About this file

This document is a Request for Proposal (RFP) issued by New Mexico State University (NMSU) for On-Call Architectural/Engineering Services, soliciting proposals from architectural and engineering firms. The RFP #2024-RFP-585 was released on 5/9/2024 with a proposal submission deadline of 7/15/2024 at 2:00 PM MDT. The contract appears to be an on-call, indefinite quantity agreement for professional services to support NMSU's comprehensive educational, research, extension, and public service missions across its statewide system. The procurement covers multiple commodity codes including architectural services, construction services, and professional engineering services for higher education capital improvement projects.

The solicitation includes preferences for resident businesses and veteran-owned businesses, with potential additional point allocations of 8-10% for qualifying firms. Multiple architectural and engineering firms are listed as potential respondents, including Orlo Forensics, Testudo Engineering, Bohannan Huston, and others. The procurement process will involve an evaluation committee that may conduct interviews with top-rated proposers, though contracts may be awarded based solely on written proposals. Respondents must submit comprehensive proposals through NMSU's online bidding system, with specific formatting requirements, and are subject to New Mexico's Procurement Code regulations. The contract terms will be negotiated following selection, with NMSU reserving the right to reject proposals that request significant deviations from standard terms and conditions.

Respondent will bear all costs, including attorney’s fees, related to any challenge to a claim of exemption from the New Mexico Inspection of Public Records Act, NMSA 1978, Chapter 14, Article 2 as it relates to the portion of a proposal that Respondent marked as exempt. NMSU is not required to defend the claimed exemption and will allow inspection within 10 days after notifying Respondent of the challenge, unless Respondent has undertaken to defend the claimed exemption and to indemnify NMSU against any loss, damages or costs associated with the refusal to allow inspection.

17. New Mexico law allows other governmental entities within the State of New Mexico to contract, in accordance with 13- 1-129 NMSA 1978, for services with the Contractor under the terms contained in the Agreement. Should that occur, NMSU will not be a party to any engagements entered into pursuant to this paragraph. Contractual engagements accomplished under this provision will be solely between the Contractor and the subject governmental entity.

18. If the Respondent or any of its principals are presently debarred, suspended, proposed for debarment, or declared ineligible for award of contract by any federal entity, state agency or local public body, the Respondent will not be considered for an Award.

19. Submission of a Proposal is deemed a certification by Respondent that Respondent has not, directly or indirectly, acted in restraint of competition.
