2.10 SUBCONTRACTORS, SUPPLIERS, AND OTHERS
2.10.1 If Owner requires the identity of certain Subcontractors, Suppliers, individuals, or entities to be submitted to the Owner in advance of a specified date prior to the Effective Date of the Agreement, the apparent Successful Bidder, and any other Bidder so requested, shall within five days after Bid opening, submit to the Owner a final list of all such Subcontractors, Suppliers, individuals, or entities proposed for those portions of the work for which such identification is required. Such list shall be accompanied by an experience statement with pertinent information regarding similar projects and other evidence of qualifications for each such Subcontractor, Supplier, individual, or entity if requested by Owner. If the Owner or the Engineer has a reasonable objection to any proposed Subcontractor, Supplier, individual, or entity, the Owner may, before the Notice of Award is given, request the apparent Successful Bidder to submit a substitute, without an increase in bid price.
2.10.2 If apparent Successful Bidder declines to make any such substitution, the Owner may award the contract to the next lowest responsible Bidder that proposes to use acceptable Subcontractors, Suppliers, individuals, or entities. Declining to make requested substitutions will not constitute grounds for forfeiture of the bid security of any Bidder. Any Subcontractor, Supplier, individual, or entity so listed and against which the Owner or Engineer makes no written objection prior to the giving of the Notice of Award will be deemed acceptable to the Owner and Engineer subject to revocation of such acceptance after the Effective Date of the Agreement as provided in paragraph 6.06 of the General Conditions.

http://www.pennbid.net/
2.12 BASIS OF BID/EVALUATION OF BIDS
2.12.1 Bidders shall submit a Bid on a unit price basis for each item contained on the Bid Form. The price for each alternate will be the amount added to or deleted from the base Bid if OWNER selects the alternate.
2.12.2 The total of all estimated prices will be determined as the sum of the products of the estimated quantity of each item and the unit price Bid for the item. The final quantities and Contract Price will be determined in accordance with Paragraph 11.03 of the General Conditions.
2.12.3 The Owner may conduct such investigations as the Owner deems necessary to establish the responsibility, qualifications, and financial ability of Bidders, proposed Subcontractors, Suppliers, individuals, or entities to perform the Work in accordance with the Contract Documents.
Alternate Bid items may or may not be awarded based on the discretion of the Owner.
2.13 SUBMITTAL OF BID VIA PENNBID
2.13.01 Sealed Bids must be submitted by [date/time] via PennBid. Failure to submit any of the required documentation as noted in these Instructions to Bidders and Bid Form/Form of Guaranty by this date and time shall result in bidder’s disqualification.
2.13.02 Sealed bids will be opened on Jun 1, 2026 at 3pm EST.
2.14 MODIFICATION AND WITHDRAWAL OF BID
2.14.01 Bids may be modified or withdrawn via PennBid at any time up to the bid due date and time.
2.14.02 If within 24 hours after Bids are opened any Bidder files a duly signed written notice with the Owner and promptly thereafter demonstrates to the reasonable satisfaction of the Owner that there was a material and substantial mistake in the preparation of its Bid, that Bidder may withdraw its Bid, and the Bid security will be returned. Thereafter, if the work is rebid, that Bidder will be disqualified from further bidding on the work.
2.14.03 If the bid is withdrawn, the Owner may either award the Contract to next lowest qualified responsible and responsive Bidder or reject all bids and resubmit the project for bidding. If the Owner elects to reject all bids and resubmit as a result of withdrawal (and not for other reasons), the withdrawing bidder is obliged to pay the costs of printing new contract documents, required advertising, and printing and mailing notices to prospective bidders.
2.15 BID OPENING PROCEDURE
2.15.01 Bids will be opened and posted publicly on PennBid. An abstract of the amounts of the sealed Bids and major alternates (if any) will be made available to Bidders after the opening of Bids.
2.16 BIDS TO REMAIN SUBJECT TO ACCEPTANCE
2.16.01 All Bids will remain subject to acceptance for the period of time stated in the Bid form. The Owner may, in its sole discretion, release any Bid and return the Bid security prior to the end of this period.
2.17 AWARD OF CONTRACT
2.17.01 The Owner reserves the right to reject any or all bids or any parts thereof, waive informalities, irregularities, or technicalities, and negotiate contract terms with the Successful Bidder. The Owner reserves the right to reject all nonconforming, nonresponsive, unbalanced or conditional bids. The Owner reserves the right to reject the bid of any Bidder if Owner believes it would not be in the best interest of the project to make an award to that Bidder, whether because the bid is not responsive or the Bidder is unqualified or of doubtful financial ability or fails to meet any other pertinent standard or criteria established by Owner.
2.17.1 More than one Bid for the same work from an individual or entity under the same or different names will not be considered. Reasonable grounds for believing that any Bidder has an interest in more than one Bid for the work may be cause for disqualification of that Bidder and the rejection of all Bids in which that Bidder has an interest.
2.17.2 Discrepancies in the multiplication of units of work and unit prices will be resolved in favor of the unit prices. Discrepancies between the indicated sum of any column of figures and the correct sum thereof will be resolved in favor of the correct sum.
2.17.3 The Owner may consider the qualifications and experience of Subcontractors, Suppliers, and other persons and organizations proposed for portions of the work. OWNER may also consider the operating costs, maintenance requirements, performance data and guarantees of major items of materials and equipment proposed for incorporation in the work when such data is required to be submitted prior to the Notice of Award.
2.17.4 If the contract is to be awarded, it will be awarded to the lowest responsive and responsible Bidder (the "Successful Bidder") based on the “Total Lump Sum Contract Price”. In awarding bids, the Owner shall have the right to take into consideration the following factors in addition to price:
A. Character, integrity, reputation, and judgment of the Bidder.
B. The previous and existing compliance of the Bidder with the requirements of all-applicable laws and regulations.
C. The number and scope of the conditions attached to the bid.
D. The ability, capacity, experience, and skill of the Bidder to comply with the terms of the Contract.
2.18 SUCCESSFUL BIDDER REQUIREMENTS & EXECUTION OF CONTRACT
2.18.01 The Successful Bidder will, after being issued a Notice of Intent to Award from Owner, provide a Financial Balance Statement listing assets and liabilities and containing an operating statement for the most recent fiscal year. This Financial Balance Statement must be submitted within ten (10) days of being issued the Notice of Intent to Award. Failure to provide an adequate Financial Balance Statement within ten (10) days after being issued a Notice of Intent to Award may result in Bidder disqualification.
2.18.02 Each bid must be accompanied by a bid security made payable to Owner for ten (10) percent of the Bidder’s maximum bid price and in the form of a Certified Check or Surety Company Bid bond. The bid security of the Successful Bidder will be retained until such Bidder has executed the agreement and furnished the required contract security, whereupon the bid security will be returned. If the Successful Bidder fails to execute and deliver the Agreement and furnish the required contract security with fifteen
(15) days after the Notice of Award, the Owner may annul the Notice of Award, and the Bid security of that Bidder will be forfeited. The Bid security of the other Bidders whom OWNER believes to have a reasonable chance of receiving the award may be retained by the Owner until the earlier of the seventh day after the Effective Date of the Agreement or the sixty-first (61st) day after the Bid opening, whereupon Bid security furnished by such Bidders will be returned. Bid security with Bids, which are not competitive, will be returned within seven (7) days of Bid opening.

In such case, the Owner, at its discretion, may award the contract to the next lowest responsible bidder, or reject all bids.
