About this file
This file is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman for use in conjunction with the State of Utah Division of Purchasing's procurement for an Internationally Trained Physicians Evaluation Tool through the Department of Commerce. The form is designed to enable vendors submitting qualifications to protect trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Vendors claiming confidentiality must provide a concise statement of reasons supporting the claim and submit both redacted and non-redacted versions of their proposal; the entire proposal may not be redacted, and the Division of Purchasing will not perform redactions on behalf of vendors who fail to provide a redacted copy. The procurement seeks design professional service providers and consultants for a three-year contract award under Utah Procurement Code 63G-6a Part 15, with the highest-ranked vendor selected to negotiate compensation determined to be fair and reasonable.
The form itself contains no pricing information, as vendors are explicitly instructed not to include pricing in their qualifications submissions. The document serves as a procedural template requiring claimant information including company name, address, contact details, and specific identification of which pages and paragraphs are subject to confidentiality claims. While making a confidentiality claim does not guarantee protected classification if the government receives a records request, the form provides the mechanism for vendors to assert protection over sensitive business information as permitted under Utah's Government Records Access and Management Act (GRAMA). No set-asides, incumbent information, or funding source details are specified in this confidentiality claim form.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
