About this file

This is a standard form construction contract agreement between West Ada School District (Owner) located in Meridian, Idaho, and a contractor for execution of work on an unspecified project. The contract adopts AIA Document A101-2017 as the basis for agreement and incorporates AIA Document A201-2017 General Conditions by reference. The related project involves a fire alarm system upgrade at Renaissance High School and District Service Center with a Substantial Completion date of August 7, 2026. The contract structure includes provisions for Contract Time measured from the date of commencement, with liquidated damages assessed at $350.00 per calendar day for delays beyond the Substantial Completion date. The document establishes mechanisms for progress payments, final payment, insurance and bonding requirements, dispute resolution procedures, and termination provisions for both cause and convenience.

The contract specifies a 5% retainage withhold from progress payments prior to Substantial Completion, with payment processing requirements stipulating that applications received by the fifth of the month receive payment by month-end, while later applications receive payment within 60 days of Architect receipt. Final payment is conditioned upon receipt of performance bond consents, tax release notices from the Idaho State Tax Commission, and contractor release of liens forms. The Contractor must maintain workers' compensation insurance, employers' liability coverage at $1,000,000, business automobile liability at $1,000,000, and commercial general liability with limits of $1,000,000 per occurrence and $2,000,000 general aggregate. Payment and Performance Bonds at 100% of contract value are required. Idaho Code compliance provisions mandate employment of 95% bona fide Idaho residents, tax payment certifications, anti-boycott certifications, and non-affiliation with abortion providers. The contract requires continuous on-site project supervision, weekly safety meetings, and comprehensive quality control protocols throughout project execution.
