About this file
This is a Domestic Partnership Act Certification form required by Broward County, Florida for vendors responding to a Surplus Auction Services solicitation. The form must be completed and submitted with the vendor's proposal, either at the time of initial submittal or within three business days of the County's request for the form. Vendors failing to submit the certification by the stated deadline may be deemed nonresponsive to the solicitation. For contracts exceeding $100,000, vendors must certify their compliance status with Broward County's Domestic Partnership Act, which requires providing benefits to registered domestic partners of employees on the same basis as benefits provided to employees' spouses.
Vendors must select one of three primary compliance options: currently complying with the Act's requirements, committing to comply at the time of contract award, or declining to comply. Alternatively, vendors may claim an exemption if they employ fewer than five employees, do not provide spouse benefits, are a governmental entity or nonprofit organization, are a religious organization, provide cash equivalents of benefits with supporting affidavit, or cannot comply due to conflicting federal or state law or grant terms. The form requires vendor name, authorized signature, printed name, title, and date. This certification is mandatory for vendor responsiveness and, if the vendor currently offers domestic partnership benefits, the completed form submitted at solicitation closing is required for eligibility for the domestic partnership tiebreaker advantage in the competitive evaluation process.
