About this file
This is a GRAMA Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with a Section 811 Project Rental Assistance (PRA) Program Administration and TRACS Management contract opportunity conducted by the State of Utah Division of Purchasing and the Governor's Office of Economic Development. The form is designed to allow vendors submitting qualifications to claim protection for trade secrets and commercial financial information under Utah Code provisions 63G-2-305 and 63G-2-309. The procurement is seeking statements of qualifications from professional services providers and consultants under Utah Procurement Code 63G-6a Part 15, with contract duration of five years. Vendors are required to submit both redacted and non-redacted versions of their proposals if claiming confidentiality; the Division of Purchasing will not perform redactions on behalf of claimants who fail to provide a redacted copy. The form includes fields for claimant information, company details, and specification of which pages, paragraphs, and sections of the submission warrant confidentiality protection.
The confidentiality claim form emphasizes that submission of a claim does not guarantee protected classification if the government receives a public records request under the Government Records Access and Management Act (GRAMA). Vendors must provide concise statements explaining reasons for confidentiality claims, specifically addressing how disclosure could reasonably result in unfair competitive injury or reveal trade secrets. The form requires identification of the specific governmental entity receiving the submission and the reason for the claim. No pricing information should be included in qualifications submissions. The highest-ranked vendor will be selected for contract negotiations at fair and reasonable compensation to be determined through subsequent discussions; if negotiations fail with the top-ranked vendor, the state may proceed to negotiate with the next highest-ranked vendor.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
