About this file

This is a Drug-Free Workplace Affidavit required for participation in a Letcher County Fiscal Court invitation for bid regarding asbestos abatement services in Kentucky. The affidavit establishes mandatory requirements for responding contractors to maintain drug-free workplace policies and practices. Contractors must publish statements prohibiting unlawful manufacture, distribution, dispensing, possession, or use of controlled substances in the workplace and must specify actions taken against employees for violations. Firms are required to inform employees about the dangers of drug abuse, maintain workplace drug-free policies, inform employees of available drug counseling and rehabilitation programs, and communicate applicable penalties for violations. Each employee engaged in providing the commodities or contractual services under bid must receive a copy of the drug-free workplace statement.

The affidavit further requires that firms notify employees that as a condition of work on the bid services, employees must abide by the drug-free workplace terms and must notify their employer of any conviction of or plea of guilty or nolo contendere to any violation of controlled substance laws within five days of such conviction occurring in the workplace. Contractors must impose sanctions or require satisfactory participation in drug abuse assistance or rehabilitation programs for employees convicted of violations, where such programs are available in the employee's community. The affidavit obligates firms to make good faith efforts to continue maintaining a drug-free workplace through ongoing implementation of these requirements.
