About this file

This file is a Health Department Addendum to Montgomery County Standard Terms and Conditions for electronic contracts in Pennsylvania. The addendum establishes specialized provisions governing health-related services and research activities within Montgomery County's contracting framework. The scope of work is not detailed in this addendum document itself, as it incorporates by reference the Montgomery County Standard Grant Addendum and applies only to contracts involving health department services. The addendum establishes that in case of conflicts between this document and other contract terms, the Health Department Addendum controls. The document has been pre-approved by the Montgomery County Solicitor, with version control managed through the header designation; no additional solicitor approval is required provided the County's Standard Contract and Signature page are used and the text remains unchanged.

Key contractual provisions include prohibitions on human experimentation with subjects unless explicitly called for in the statement of work, with all experimentation required to comply with local, state, federal, and UN guidelines. The Provider must maintain strict confidentiality of all client information, including names, identities, records, and service details, except as permitted by applicable law and Department regulations, and must ensure all subcontractors adhere to applicable confidentiality laws. If the Health Insurance Portability and Accountability Act (HIPAA) applies, the Provider must sign and be bound by the County's Business Associate Addendum. Additionally, if applicable, the agreement shall be governed by the Mental Health/Mental Retardation Act of 1966, as amended, and the Mental Health Procedures Act of 1976, as amended, with the Provider agreeing to abide by all associated audit, reporting, and retention policies.
