a. No oral, telegraphic or telephone bids will be considered.

b. The bid must be signed with the full name and address of the bidder; if a co-partnership, by all members of the firm with names and addresses of each member;

and if corporation, by two duly authorized officers with corporate seal attached and the name of the state in which it is incorporated.

c. Signed copies of any addenda issued during advertising and bidding period shall accompany all bid proposals.

2. BID GUARANTEE OR BOND

The check or bond shall be forfeited as liquidated damages if the bidder fails to execute the Contract incorporated in the Contract Documents and furnish bonds and required insurance certificates within ten

(10) days following notice of award of the Contract to him.

The bid and the bid guarantee may be withdrawn in accordance with Pennsylvania Act No. 4, approved January 23, 1974, as follows. A bidder may withdraw his bid from consideration after the bid opening without forfeiture of the certified check, bank cashier's check, surety bid bond or other security filed with the bid if the price bid was submitted in good faith, and the bidder submits credible evidence that the reason for the price bid being substantially lower was a clerical mistake as opposed to a judgment mistake, and was actually due to an unintentional and substantial arithmetical error or unintentional omission of a substantial quantity of work, labor, material or services made directly in the compilation of the bid; provided:

No bidder who is permitted to withdraw a bid shall supply any materials or labor to, or perform any subcontract of other work agreement for, any person to whom a contract or subcontract is awarded, in the performance, without the written approval of the contracting body.

The Wysox Community Park Boat Launch Project 4

If a bid is withdrawn in accordance with the provisions of this act, the contracting body may award the Contract to another bidder or reject all bids and resubmit the project for bidding. In the event the contracting body resubmits the reject for bidding, the withdrawing bidder shall pay the costs, in connection with the resubmission, of printing and mailing notices to prospective bidders, if the contracting body finds that such costs would not have been incurred but for such withdrawal. In no event shall the withdrawing bidder be permitted to resubmit a bid for the project.

If the contracting body intends to contest the right of a bidder to withdraw a bid, it should hold a hearing thereon within ten (10) business days after the opening of such bids and issue an order allowing or denying the claim of such rights within five (5) days after the hearing. Notice of the claim to withdraw the bid shall be made within two (2) business days.

The bid guarantee of all but the three (3) lowest bidders on each Contract will be returned within fourteen (14) days after the date of opening of the bids. A Non-Collusion Affidavit in proof that the contractor has not entered into any collusion with any person in respect to this proposal, or any other proposal, for the contract for which the proposal is submitted is required.
