About this file
This is a Domestic Partnership Act Certification form required by Broward County, Florida for vendors responding to solicitations involving contracts valued over $100,000. The certification document outlines Broward County's Domestic Partnership Act requirements, which mandate that vendors contracting with the County must provide benefits to registered domestic partners of employees on the same basis as benefits provided to employees' spouses. The form must be completed and signed by an authorized vendor representative and submitted with the solicitation response. For solicitations with a Domestic Partnership tiebreaker provision, the certification must be submitted at the time of solicitation submittal to maintain eligibility. Vendors failing to submit the form by stated deadlines may be deemed nonresponsive to the solicitation or ineligible for tiebreaker consideration.
The certification form requires vendors to indicate their compliance status with one of four primary options: current compliance with the Domestic Partnership Act, commitment to comply at contract award, non-compliance, or qualification for one of six specified exemptions. Exemptions are available for vendors with fewer than five employees, those that do not provide spousal benefits, governmental entities, not-for-profit organizations, religious institutions, and vendors subject to conflicting federal or state law requirements. Vendors claiming an exemption must document their qualifications through appropriate evidence or affidavits. The form applies specifically to the FEMA Compliant Fabricate and Refurbish Water and Wastewater Control Panels contract opportunity for Broward County and is dated September 9, 2024.
