About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with a Request for Statements of Qualifications (RFSQ) for a Cognitive Behavioral Program issued by the State of Utah Division of Purchasing on behalf of the Department of Corrections. The RFSQ seeks qualified companies to provide cognitive behavioral program professional services under a 5-year contract awarded through the Small Purchases of Professional Service Providers and Consultants process outlined in Administrative Rule R33-105. The solicitation specifies that vendors should submit statements of qualifications without pricing information, and the small purchase threshold for this project is $100,000.00. The highest-ranked vendor will be selected to negotiate contract terms at fair and reasonable compensation; if negotiations fail with the top-ranked vendor, the state may proceed with the next highest-ranked vendor.
The confidentiality claim form allows bidders to protect trade secrets and commercial financial information from public disclosure under Utah Code 63G-2-305 and 63G-2-309. Claimants must submit both redacted and non-redacted versions of their proposals, provide a concise statement of reasons supporting the confidentiality claim, and complete all required information including company details, contact information, and specific page and paragraph references for claimed confidential material. The form notes that submitting a confidentiality claim does not guarantee protected classification if the government receives a public records request under the Government Records Access and Management Act (GRAMA).

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
