d) The resultant contract to this solicitation will be an Indefinite Delivery, Indefinite Quantity type contract. The ceiling for this contract is up to $150,000.00 with a guaranteed minimum of $500 for the base period only. A task order will be issued to fund the period, however, only services rendered will be paid and the contractor will not be entitled to payment except for services provided.

General Information
1.0 Scope of Work
1.1The Contractor shall provide a comprehensive occupational medical examination program for Region 2, Law Enforcement and Investigation employees. The general medical and occupational history review and general physical examinations provide the basis for the medical determination/status of employees to perform the essential functions of arduous duty positions and disclose any health issues that may prevent the effective performance of official duties. The contractor shall begin immediately or as soon as possible with minimal start-up time, to provide all necessary facilities, staff, materials, and equipment to administer an all-inclusive medical examination program as delineated in the performance tasks outlined herein.
1.2 The USFS will provide a spreadsheet with each employee’s personal identifiable information in order to begin medical examinations.
2.0 Background
2.1. The Occupational Safety and Health Administration (OSHA) requires that agencies establish medical and physical qualifications for individuals retaining positions that primarily perform arduous duties (29CFR1910.120(F). US Forest Service Policy, FSM 6720 and FSH
6709.11, provides direction for having a program for conducting medical tests and physical examinations, including baseline physicals of Forest Service employees occupationally exposed to hazardous levels of chemical, biological, or physical agents. To fulfill this requirement, the
United States Department of Agriculture (USDA), United States Forest Service (USFS) developed a Medical Surveillance Program.

2.2 Under this program, the USFS applies these medical qualifications to all positions in which arduous duties are assigned, whether as a primary or collateral duty, and whether the position is career, term, or temporary.
2.3 The primary objective is to establish a Baseline medical examination to note the employee’s current medical condition(s) and history. A Periodic examination will determine the employee’s medical condition(s) and history are static and stable, due to the physical demands and various working conditions of the job. An emergency examination will be required on an as needed basis if any personnel are exposed on duty. Currently, arduous occupations included in the program are law enforcement officers (LEO) who may perform collateral duties as wildland investigators and/or investigate illegal drug production sites. Law Enforcement employees are regularly exposed to unknown, toxic chemicals when eradicating marijuana grow sites on US
Forest Service lands.

3.3 Emergency Exam Requirement – As Needed:
An emergency medical exam will be requested when employees have been exposed to hazardous levels of chemical, biological, or physical agents. Per OSHA 316201R (2014), an emergency medical exam must be given within 48 hours of exposure, no exceptions.
3.4 No-Show Exam: a scheduled examination not attended by the applicant or employee, without prior cancellation of the appointment within an allotted time frame. The contractor is eligible for reimbursement for no-show exams.
3.5 Place of Performance: The contractor must be able to provide services in Colorado, Kansas, Wyoming, South Dakota, and Nebraska – to include rural cities per the USFS, Region 2 Website.
Region 2, Law Enforcement and Investigations personnel are located in the following cities and need an accessible clinic, no further than 100 miles. A detailed spreadsheet of Region 2 employees, contact information, and closest city will be provided to the Contractor, there are exemptions to some employees who are further than 100 miles.

3.6 Data Management
3.6.1. Provide a secure web-based application, hosting infrastructure and services that are accessible to the highest extent possible for the purposes of requesting, scheduling, tracking, and documenting all data associated with the medical surveillance program. The application will meet the following functional requirements:
· Automate the exam requesting, scheduling & completion of medical history questionnaire process through electronic submission via a secure web application.
· Document attempts made by the Contractor to contact/schedule the exams with examinee
· Provide email or pop-up notices to examinee and users 30 days prior to when an exam is due
· Issue compliance notifications via email to examinees and supervisors for overdue examinations
· Real-time tracking of the status and progress of examinee’s examination processes
· Document individual examination results
· Document the final determination of the medical results
· Maintain a secure web application repository for examinees to retrieve documents, including deferral letters, final determinations, exam results and medical certificates.
· Incorporate and maintain individual examinee files that contain all historical and current examinations and personal identification information, including:
• Name
• Individual Personal Identifier Code
• Date of Birth
• Address (work or home)
• Date of all examination(s)
• Age
• Month and year of next examination
• Exam category (Baseline/Periodic/Emergency)
• Status of all past and ongoing examination(s) during the contract period
• Event log of all past and ongoing examination(s)
▪ Document the entire evaluation for a historical basis
3.6.2. The Contractor shall be responsible for developing and implementing training for utilizing the web-based application. It is envisioned that the training is geared toward new users learning how to navigate the site through self-paced instruction. This training will be accessible and available (24/7) 365 days per year. The Contractor shall abide by the Health Insurance Portability and Accountability Act (HIPAA) Security Rules as it pertains to Security Standards for the Protection of Electronic Protected Health
Information (the Security Rule) which establishes a national set of security standards for protecting certain health information that is held or transferred in electronic form.

3.6.3. Upon award, the Contractor shall be responsible for transitioning all existing examinee determination data (i.e. dates and times of all previous determinations, name, SSN, etc.) from the Government furnished excel spreadsheet (see section 4.0, Government Furnished Information) to the web-based application, and transition all existing examinee medical history forms to the application in order to ensure all historical data is maintained and available for use in the new application.
For clarification, there are approximately 50 patients that will need initial information submitted, however for subsequent years the Government would only anticipate new
FAC 2025-03 January 17, 2025 hires to be entered which is approximately 2 additional examinees submitted into the web based application. Examinee data can be provided to the contractor electronically (pdf or word) or can be entered by the Government.
3. 7 Records Management
3.7.1 The Contractor shall maintain and safeguard all hardcopy documentation as generated throughout the entirety of this contract. The Contractor shall abide by the HIPAA
Privacy Rule: Standards for Privacy of Individually Identifiable Health Information which establishes national standards for the protection of certain health information (Reference 45
CFR Parts 160 and 164 Standards for Privacy of Individually Identifiable Health
Information) ensuring that no unauthorized release of personal information occurs. Maintain copies of all previous and current Forest Service medical files for all examinees. Convert all hardcopy documentation that is generated during the current contract to electronic media for posting to the secure web application. Records Management will be required and maintained throughout the course of the contract.
3.7.2 Examinee Results
In all cases, the Contractor shall post electronic copy (hardcopy, upon request will be at an additional cost) of examination results and medical certificate with final rating for retrieval by examinee upon completion of determination.
3.8 Customer Support
Provide, implement, operate, and maintain a fully functional Call Center, for recording, triaging, troubleshooting and resolving/ redirecting customer support requirements and ensuring minimum user downtime. All customer service-related inquiries must be responded to within the same business day or by close of business (MST) the following business day.
Communicate to employees their personal health issues/concerns that do not affect clearance for arduous duty (e.g. elevated triglycerides) that are found on any of the examinations. Provide electronic results to examinee within 1 day of determination completion.
3.9 Contract Close-out
3.9.1 At the end of the contract, the Contractor shall furnish all existing historical examinee determination data in the form of an excel spreadsheet. Additionally, the Contractor shall provide exam reports, scanned exam medical history forms and final determination documentation compatible with MS Office or Adobe Acrobat. Upon request, all hardcopy documentation will be provided. Ultimately, the Contractor shall deliver this property to the new contract Awardee per the transition plan and 52.237-3 – Continuity of Services; this should be accomplished through direct coordination between contractors. If this is not possible, then all final deliverables will be provided as follows:

4.0 Government Furnished
4.1 Upon award, USFS will furnish all existing historical examinee determination data in the form of an excel spreadsheet, as well as all scanned medical history forms. Furthermore, all associated historical hardcopy documentation will be provided to the Contractor. The delivery of this information should be accomplished through direct coordination with the current incumbent
Contractor.
4.2 The Contractor will disclose to a designated individual (Special Agent in Charge), information from the employee’s health record concerning work-related clearance, problems, or restrictions VIA mail or the Contractor’s secure portal.
