About this file
This document is an Exhibit detailing Prison Rape Elimination Act (PREA) compliance requirements for a contractor providing residential community transition services to the Colorado Department of Corrections (CDOC). The contractor must establish and maintain a zero-tolerance policy for sexual assault, rape, and sexual misconduct in accordance with 42 U.S.C. 15601 and applicable CDOC administrative regulations. Key operational requirements include designating a dedicated PREA Manager, ensuring all staff, volunteers, and contract personnel receive PREA training through CDOC-provided programs, and providing specialized training to first-line responders, shift commanders, investigators, and clinical services staff. The contractor must orient all offenders to PREA policies during facility intake and annually thereafter, with signed acknowledgments maintained in offender files. Accommodations must be provided for offenders with limited English proficiency, hearing or visual impairments, or limited reading skills to ensure they can report incidents and access written information about sexual abuse policies. The contract term includes ongoing compliance monitoring by CDOC with assessment of liquidated damages for non-compliance.
The contractor bears full responsibility for demonstrating PREA compliance through a triennial audit conducted by a U.S. Department of Justice-accredited auditor, with audit costs borne by the contractor. Incident reporting requirements are extensive, including individual reports of all suspected sexual misconduct, assault, harassment, and retaliation to the Office of the Inspector General (OIG) within prescribed timelines, staff administrative dispositions within thirty calendar days, and biannual data submissions for the Department of Justice Survey of Sexual Violence. The contractor must arrange hospital transport with Sexual Assault Nurse Examiner services for suspected victims and reimburse CDOC for forensic examinations. Mental health treatment must be provided to affected offenders, and alleged perpetrators and victims must be effectively separated until permanent safety arrangements are established. Current state employees are prohibited from conducting the PREA audit to avoid conflicts of interest.
