This is a requirements contract with no minimum purchase guarantee, meaning quantities may be increased or decreased based on city needs, with orders placed on an as-needed basis. All products must be current manufacturer items delivered within 30 days of request, with sellers required to maintain reasonable stock throughout the contract term and subject to liquidated damages of 5 percent of unit price for delivery delays. Required qualifications include enrollment in the City's Annual Bid Security Program (non-refundable $100 fee), submission of a $25 bid processing fee and $25 performance security fee, completion of seller contact forms, customer references documenting prior contract experience, a Consent and Authorization Agreement, and seller qualifications documentation. For products containing recycled materials, bidders must submit a completed Certification of Recycled Content form with mill information and documentation of recycled content percentages verified through mill and production records. All quotes must be submitted electronically through PHLContracts no later than 10:30 AM on Wednesday, July 22, 2026, with no quotes accepted after the bid opening time, and the contract award will be for an initial twelve-month term with options to renew for up to four additional one-year periods at the City's sole discretion.

The procurement includes a Local Business Entity (LBE) certification preference of 10 percent for quotes of one million dollars or less, available to sellers holding current valid LBE certification from the Procurement Commissioner and performing or maintaining 51 percent or more of work and inventory within Philadelphia's geographic limits. Failure to comply with LBE certification requirements during contract performance may result in revocation of LBE status, breach of contract declarations, payment of liquidated damages equal to 10 percent of the total awarded contract amount, and potential debarment for up to three years. All sellers must comply with non-discrimination provisions, ethics requirements, prevailing wage standards for applicable service categories, and Chapter 17-1300 minimum wage and benefits standards currently set at $16.82 per hour effective July 1, 2025, subject to annual Consumer Price Index adjustments. The estimated expenditure for the contract period is $150,000, with the Procurement Commissioner retaining sole discretion in all award determinations and the right to reject all quotes, cancel the bid solicitation, or cancel awarded contracts if deemed in the City's best interest. Awards for contracts exceeding $94,000 become binding only upon satisfaction of conditions including posting of required performance and payment security, Law Department approval, Finance Director and Controller certification of fund availability, and Procurement Commissioner execution. All articles must be delivered at the quoted price FOB Destination with unit pricing prevailing in case of discrepancies with extended amounts, and sellers must submit quotes net of all federal and state taxes as the City of Philadelphia is exempt from federal excise, transportation, and Pennsylvania sales taxes.
