About this file

The document is a Business Request for GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form issued by the Utah State Archives' Office of the Government Records Ombudsman. This form allows businesses to request confidentiality protection for sensitive information submitted to governmental entities under Utah Code §63G-2-305, specifically covering trade secrets and commercial financial information that could potentially result in unfair competitive injury if disclosed.

The form provides a mechanism for businesses to submit a confidentiality claim by detailing specific reasons for protecting certain document sections, with a critical requirement that claimants must submit both redacted and non-redacted versions of their proposal. Importantly, the form notes that making a confidentiality claim does not guarantee protected classification, and the Division of Purchasing will not redact proposals on behalf of claimants who fail to upload a redacted copy. The document includes fields for company information, contact details, specifics about the confidentiality claim, and space for a concise statement supporting the claim, along with signature and date lines for formal submission.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
