About this file

This is a Public Contract Boycott Restriction Statement (Attachment B) issued by the Jordan School District in Utah for vendors bidding on the Bingham High School Track Replacement project. The statement, revised September 10, 2024, requires all vendors contracting with Jordan School District to certify compliance with Utah Code 63G-27 (S.B. 97) regarding public contract boycott restrictions. Vendors must confirm they are not currently engaged in an economic boycott or boycott of the State of Israel and agree to maintain this compliance throughout the contract term. The statement specifies prohibited boycott activities, including those targeting the State of Israel, companies engaged in traditional energy, mining, agriculture, firearms manufacturing or distribution, companies not meeting environmental standards beyond state and federal requirements, and companies not facilitating access to abortion or sex characteristic surgeries. Vendors are required to sign and date the certification statement, providing their company name and the solicitation name and number.

The Bingham High School Track Replacement project involves replacing and resurfacing the running track at the school located in South Jordan, Utah, with a new synthetic track surface system and associated accessories. The scope includes an additive alternate option for a poured synthetic track surface system and unit pricing for track substrate remediation work. The project is issued under the State of Utah Procurement Code, with the Jordan School District reserving the right to reject any or all proposals and waive any informality or technicality. The awarded contract will be granted to the lowest responsive and responsible bidder meeting all specifications and requirements outlined in the bid documents.

ATTACHMENT B

Public Contract Boycott Restriction Statement

In accordance with Utah Code 63G-27 (S.B. 97) Public Contract Boycott Restrictions, vendors contracting with the Jordan School District to provide any good or service, including supplies, information technology, or construction services, must certify they are not currently engaged in an “economic boycott” nor a “boycott of the State of Israel” as those terms are defined in that Code section. Vendors must also agree not to engage in either boycott for the duration of the contract (if awarded). For example, a vendor may not, without an ordinary business purpose, boycott: the State of Israel; companies engaged in activities related to traditional energy, mining, or agriculture; companies engaged in the manufacture, distribution, sale, or use of firearms; companies that do not meet environmental standards beyond applicable state and federal laws; or companies that do not facilitate access to abortion or sex characteristic surgeries. If a vendor does engage in such a boycott, it must immediately notify the public entity party to the contract in writing.

We agree to comply with the above statement during the entire contract period.
