About this file
This is a permit application and approval document involving the Michigan Department of Natural Resources (MDNR) Parks and Recreation Division and the U.S. Army Corps of Engineers (USACE) for a harbor modification project at Port Austin, Michigan on Lake Huron. The project authorizes the discharge of approximately 11,920 cubic yards of rock to construct a breakwater extension consisting of 2,520 cubic yards of core stone, 2,200 cubic yards of sub-armor stone, and 7,200 cubic yards of armor stone. The new breakwater section will extend 160 linear feet from the western terminal end of the existing breakwater with an 80-foot width, overlapping the existing bin-wall by an additional 90 feet with a 95-foot width for a total overall length of 250 feet. Additionally, the project involves repair of the western pier system by removing damaged docks and gangways and installing new dock components including a 72-foot-long gangway, a 10-foot-wide main floating pier extending 545 feet with a 900 square foot triangular deck, 22 finger piers, and 15 new guide piles. The work is authorized to be completed by December 31, 2028. The site is located at 8774 Lake Street, Port Austin, Michigan in Huron County, with the project impacting 9,000 square feet of the USACE navigation channel and extending 110 feet into the Federal Navigation channel.
The permit includes requirements for the applicant to obtain as-built drawings in PDF and CAD formats within 30 days of completion, maintain access to upstream marinas throughout construction, and provide post-dredge surveys and navigation channel relocation notifications to USACE Operations prior to commencing the breakwater extension. The applicant must notify the Detroit Project Office Operations Manager a minimum of five days before construction begins and within five days after completion. The project includes mitigation dredging of approximately 250 cubic yards to bring the navigation channel area to full project depth. The permit was issued by the U.S. Army Engineer District, Detroit under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act, and became effective on April 27, 2023.

DEPARTMENT OF THE ARMY PERMIT
Permittee Michigan DNR-Parks and Recreation Division
Permit No. LRE-2007-00842-16-S21
Issuing Office U.S. Army Engineer District, Detroit
NOTE: The term "you" and its derivatives, as used in this permit, means the permittee or any future transferee. The term "this office" refers to the appropriate district or division office of the Corps of Engineers having jurisdiction over the permitted activity or the appropriate official of that office acting under the authority of the commanding officer.
You are authorized to perform work in accordance with the terms and conditions specified below.
Project Description:
a) Discharge approximately 11,920 cubic yards of rock consisting of 2,520 cubic yards of core stone, 2,200 sub-armor stone and 7,200 armor stone to construct a breakwater extension.
The new breakwater section will extend 160 linear feet from the western terminal end of the existing breakwater bin-wall, with a width of 80 feet. The new breakwater will overlap the existing bin-wall by an additional 90 feet. This section will have a 95-foot width. The overall length of the breakwater extension is 250 feet. The location proposed for the breakwater extension will impact 9,000 square feet of the USACE navigation channel and extend 110 feet into the Federal Navigation channel.
b) Repair the western pier system by removing all damaged docks and gangways. Install:
new dock components to reconstruct the 72-foot-long gangway; a 10-foot-wide main floating pier extending 545 feet with a 900 square foot triangular shaped deck centrally located; 22 finger piers; 15 new guide piles; and a terminal 10-foot-wide pier to reconstruct the 49 slips..
Project Location:
In Lake Huron, offshore property in 8774 Lake Street, Port Austin, Michigan.
Permit Conditions:
General Conditions:
1. The time limit for completing the work authorized ends on December 31, 2028. If you find that you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least one month before the above date is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of this permit from this office, which may require restoration of the area.
3. If you discover any unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately stop work in that area and notify this office of what you have found. We will initiate the Federal and state coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places.
4. If you sell the property associated with this permit, you must obtain the signature of the new owner in the space provided and forward a copy of the permit to this office to validate the transfer of this authorization.
5. If a conditioned water quality certification has been issued for your project, you must comply with the conditions specified in the certification as special conditions to this permit. For your convenience, a copy of the certification is attached if it contains such conditions.
6. You must allow representatives from this office to inspect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms and conditions of your permit.
Special Conditions:
1. Your signature, as permittee, indicates that, as consideration for the issuance of this permit, you voluntarily accept and agree to comply with all of the terms and conditions of this permit.
2. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration.
3. The requester must obtain appropriate permits prior to construction and coordinate the relocation of the federal navigation channel with applicable federal, state and local agencies.
Coordination includes but is not limited to providing pre- and post-construction notifications (e.g., USCG- ‘Notice to Mariners’) and as-built data required to update nautical charts (show channel limits to aid maritime vessel traffic).
4. Utility crossings shall be verified prior to construction activities.
5. Access to upstream marina(s) must be maintained at all times throughout construction. The navigation channel must be relocated as described in the joint permit application and the drawings dated 04 October 2022 (Encl 2) and approved by USACE Operations prior to commencing with the extension of the breakwater. Applicant will submit post-dredge surveys and as-builts of the navigation channel to USACE Operations (POC LRE Section 408 Coordinator, Brian Korzetz, brian.r.korzetz@usace.army.mil) for approval. The federal navigation channel will be considered relocated upon receipt and acceptance by USACE of the as-builts and post-construction survey after verification that authorized dimensions have been met.
6. The requester must submit as-built drawings in Adobe PDF and either Autodesk AutoCAD or Bentley MicroStation, CAD file format to the Section 408 Coordinator within 30 days of completion of work. Drawings shall include the location and dimensions of the relocated federal navigation channel with the vertical datum referenced. The requestor must also provide a post-construction survey with sufficient detail for USACE to verify the channel has been adequately relocated.
7. The requester shall notify the Operations Manager of the Detroit Project Office, Mr. Pat Kuhne at (313) 226-2069, that work is commencing a minimum of 5 days prior to construction beginning and that construction is completed within 5 days after work is complete.
