About this file

This is a Payment Bond form for the City of Midland, Texas, required as a condition of contract performance for the City of Midland Paving, Alleys, Streets & Sidewalks 06 & Downtown Alley-1 Paving Improvements & Bulb-out project. The bond secures the contractor's obligation to pay all claimants, including subcontractors and suppliers of labor and materials, in connection with the execution of the project work. The project encompasses two separate paving locations under COMPASS 06—one extending from Camp Street to Marienfeld Street and Industrial Avenue to Florida Avenue, and a second location from Lamesa Road to Madison Street and Orchard Lane to Davis Avenue—as well as Downtown Alley-1 paving improvements along the downtown alley corridor between Illinois Avenue and Texas Avenue, and bulb-out additions along Main Street.

The Payment Bond requires the principal contractor and surety to be jointly and severally bound to the City of Midland as obligee in a specified dollar amount. The surety waives notice of any changes, extensions of time, alterations, or additions to the contract terms, work scope, plans, specifications, or drawings, and acknowledges that no assignment of the contract shall affect its obligation under the bond. The bond must be executed by both the principal and surety with proper authorization documentation, including a Power of Attorney form, and requires approval as to form by the City Attorney. The bond document itself contains blank fields for completion, including the principal's name and address, surety information, bond amount, and contract execution date.
