About this file
This is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the State of Utah Division of Purchasing's RFP for golf carts for state parks. The form serves as a template for vendors to claim trade secret or commercial financial information protection under Utah Code 63G-2-305 and 63G-2-309. Claimants must submit a concise statement of reasons supporting their confidentiality claim and are required to provide both redacted and non-redacted versions of their proposals; failure to submit a redacted copy will result in the Division of Purchasing declining to redact the proposal on behalf of the claimant. The form requires claimant information including company name, address, representative name, telephone number, and email address, along with details specifying which pages and paragraphs of the submitted materials are subject to the confidentiality claim.
The confidentiality claim process is discretionary, and submitting a claim does not guarantee that information will receive protected classification if the government receives a records request under the Government Records Access and Management Act (GRAMA). Claimants must identify the specific governmental entity receiving the records, provide detailed reasoning for each page and paragraph subject to protection, and submit a signed and dated form. This form is standard procedure for competitive procurements involving proprietary or sensitive business information and allows vendors to protect legitimate business interests while maintaining transparency requirements under Utah public records law.

Business Request for GRAMA Business Confidentiality Claim
Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
