About this file

This is a Claim of Business Confidentiality document submitted to the State of Utah Division of Purchasing in connection with the Road Salt procurement. The document addresses confidentiality protections for proprietary information submitted by a vendor in response to the RFP for bulk road salt supply. The RFP seeks to establish a contract with an initial term of five years, with potential for multiple awards based on vendors meeting both technical score thresholds and total score requirements. Vendors are required to guarantee pricing for a minimum of one year from the contract award date.

The business confidentiality claim permits vendors to designate specific information within their proposals as confidential or proprietary, subject to applicable Utah public records law and procurement regulations. This protection applies to trade secrets, financial data, pricing formulas, and other commercially sensitive information that vendors wish to shield from public disclosure. The document outlines the procedures and criteria for substantiating confidentiality claims, ensuring that legitimate business information receives appropriate protection while maintaining procurement transparency and competitive fairness. An administrative fee of 0.75% applies to contract awards resulting from this procurement.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
