About this file

This file is a Business Confidentiality Claim form issued by the Utah State Archives Office of the Government Records Ombudsman in connection with the Provo City School District's 2026 E-Rate Access Points procurement. The form is designed to allow vendors submitting proposals to claim protection for trade secrets and commercial financial information under Utah Code 63G-2-305 and 63G-2-309. Vendors bidding on the access points contract must submit all bids through U3P (Utah Public Procurement Place, Bonfire/Euna) by March 23, 2026, at 2:00 pm MST. The procurement seeks new access point equipment for the school district's schools, with specifications detailed in the attached Scope of Work. The contract will be awarded to a single responsive and responsible vendor with the highest evaluation score, with a contract term of one year during which the vendor must guarantee its pricing.

Claimants seeking confidentiality protection must submit both redacted and non-redacted versions of their proposals, including a concise statement of reasons supporting the claim. The Division of Purchasing will not redact proposals on behalf of vendors who fail to submit a redacted copy. Making a confidentiality claim does not guarantee protected classification status if the government receives a public records request under the Government Records Access and Management Act (GRAMA). All vendors must participate in the E-Rate program and comply with E-Rate regulations, including obtaining a SPIN number and filing a timely SPAC. All equipment must be new; used or refurbished items are not acceptable, and the District reserves the right to determine product equivalence and compatibility.

Business Request for GRAMA Business Confidentiality Claim

Note: Utah Code § 63G-2-305(1) states that trade secrets can be protected if the person submitting the trade secret provides the governmental entity with a confidentiality claim. Likewise, Utah Code § 63G-2-305(2) states that commercial financial information can be protected if disclosure could reasonably be expected to result in unfair competitive injury to the person submitting the information, and that person has provided a confidentiality claim. Confidentiality claims are described in Utah Code § 63G-2-309. A claim must include a concise statement of reasons supporting the claim and must be submitted with the information requested to be protected. A claimant MUST submit a redacted and non-redacted version of their proposal. The entire proposal may NOT be redacted. The Division of Purchasing will not redact a proposal on behalf of a claimant if they fail to upload a redacted copy of their proposal.
