About this file

This is a GRAMA (Government Records Access and Management Act) Business Confidentiality Claim form from the Utah State Archives, issued in conjunction with the Utah State Board of Education School Safety & Student Services Vendor Fair scheduled for September 10, 2026. The form serves as a template for vendors and contractors to claim protection of trade secrets and commercial financial information when submitting proposals or responses to the State of Utah. The document outlines the procedures established under Utah Code 63G-2-305 and 63G-2-309, which permit the protection of sensitive business information if proper confidentiality claims are submitted. Vendors responding to state procurement opportunities must submit both redacted and non-redacted versions of their proposals, with the understanding that the State's Division of Purchasing will not perform redactions on behalf of claimants who fail to provide a redacted copy.

The form requires claimants to provide detailed information including company name, address, representative contact details, and a concise statement of reasons supporting the confidentiality claim. Claimants must specify the exact pages and paragraphs of their submission that warrant confidential treatment and the specific reasons for protecting each section. The document explicitly notes that submission of a confidentiality claim does not guarantee that information will be classified as protected if the governmental entity receives a public records request, emphasizing that the ultimate determination of protected status remains with the government entity. This form applies specifically to records submitted to the Utah State Board of Education in connection with the School Safety & Student Services Vendor Fair and any related procurement activities.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
