provide a design that meets the Government requirements for the two trash pumps. Please provide what these pumps are for and are they portable, amount of trash capable for, etc?

Government’s Response: As stated in Amendment 4, the DBT is to provide a design that meets the Government’s requirements.

Offeror’s Question: Amendment 0004, page 29 discusses background checks but does not provide the current forms required by FLETC for worker access. Currently, the FLETC is requiring credit checks on top of the criminal background checks. Please provide a copy of the background check forms being required by workers so it can be incorporated in our pricing? Also confirm that credit checks are required for worker access?

Government’s Response: The form can be found in Section J, under J.7 entitled “Pier Romeo Facility Access Form.”

NOAA checked with FLETC on the credit check question and they said FLETC subcontractors are not required to provide a credit check form.

If contractors will be needing FLETC access for up to 1 year, it’s a two part process as shown below:

Part 1) FLETC Approval: NOAA POC submits to FLETC POC, they give a pre -approval usually up to 30 days in that time we must have our NOAA approval completed & back to them, bolded items are completed/provided to NOAA POC contact via kiteworks from their Company POC collecting the info. NON- bold are items NOAA POC collects.

● Applicant OF 306

● 2 forms of ID

PAGE 6 OF 9 1305M423RNAAJ00040006

1305M423RNAAJ0004

● FLETC-DHS Form 11000 (completed by NOAA POC)

Part 2) NOAA POC submits a security package to OSY/ERSO for a Tier 1 clearance (previously NACI); this needs to be completed/approved by NOAA before the 30 day FLETC pre- approval timeline is up. The process initiates the eQIP (background investigation) link to be sent & completed by the applicant.

● Applicants OF 306

● 2 forms of ID

● 2 Fingerprint cards completed

● Resume/Employee Application for Hire

● NOAA POC: submits a CD591; OSY Cover Sheet; PDT (position designation tool)

Offeror’s Question: Amendment 0004, page 35/36 states to refer to the geotechnical report for information about soils. The geotechnical report does not provide any information on defining the quantity for unsuitable soils. This is an unknown at this time and need direction to price. For bidding purposes please either provide an allowance, an unit price and quantity to carry, or have us exclude unsuitable soils since this scope cannot be quantified during bid?

Government’s Response: A requirement for Unit Pricing for Contaminated Soil Removal & Disposal has been added to the Price Proposal Template and Section B. Contractor shall provide their per cubic yard (CY) cost for potential contaminated soil removal cost as instructed in Paragraph 2 of this Amendment.

Offeror’s Question: Amendment 0004, page 36 states period of performance is to substantial completion. Then should we assume contract final completion is a month after substantial completion?

Government’s Response: Confirmed. Final completion is 30 days after Substantial completion.

Offeror’s Question: Amendment 0004, page 37 does not address what CLIN the platform for submersible crafts should be included. Please provide?

Government’s Response: The platform for submersible crafts should be included in CLIN 0002.

Offeror’s Question: Amendment 0004, page 38 RFI asks if SC DOT should be used, not CA DOT but the answer does not address the question.

Should we use SC DOT?

Government’s Response: South Carolina DOT does not have published corrosion rates. Use CA DOT corrosion rates provided.

PAGE 7 OF 9 1305M423RNAAJ00040006

1305M423RNAAJ0004

Offeror’s Question: Amendment 0004, page 48 NOAA is allowing hard copies of previously filled out PPQs to be submitted in lieu of the NOAA PPQ form. Please confirm that hard copies of previous CPARS can also be emailed to NOAA POC for the same reasons?

Government’s Response: Not Confirmed. Previously filled out Past Performance Questionnaires may be submitted in lieu of the NOAA PPQs.

As per Section L.9.2.5.2 Other Sources: "In evaluating the Offeror's past performance, the Government may consider the information in the Offeror's submittal as well as information gathered from other sources including former customers, Government agencies, federal databases (e.g. CPARs) and other references." The Contracting Officer has access to the CPARs database and can obtain the information.

Offeror’s Question: Amendment 0004, page 52/53 provides 52.216-2 clause and asks for it to be completed and included in the proposal.

This form is for unit prices and this proposal does not have any unit prices, it’s a lump sum, so please clarify what is wanted and for what?

Government’s Response: In accordance with the full text version outlined in Amendment 0004, the offeror shall “warrant that the unit price stated in the Schedule for _____.” As the offeror’s cost will be lump sum per CLIN, the offeror shall accompany this Clause with a spreadsheet which provides a detailed listing of the materials which may be directly impacted and would warrant the usage of this Clause.

This option would permit unit pricing based on your current rated for each item/material.

Offeror’s Question: Amendment 0004 RFI response on page 44 regarding the proposal template states: “The Proposal Template is attached to the proposal via paperclip. The proposal must be downloaded and the Proposal Template is attached on the left.” Our team is unable to locate and/or download this file. Please provide the proposal template as a separate file.

Government’s Response: The Proposal Template is provided on SAM.gov in Links/Attachments.

Offeror’s Question: The current electrical equipment supply industry has extraordinary leads times that do not seem to be getting any better, and in some cases worse. The most critical items pushing the project schedule is the switchgear and the generator set. Upon submittal approval, the lead time for the switchgear can be 80 weeks (18.5 months) depending on final design, and the generator set is currently 76 weeks (17.5 months). Based on the RFP/Section F Delivery Schedule long lead items are to be submitted with the design IFC so the design/approval period for long lead items is 13 months. Adding the 18 months for electrical equipment procurement and another 4 months for install/energize/Siemens approval/commissioning this makes

PAGE 8 OF 9 1305M423RNAAJ00040006

1305M423RNAAJ0004

the Period of Performance 35 months. Please extend the Period of Performance 8 months, from 27 months to 35 months.

Government’s Response: The POP has been extended from 850 days to 925 days per Amendment #5. Additionally, the latest the contractor could submit their long lead submittals per the scope is at the IFC;

however, nothing in the scope prevents the DBT from providing long lead submittals and ordering equipment earlier than the IFC Design.

The Solicitation states to provide the government a list of the long lead material/equipment items with the 35%, 65%, and again with the 95% design submittals to help support the long lead items.

Offeror’s Question: Amendment 0004, page 59 states to include C-113 key notes 1, 2, 18 in CLIN 002. Notes 1 and 18 are the concrete resilient curb that in an earlier RFI the Resilient Curb was said to be included in CLIN 001. Please clarify?

Government’s Response: Resilient curbing is to be included in CLIN 0001, Trestle ramp is included in CLIN 0002.

Offeror’s Question: According to ASCE 24-24, Chapter 4.6: Enclosed areas below the Design Flood Elevation (DFE) shall be permitted only where all of the following conditions are met:

1. Enclosure walls shall be designed and constructed in accordance with Section 4.6.1 and Section 4.6.2.

2. Enclosed areas shall be used solely for parking of vehicles, building access or storage and

3. Where stairways are located inside the enclosed areas with breakaway walls, exterior doors shall be required at the entry at the top of the stairs.

The above building code referenced by UFC in the RFP requires breakaway walls for buildings with enclosed space below the flood elevation which is 11’. Please confirm that the breakaway walls are required since the Warehouse building is in a flood zone and will endure wave action and flooding.

Government’s Response: As mentioned within Amendment #4, breakaway walls are not required, this is a deviation from the UFC that NOAA is fully aware of.

Offeror’s Question: Amendment 0004 Page 62 of 70 Government’s responses references Section 3 of the concept narrative and to review the concept drawings in reply to: “What are the lighting design requirements for the pier? Are the lights to be installed on the perimeter of the pier or down the middle?”

However, the concept narrative does not specify whether the lighting layout for the pier should be installed on the perimeter of the pier or down the middle. Additionally, the concept drawings do not specify

PAGE 9 OF 9 1305M423RNAAJ00040006

1305M423RNAAJ0004

whether the lighting layout for the pier should be installed on the perimeter of the pier or down the middle.

The concept narrative and UFC-3-350-01 pier lighting level performance requirements contradict each other.

Concept narrative:

• Pier, gangway, trestle and small boat dock lighting are to be 30 footcandles during active periods and reduced to 5 footcandles during inactive periods for security purposes.

• Pole mounting LED lighting to be provided for the pier, gangway and trestle. Lighting to meet local lighting, current energy code and IES requirements. Refer to Electrical section for additional information.

• Maximum pole height to be 10 feet.

Government’s Response: The final design of the lighting system is the responsibility of the DBT. For the 15% Concept Design, the light fixture heights were selected to help prevent adverse effects on the marine life in the area. The lighting levels are intended for work on activities on the pier and not for work on ships from the pier lighting. This does differ from UFC requirements for the lighting in this area. All other aspects of the UFC to be applied to the project.

Lighting should be installed on the perimeter of the pier.
