About this opportunity
The West Virginia Department of Environmental Protection (WVDEP), Office of Special Reclamation, is soliciting bids through an Agency Request for Quote (ARFQ 0313 DEP2600000001) for construction and reclamation services at the Royal Coal Company Permit P-688 site located in Fayette County near Fayetteville, West Virginia. This project encompasses 21 line items including mobilization and demobilization, site preparation, installation of 1,820 linear feet of silt fence, Type 1 revegetation of 6.25 acres, installation of discharge piping and tunnel connection piping, bat gate installation, conveyor tunnel ventilation, regrading of Ponds 12 and 13 with 300 linear feet of channel work, structure demolition and encapsulation, incidental stone placement (1,000 tons upper site and 100 tons lower site), road maintenance, vehicular gates (2 units), and pipe anchors (5 units). The contractor is responsible for all surveying, construction layout, quality control testing, material ordering and delivery, environmental controls, dust management, water pollution prevention, sediment and erosion control, and provision of a comprehensive Schedule of Values at the mandatory pre-construction conference. Key qualifications include West Virginia contractor licensure, submission of performance and labor/material payment bonds equal to 100 percent of contract value, a bid bond equal to five percent of the total bid amount, commercial general liability and automobile liability insurance with minimum limits of $2,000,000 per occurrence, and compliance with Davis-Bacon wage rates and local labor market hiring requirements (75 percent local labor for projects exceeding $500,000). The mandatory pre-bid meeting was held on July 30, 2025, at 10:00 a.m. on-site, with technical questions due August 6, 2025; the original bid closing date of August 13, 2025, was extended to August 26, 2025, at 10:30 a.m. via Addendum No. 1, with all bids submitted electronically through wvOASIS Vendor Self Service at www.wvOASIS.gov. The contract will be awarded to the lowest responsive bidder on a fixed-period 365-calendar-day term commencing from the Notice to Proceed, with liquidated damages assessed at $1,000 per working day for delays beyond the contract completion date.
No specific set-asides for disadvantaged enterprises or minority-owned businesses are identified in the solicitation documents; however, all bidders must comply with drug-free workplace requirements and must not be federally or state debarred or suspended, have outstanding environmental enforcement actions with DEP, or have unresolved vendor complaints. The solicitation documents do not identify any incumbent vendors, current contractors, or existing infrastructure requiring integration beyond the site-specific conditions and utilities already present. The revised engineer's estimate provided in Addendum No. 1 is $841,193, which serves as the budget range for this procurement. Bidders must acknowledge receipt of all addenda to avoid bid disqualification and must submit acknowledgment with their formal bids. Contact Linda L. Stanley, the buyer, at (304) 414-1144 or linda.l.stanley@wv.gov for additional information. All pricing is firm for the life of the contract, with vendors required to accept payment by electronic funds transfer and P-Card, and the contractor assumes responsibility for all applicable sales, use, and personal property taxes.
