About this file

This document is an Addendum 1 for a state contract opportunity issued by the Oregon Department of Transportation (ODOT) for the Major Bridge Maintenance Yaquina Bay Bridge Pier 2 Dolphin Replacement Project. The project involves removing 11 existing dolphins with approximately 33 steel piles and installing 36 new steel pipe piles in Newport, Oregon, with work scheduled between November 1, 2025, and February 15, 2026. The bid opening date was changed to October 30, 2025, at 10:00 am, and a pre-bid meeting was held on October 13, 2025, via Microsoft Teams. The project requires maintaining navigation lights, removing old steel piles from the bay floor, and adhering to strict environmental protection protocols, including Marine Mammal Protection Act requirements.

The contract is a state-funded project with an estimated value between $1,000,000 and $2,000,000, subject to State Buy America Build America (BABA) iron and steel requirements. Bidders must be registered in OregonBuys, possess a valid Construction Contractors Board license, and meet various responsibility criteria. Environmental considerations are significant, with work restricted to a specific in-water work window and requiring permits from multiple state and federal agencies. The contractor will be responsible for coordination with the Coast Guard, implementing best management practices, and managing potential marine mammal interactions during construction. Compensation for standby time due to marine mammal shutdowns will be addressed through a change order based on actual time incurred during the project.

a. Cody Stone, ODOT, Maintenance Project Manager

b. Nick Testa, ODOT, Senior Biologist

c. Irene Ulm, ODOT, Wetlands & Environmental Permits Specialist

d. Adam Roberts, ODOT, Region Environmental Coordinator

e. Luke Tubel, ODOT, Structural Engineer

f. Derek Moore, ODOT, Electrical Engineer

g. Julie Wirth-McGee, AKS, Project Manager

h. Greg Morrill, Bergerson Construction, Inc.

i. Chad Curs, Bergerson Construction, Inc.

j. Patrick Baur, Ballard Marine Construction

2. Project Overview

a. Replacing the pier protection dolphins on the north side of the Yaquina Bay Bridge in Newport (12 dolphins, 36 piles), 11 dolphins to be removed, 12 to be installed

b. Maintain nav lights in operating condition during construction

c. The old steel piles are lying on the bay floor and need to be removed

d. IWWW Nov 1 to Feb 15

e. Marine Mammal Protection Act (MMPA) requires work to stop if mammals come within 28 meters of the dolphins during vibratory pile driving.

f. Weekend work is allowed in the specifications, but it is not preferred as we have minimal staffing for inspection and observation

g. Bid was posted on 9/29, we’ve received no questions yet

h. Bid opens Oct 23rd at 2 PM Bid opening changed to 10/30/2025 at 10:00 am.

3. Project Structure

a. ODOT State funded project

b. State Buy America Build America (BABA) iron and steel requirements apply

c. Contract administered by Cody Stone

d. Work inspected by AKS

e. MMPA observation done by AKS

4. NOAs

a. Contractor to contact the Coast Guard a minimum 30 days in advance of work in the channel so they can issue a notification to local mariners

b. On page 10 of 00014917_Exh 7-1_Permit Authorization, Item 21 states that the method of pile placement shall be vibratory. On page 11, Item 24 outlines BMPs required during impact driving. The area of piledriving used to have timber dolphins and it is possible that remnants of the timber piles may be encountered in the substrate. Also, the pile records from past dolphin work indicate dense soils were encountered prior to the specified tip elevation. If either of these conditions are encountered, will impact driving be allowed utilizing the BMPs listed in Item 24?

i. The IHA permit only allows vibratory driving. References to impact driving in the permits are left over from the standard template that should have been removed.

c. Is IHA permit on OreBuys?

i. Added via Addendum 1

d. How many piles are lying on the bay floor?

i. The dive inspection report counted nearly 20 piles, but we believe it’s safe to assume all ~30 piles from the previous replacement project are down there.

e. Will ODOT consider adding a bid item for contractor standby exceeding 1 hour for MMPA shutdowns due to marine mammal presence or weather conditions preventing observation? Bidding contractors cannot effectively estimate the number or duration of marine mammals entering the exclusion zone. Nor can the weather conditions that would prevent observation of marine mammals be predicted by bidders.

i. Instead of writing a specification and amending the bid schedule, the contractor, inspector, and project manager will track down time during the work due to MMPA shutdowns and address compensation based on actual standby time incurred via a change order at the end of the project. In order to incur time, shutdowns must me at least 1 hour in length.

f. The plans specify no work zones where eel grass beds are present, which includes no barge use in that location.
