H.1 CLAUSES

H.2 OTHER REQUIREMENTS

Minimum Insurance Coverage Requirements Pursuant to FAR clause FAR 52.228-5, Insurance-Work on a Government Installation paragraph (a), Contractors shall present evidence and maintain, as a minimum, the amounts of insurance coverage indicated below:

(1) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they must be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 must be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(2) General Liability. The Contractor must have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(3) Automobile Liability. The Contractor must have automobile liability insurance written on a comprehensive form of policy. The policy must provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States must provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(4) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor must have aircraft public and passenger liability insurance. Coverage must be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury. Coverage for passenger injury must be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

Local Material Sources

Designated Sources-- Sources of local materials will be designated on the drawings. The Government assumes responsibility for the quality and quantity of material in the source. The Contractor shall determine the equipment and work required to produce the specified product.

The Contractor shall utilize all suitable material in the source. The designation of source will include the rights of the Contractor to use certain area(s) for plant site, stockpiles, and haul roads.

Any Contractor royalty payment requirements will be stated below.

When materials are subject to weight measurement, the weight/volume relationship used for determination of designed quantities will be shown on the Drawings.

Should the designated source, due to causes beyond the control of the Contractor, contain insufficient suitable material, the Government will provide another source with an equitable adjustment in accordance with the Differing Site Conditions and Changes clauses.

Contractor-Furnished Sources--When the material sources are not designated as provided above or the Contractor elects not to use designated sources, the Contractor shall be responsible for providing the specified product with no adjustment in contract price, unless weight/volume relationship differences between designated source material and Contractor-furnished source material result in financial disadvantage to the Government. Quality testing shall be the responsibility of the Contractor. Test results shall be furnished to the Contracting Officer.

Samples, Tests, Cited Specifications

Reference made in the contract to specifications, standards, or test methods adopted by AASHTO, ASTM, GSA, or other recognized National technical associations, shall mean specifications, standards, or test methods (including interim or tentative issues) which are in effect on the date of the solicitation.

Resource Protection Measures

The contractor shall adhere to the following Resource Protection Measures (RPM) for each resource area:

Recommended Wilderness/Wild and Scenic Rivers The contractor will be briefed on minimum impact/leave no trace ethics prior to starting work and will follow minimum impact/leave no trace ethics while working and camping. The contractor will camp in established campsites at the trailhead or the designated existing hardened site near the bridge, as approved by the C.O. No long-term holding of stock will be permitted at the bridge site. Stock must be taken to the trailhead every night and restrained there.

Stock used to support project work will be restrained in such a way as to minimize soil disturbance and avoid loss of native/desirable vegetation.

Packstock and helicopter transportation will be restricted to weekdays and non-holidays when possible to minimize impacts to visitors.

Track mounted hydraulic machines will not be allowed. Heavy motorized equipment and motorized vehicles will not be allowed.

Helicopter use will be limited to two days. A helispot site may be located within the administrative pasture at Clearwater Crossing.

Old bridge materials will be sawed up and piled for burning in hardened sites outside the riparian area. See #26 for burn pile specifications. Nails, bolts, metal, and any treated bridge materials will be packed out using packstock and/or flown out. Burning of piles will be coordinated with District fire personnel. Old bridge materials will not be left in the stream or on the streambank.

The established sling site will be used for staging of materials and supplies long-lined in for construction. Staging of any other materials may not disturb soils and vegetation.

The existing bridges will not be deconstructed prior to July 1 to minimize the amount of time access is restricted to the public.

Borrow sources for gravel and fine material will be weed-free, obtained from within the identified sling site and rehabilitated to a natural appearance following use. Rock will be obtained from the existing abutments or collected from the identified sling wit only.

Fisheries/Hydrology Work within the wetted stream channel (e.g., removing existing piers) will be conducted between July 15 and August 15. Work may occur outside of the wetted channel at any other time of the year. All regulatory permits (e.g., 124 Permit) will be obtained prior to ground-disturbing activities. The 124 permit will be obtained by the Forest Service.

Clearing of riparian vegetation will be minimized to that necessary for bridge construction and generally limited to the immediate bridge sites to conserve existing vegetation for shade and stream bank stability.

All project activities will cease, except efforts to minimize storm or high flow erosion, during precipitation and high flow events that result in uncontrollable erosion at the bridge site.

Native materials collected on site (e.g., logs, slash, rock, gravel, fine material, etc.) for construction and rehabilitation activities will be collected from the identified sling site borrow area.

Best Management Practices (BMPs) for using treated wood in aquatic environments will be followed.

All tools and boots/waders will be cleaned of mud, dirt, or plant materials before entering the work site and when leaving the work site to prevent the spread of aquatic nuisance species and invasive species.

Motorized tools will be fueled and serviced, and fuel will be stored, outside of the riparian habitat conservation area. This BMP does not apply if motorized tools requiring fuel are not used.

Building materials will adhere to standards for using treated wood in aquatic environments.

All disturbed soil (i.e., material staging area, crew camp, bridge site) will be replanted with riparian vegetation and/or covered with duff/slash to prevent soil erosion and facilitate vegetation recovery.

Disturbed areas will be stabilized and revegetated with native materials sourced in-situ (i.e. salvaged woody debris, alder, willow, dogwood transplants, native seed mixture).

If fords are improved to accommodate project activities or provide temporary access around the project sites, they will be restored to pre-project conditions upon completion of the project. Any channel or soil disturbance caused by the use of fords during bridge construction will be naturalized using native materials.

Other than the individual tree shown in the plans, no damage or felling of trees will be allowed unless approved by the CO.

Spike camps, latrines, and temporary stock holding will be located greater than 150 feet from the river and streams.

Blasting within 150 feet of the river will only occur between July 1 and August 15th.

Soils Slash will be used to stabilize bare soils and streambanks during and following project implementation. Slash of mixed sizes (at least 50% < 6 inches diameter) will be placed over approximately 65−70% of the bare soil and streambanks to a depth of approximately 2−3 inches where available (approximately 10-15 tons/acre). Most slash will be in direct contact with the soil surface.

Burn piles will be located in the identified sling site. The size of pile should be limited to existing disturbance footprint. Piles will be limited in size to 10 x 10 feet. Following burning, native duff from adjacent areas should be incorporated (raked) into the burn pile (see #23).

Slash (following guidance in #22) should then be placed to cover the burn pile to provide shading, erosion control, and discourage re-use of the burned areas.

Social trails established during construction that are not part of the National Forest trail system will be decommissioned after use. Decommissioning will include:

• Decompact the trail tread to a depth of at least 6 inches using hand tools.

Decompaction techniques should avoid mixing topsoil (4-6 inches in depth) with infertile subsoil below (> 6 inches).

• Native duff will be placed over the decompacted area to re-introduce soil microbial populations and native seed (see #23).

• Slash will be placed over decommissioned trails to provide shading and prevent erosion (see #22).

Wildlife During helicopter operations, to minimize disturbance to wildlife and especially grizzly bears, the helicopter will take as close to the same flight path as possible for each trip to and from the bridge site. Helicopter use shall be limited to two days.

To eliminate the chance of food habituating grizzly bears and other wildlife, garbage will be stored in a bear proof container throughout the duration of the project and bear attractants will be removed if/when a spike camp is unoccupied overnight. Food and other bear attractants will be stored in compliance with the Lolo National Forest Food Storage Order.

If any threatened, endangered, or sensitive species are located/encountered during project layout or implementation, the botanist, wildlife or fisheries biologist will be notified.

Management activities will be altered, if necessary, so the resource is protected.

Cultural Resources If previously unrecorded heritage resources are encountered during project implementation, activities will be halted and an archeologist will be notified. If necessary, additional RPMs will be devised in consultation with the Montana State Historic Preservation Office. The existing cultural site on the east side of the creek up the Shley Trail will not be disturbed.

Botany If new occurrences of Federally-listed or Region One sensitive plants are detected within the project area, the botanist will be contacted so protective measures may be revised, additional buffers implemented, or activity timing restrictions applied.

All revegetation efforts will use native material collected on site.

Noxious Weeds

Minimize transport and establishment of weeds on National Forest System lands.

Implement required weed protection measures outlined in Forest Service Manual 2080 (Noxious Weed Management) including:

• Use certified weed-free feed if feed is needed for stock while being used to access the bridge sites and feed stock weed-free feed for a few days prior to entering the Wilderness. Brush stock to remove any weed seed prior to entering the Wilderness.

• Work crews will regularly inspect, remove, and properly dispose of weed seed and plant parts found on their clothing and equipment.

Restricted Equipment

The following list of equipment is restricted unless approved otherwise by the contracting officer:

1. Helicopter use is limited to two days of use

2. Heavy motorized equipment or motorized vehicles will not be allowed at the bridge site

FAR 52.225-9 Buy American Act-Construction Materials (OCT 2022)

(a) Definitions. As used in this clause—

Commercially available off-the-shelf (COTS) item—

(1) Means any item of supply (including construction material) that is–

(i) A commercial product (as defined in paragraph (1) of the definition of “commercial product” at Federal Acquisition Regulation (FAR) 2.101);

(ii) Sold in substantial quantities in the commercial marketplace; and

(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and https://www.acquisition.gov/far/part-2#FAR_2_101

(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.

"Construction material" means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies.

However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

Cost of components means—

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.

Critical component means a component that is mined, produced, or manufactured in the United States and deemed critical to the U.S. supply chain. The list of critical components is at FAR 25.105.

Critical item means a domestic construction material or domestic end product that is deemed critical to U.S. supply chain resiliency. The list of critical items is at FAR 25.105.

Domestic construction material means—

(1) For construction material that does not consist wholly or predominantly of iron or steel or a combination of both-

(i) An unmanufactured construction material mined or produced in the United States; or

(ii) A construction material manufactured in the United States, if–

(A) The cost of its components mined, produced, or manufactured in the United States exceeds 60 percent of the cost of all its components, except that the percentage will be 65 percent for items delivered in calendar years 2024 through 2028 and 75 percent for items delivered starting in calendar year 2029.

Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic. Components of unknown origin are treated as foreign; or https://www.acquisition.gov/far/part-25#FAR_25_105

(B) The construction material is a COTS item; or

(2) For construction material that consists wholly or predominantly of iron or steel or a combination of both, a construction material manufactured in the United States if the cost of foreign iron and steel constitutes less than 5 percent of the cost of all component used in such construction material. The cost of foreign iron and steel includes but is not limited to the cost of foreign iron or steel mill products (such as bar, billet, slab, wire, plate, or sheet), castings, or forgings utilized in the manufacture of the construction material and a good faith estimate of the cost of all foreign iron or steel components excluding COTS fasteners.

Iron or steel components of unknown origin are treated as foreign. If the construction material contains multiple components, the cost of all the materials used in such construction material is calculated in accordance with the definition of "cost of components".

Fastener means a hardware device that mechanically joins or affixes two or more objects together. Examples of fasteners are nuts, bolts, pins, rivets, nails, clips, and screws.

Foreign construction material means a construction material other than a domestic construction material.

Foreign iron and steel means iron or steel products not produced in the United States.

Produced in the United States means that all manufacturing processes of the iron or steel must take place in the United States, from the initial melting stage through the application of coatings, except metallurgical processes involving refinement of steel additives. The origin of the elements of the iron or steel is not relevant to the determination of whether it is domestic or foreign.

Predominantly of iron or steel or a combination of both means that the cost of the iron and steel content exceeds 50 percent of the total cost of all its components. The cost of iron and steel is the cost of the iron or steel mill products (such as bar, billet, slab, wire, plate, or sheet), castings, or forgings utilized in the manufacture of the product and a good faith estimate of the cost of iron or steel components excluding COTS fasteners.

Steel means an alloy that includes at least 50 percent iron, between 0.02 and 2 percent carbon, and may include other elements.

"United States" means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements 41 U.S.C. Chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the domestic content test of the Buy American statute is waived for construction material that is a COTS item, except that for construction material that consists wholly or predominantly of iron or steel or a combination of both, the domestic content test is applied only to the iron and steel content of the construction materials, excluding COTS fasteners. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to information technology that is a commercial product or to the construction materials or components listed by the Government as follows:

[Contracting Officer to list applicable excepted materials or indicate "none"]

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that-

(i) The cost of domestic construction material would be unreasonable.

(A) For domestic construction material that is not a critical item or does not contain critical components.

(1) The cost of a particular domestic construction material subject to the requirements of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 20 percent;

(2) For construction material that is not a COTS item and does not consist wholly or predominantly of iron or steel or a combination of both, if the cost of a particular domestic construction material is determined to be unreasonable or there is no domestic offer received, and the low offer is for foreign construction material that is manufactured in the United States and does not exceed 55 percent domestic content, the Contracting Officer will treat the lowest offer of foreign construction material that exceeds 55 percent domestic content as a domestic offer and determine whether the cost of that offer is unreasonable by applying the evaluation factor listed in paragraph (b)(3)(i)(A)(1) of this clause.

(3) The procedures in paragraph (b)(3)(i)(A)(2) of this clause will no longer apply as of January 1, 2030.

(B) For domestic construction material that is a critical item or contains critical components.

(1) The cost of a particular domestic construction material that is a critical item or contains critical components, subject to the requirements of the Buy American statute, is unreasonable when the cost of such material exceeds the cost of foreign material by more than 20 percent plus the additional preference factor identified for the critical item or construction material containing critical components listed at FAR 25.105.

(2) For construction material that does not consist wholly or predominantly of iron or steel or a combination of both, if the cost of a particular domestic construction material is determined to be unreasonable or there is no domestic offer received, and the low offer is for foreign construction material that does not exceed 55 percent domestic content, the Contracting Officer will treat the lowest foreign offer of construction material that is manufactured in the United States and exceeds 55 percent domestic content as a domestic offer, and determine whether the cost of that offer is unreasonable by applying the evaluation factor listed in paragraph (b)(3)(i)(B)(1) of this clause.

(3) The procedures in paragraph (b)(3)(i)(B)(2) of this clause will no longer apply as of January 1, 2030.

(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American statute.

(1) (i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including-

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:
