About this file

This is Amendment 0001 to Solicitation 1240LP26Q0173, issued by USDA Forest Service CSA Intermountain 4 (located in Ogden, UT) with an effective date of September 28, 2026. The amendment presents a Questions and Answers document addressing clarifications to the Apache Zone Aggregate solicitation, with no changes to the response deadline.

The Q&A addresses seven key inquiries regarding contract performance and compliance. Answer 1 clarifies that small-business primes cannot use quarry subcontractors' pit locations unless they can demonstrate enforceable rights to designate locations, authorize government access, maintain access throughout the contract period, verify quantities and quality, control release and pickup procedures, and independently fulfill delivery, inspection, environmental, safety, and security obligations. Answer 2 confirms that one pit location may serve both Apache and Greenlee Counties if it meets the 35-mile requirement. Answer 3 specifies that the 2,950 tons for base CLIN 0001 is a funded quantity at award, to be picked up over the contract performance year. Answer 4 establishes that no minimum quantity is guaranteed; the Forest Service will take the full funded quantity over the performance period based on road work activities, with contractors required to prepare a minimum of 200 tons within the first week of award and permitted to invoice as material is accepted. Answer 5 clarifies that the option quantity is To Be Determined (TBD) and will be awarded at the unit rate quoted for CLIN 0001 if exercised. Answer 6 states that the Nonmanufacturer Rule does not apply because the contract value is below the $250,000 threshold in 13 C.F.R. § 121.406. Answer 7 confirms that Table 703-3, Grading G is the controlling gradation requirement for the aggregate product.

Questions/Answers: 1240LP26Q0173 Apache Zone Aggregate amendment

Question 1:

May a small-business prime designate pit locations owned and operated by a committed quarry subcontractor, with that quarry producing, stockpiling and making the material available for Government pickup while the prime manages the contract?

Answer 1:

No, a small-business prime may not designate pit locations owned and operated by a committed quarry subcontractor, unless their quote can clearly demonstrate that, as the prime contractor, they have enforceable right to:

• Designate the location, and

• Independently direct or authorize Government access to the pit, and

• Independently maintain access throughout the contract period, and

• Directly verify quantities and quality, and

• Directly control release and pickup procedures; and

• Independently fulfill all delivery, inspection, environmental, safety, and security obligations.

Question 2: Must the quote identify a qualifying pit in each of Apache and Greenlee Counties, or may one pit serve both districts if it meets the 35-mile requirement?

Answer 2: One pit could serve both districts if it meets the 35-mile requirement.

Question 3:

Is the 2,950 tons for base CLIN 0001 a funded quantity ordered at award, or an estimate for later task-order pickups?

Answer 3:

The 2,950 tons for base CLIN 0001 is a funded quantity at award, that will be picked up over the course of the year that the contract runs.

Question 4:

If pickups are ordered later, what minimum quantity, if any, is guaranteed and when may the contractor invoice?

Answer 4:

The Forest Service will take the full funded quantity, awarded in the contract, over the duration of the performance period. There is no minimum quantity guaranteed, as the material taken, over the year, will be related to Forest Service road work activities. The Forest Service may take more of the material once month compared to another depending on the road project the material is needed for. The contractor shall prepare a minimum of 200 tons within the first week of award. The entire quantity of the material will be picked up by the Forest Service prior to contract period of performance end.

The contractor may invoice as soon as the Forest Service has taken/accepted the material.

Specifics of how the contractor wants to invoice is up to them. They can do monthly for all the tons of materials picked up that month for the contract, one large total invoice after project completion, or even an invoice for every time some of the material from the contract is taken. As long as the tons invoiced for matches the loading tickets/tons the Forest Service took the invoice can be approved.

Question 5:

The RFQ lists the option quantity as TBD while the SOW schedule shows one ton; which governs pricing and evaluation?

Answer 5:

The option quantity is To Be Determined (TBD) and, if exercised, will be awarded at the unit rate quoted for CLIN 0001.

Question 6:

Does the Nonmanufacturer Rule apply to this small-business supply set-aside at the anticipated award value? If so, may a qualifying small-business prime furnish aggregate produced by a separate small U.S. quarry, and is any waiver applicable?

Answer 6:

The Nonmanufacturer Rule (NMR) does not apply to this small-business supply set-aside because the value is below the $250,000 threshold in 13 C.F.R. § 121.406.

Question 7:

The SOW and supplemental specifications identify Table 703-3, Grading G, while other solicitation language references Table 31-2, Grading G. Please confirm that Table 703-3, Grading G is the controlling gradation requirement.

Answer 7:

Table 703-3, Grading G is the controlling gradation requirement.
