About this file

This document is Exhibit 5, an affirmation document for a biomedical waste removal contract involving the Oklahoma State Department of Health (OSDH) and County Health Departments. The exhibit outlines critical requirements for waste disposal services, including strict prohibitions on waste consolidation, waste ownership transfer, and indemnification provisions. The supplier will be responsible for waste pickup at mutually agreed times and locations designated by OSDH, with a preference for service during normal operating hours.

The document emphasizes specific waste handling protocols, including that County Health Department personnel are not permitted to transport waste to alternate locations. The supplier assumes full title to biomedical waste upon removal and must indemnify OSDH against any potential losses, damages, suits, penalties, or legal expenses arising from their service performance. Specific pickup frequencies and site-specific conditions are referenced in the accompanying Exhibit 4, suggesting a comprehensive and detailed waste management contract with clear operational expectations and legal protections for the state agency.

EXHIBIT 5

Bidder must affirm (initial) agreement to the following statements:

· The bidder is strictly forbidden from consolidating OSDH Biomedical Waste with an RCRA listed or characteristic controlled industrial waste at any time prior to the delivery of said biomedical waste to the designated destination facility.

· It is understood by and between the parties that the supplier will assume title to all biomedical waste removal from any County Health Department site. The bidder will indemnify and hold harmless the Oklahoma State Department of Health, its servants, officers, agents, or employees from any and all loss, damages, suit, penalties, costs, liabilities, attorney fees and/or other expenses arising out of any claim for loss or damage as a result of any act or omission by the supplier, its servants, officers, agents, or employees pursuant to the contract.

· Pickup will be scheduled at mutually agreed upon times by both parties, and will be at a site designated by the Oklahoma State Department of Health. See Exhibit 4 for the requested frequency, and any special conditions for each site. The OSDH prefers pickup services to be performed within normal operating hours of each location. County Health Department personnel will not, under any circumstances, be responsible for transporting waste to another location.
