About this opportunity
The Utah Division of Purchasing issued a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process for a five-year service agreement on Shimadzu Total Organic Carbon Analyzers (TOC-L/TNM-L instruments) serving the Utah Department of Health and Human Services, with a notice-and-challenge period closing September 14, 2026. This is a sole-source procurement under Utah Code Annotated Section 63G-6a-802(3), justified on grounds of single-source availability, significant transitional costs, or circumstances making standard procurement impractical.
The scope covers preventive maintenance, calibration, repair, and technical support for two Shimadzu TOC-LPN analyzer systems (serial numbers H54315732086 and H54315732087). Service deliverables include annual on-site preventative maintenance with full system diagnostics, component cleaning and inspection, and calibration using certified standard reference materials; priority response for unscheduled repairs with unlimited on-site field visits; and factory-certified technical personnel. The contractor must coordinate routine maintenance visits at least 14 days in advance and submit complete written field service reports after each service event. Technical phone and remote software assistance during standard business hours (8:00 a.m. to 5:00 p.m. MST) are included. All original equipment manufacturer replacement parts, labor, and technician travel are included at no additional cost to DHHS. Monthly invoices are due by the 20th of the following month, with a fiscal-year deadline of July 14 for services performed by June 30. Digital field service reports must be submitted immediately upon completion of on-site visits or remote interventions.
The Shimadzu Scientific Instruments quote, dated April 3, 2026, establishes contract pricing effective October 18, 2026, through October 17, 2031. The Division of Purchasing issued an Award Memo naming Shimadzu Scientific Instruments as the intended awardee. A Notice of No Award subsequently closed the Part 8 notice, indicating that any contract award will proceed as a separate, subsequent stage of the procurement process.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
