Subject: Exceptions for Units Located in Potential Occupied Yosemite Toad Habitat

Based on additional field review on 5/28/2020, pre-project survey of meadows in the area, steep wooded terrain, and the Yosemite toad (YT) dispersal patterns (Liang 2010, 2016 unpublished data), although within the potential dispersal distance (1250 meters/0.78 miles of occupied breeding meadow) in the original analysis, I have determined that the following units will not be considered as occupied habitat for the YT and will not have the Limited Operation Period (LOP)(conservation measure #103) for YT occupied upland habitats:

• Units 58, 71, 76, 72, 73, 80, 61

• Units 60 if accessed from 10S13

• Unit 59, 66 if accessed from temp road identified from 10S13 (as proposed in Project GIS)

In addition, I have determined based on the same rational as listed above, hauling on 10S13 from about mile marker about 1.6 to 3.2 (YT occupied buffer south of Cabin Meadow) will not be considered to occur in occupied habitat and therefore will not qualify for the YT LOP (conservation measure #103) nor the mechanical operations restrictions (dusk/dawn) (conservation measure #106).

These exemptions are consistent with the effects determination of the biological opinion and do not conflict with the opinion, nor will not lead to take of the Yosemite toad or habitat.

Conservation Measures (Enclosure 1 of BO 08ESMF00-2016-F-0420)

103. All operations (including project related road maintenance and reconstruction) shall start 60 days after breeding is completed. Occupancy and timing of breeding would be determined annually by the District aquatic biologist.

a. Start date can be as early as July 30 or as late as September 7.

106. Mechanical operations would cease before dusk and not continue until after dawn.

Exceptions include log truck loading and road dust abatement when coordinated with the District aquatic biologist. To minimize conflict with adult Yosemite toads, operations in or within 1,250 meters of occupied meadows will occur as late in the morning as possible.
