About this opportunity

The State of Utah Division of Purchasing is processing a notice of intent to award a contract without engaging in a standard procurement process, with a public comment period closing September 22, 2026 — the mechanism by which interested vendors may challenge the sole-source determination before award.

The procurement involves an amendment to an existing contract (246298) with Waters Technologies for three MassLynx Acquisition PCs equipped with Windows 11 operating systems, instrument software, and half-day startup service. The systems are intended to replace outdated equipment used with TQ-S laboratory apparatus and to maintain compliance with Clinical Laboratory Improvement Amendments (CLIA) regulations at the Utah Department of Health and Human Services. Waters Technologies is identified as the sole source capable of providing MassLynx systems that integrate with the existing TQ-S equipment, establishing the foundation for the non-competitive award exception.

The contract amendment adds $31,224.00 to the existing contract, increasing the total from $1,253,937.71 to $1,285,161.71 — a 2% increase. The quotation from Waters Technologies, dated August 24, 2026 and expiring September 23, 2026, specifies individual pricing of $1,840.00 per startup service and $11,170.00 per MassLynx Acquisition PC. Freight is prepaid at F.O.B. Destination. Payment terms are NET 30 DAYS.

The Statement of Work requires the contractor to provide two-hour callback response time, service center repair and on-site hardware troubleshooting within 48 hours of request, priority technical remote support, materials and parts as specified in the Statement of Coverage, firmware updates, and service reports upon work completion. The contract term is January 1, 2024 forward, with annual invoicing at the beginning of each contract year.

Other vendors may submit written challenges demonstrating the existence of competing sources, equivalent products, or cost comparisons. Challengers must certify non-participation in economic boycotts and boycotts of the State of Israel under Utah Code 63G-27 et seq.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
