About this file
This document is a Business Confidentiality Claim Form for the Utah Department of Transportation (UDOT) solicitation for Cummins Engine parts and diagnostic software. The solicitation is for a five-year contract anticipated to result in a single provider award, focusing on providing parts and diagnostic software for Cummins Engines. The procurement is conducted in accordance with the Utah Procurement Code and administrative rules, with the intent of establishing a comprehensive supply contract for engine-related components and diagnostic tools.
The form specifically addresses the potential confidentiality of submitted proposal information, outlining the conditions under which a bidder might claim business confidentiality. While pricing and cost proposals cannot be classified as confidential, bidders may protect certain non-public information such as financial statements, employee details, and customer information that could potentially reveal trade secrets or cause competitive injury if disclosed. The document provides a structured mechanism for bidders to assert confidentiality claims, subject to review and potential public disclosure under Utah state regulations.
