About this file
This is a Maintenance Bond document for the City of Fort Worth, Texas, related to a Brick Pavement Rehabilitation Unit Price Contract for various projects. The contract covers brick pavement, brick sidewalk, and brick curb ramp repair and/or replacement, as well as repair and installation of concrete curb and gutter, curb ramps, sidewalk, and driveways. The City has established this contract on a unit price basis, allowing flexibility in the scope of work based on the City's needs and available funding. The contract may be renewed up to two additional times upon expiration of contract funds, with a maximum total contract term of five years from the initial effective date. The maintenance bond requires the contractor to maintain the completed work free from defects in materials or workmanship for two years following final acceptance by the City.
The maintenance bond obligates the principal contractor and surety to repair or reconstruct any defective work identified by the City within the two-year maintenance period at no cost to the City. Should the contractor fail to remedy defective work after timely notice from the City, the City may perform the repairs itself with all associated costs charged to the principal and surety under the bond. The bond amount is to be determined and filled in upon contract award. The bond is governed by Texas law with venue established in Tarrant County, Texas or the United States District Court for the Northern District of Texas, Fort Worth Division. The document requires execution by authorized representatives of both the contractor (principal) and the surety company, with certification of authority required from the surety's bylaws.
