About this opportunity

Alpine School District's Purchasing Department has issued a Notice of Intent to Award a sole source contract to The Blind Mule Behavioral Services for special education consulting and compliance monitoring services pursuant to Utah Code 63G-6a-802 and Utah Administrative Rule R33-108. This procurement is being conducted by Alpine School District's Administration department in Utah County without engaging in a standard competitive procurement process due to the vendor's identification in a binding legal settlement agreement resolving litigation related to special education services compliance. The scope of services includes comprehensive review of Alpine School District policies and procedures related to special education services and student transportation, delivery of training on best practices in these areas, and ongoing compliance monitoring to ensure adherence to established best practices. The contract term is five years with no renewal options unless separately justified and posted in accordance with Utah procurement law, and the total estimated cost is $136,000 over the contract period. The due date for any challenges to this sole source determination or submissions is February 25, 2026, and potential respondents must certify compliance with all mandatory provisions outlined in the district's vendor prerequisites, terms and conditions, and Utah state procurement requirements, including anti-boycott certifications under Utah Code 63G-27.

This procurement is restricted to The Blind Mule Behavioral Services as the sole source vendor, as the company is specifically identified in the binding legal settlement agreement and no other vendor is legally authorized or capable of fulfilling the contractual obligations. No set-asides for disadvantaged enterprises, small businesses, or other special designations apply to this sole source procurement. All contractors must comply with Alpine School District's Standard Terms and Conditions, which include guarantees on pricing for the specified period, a one-year product warranty, indemnification requirements protecting the district from third-party claims, compliance with federal and state employment discrimination and civil rights laws, and six-year record retention requirements. The contract award value of $136,000 represents the total estimated cost across the five-year service period. Notably, Alpine School District is undergoing statutory reorganization that will dissolve the current district and create three independent school districts effective July 1, 2027, which may affect contract administration and assignment during the service period. Award notifications do not constitute binding contracts; only fully executed purchase orders or contracts create binding obligations, and the vendor may not commence work until receiving executed documentation.
