About this opportunity

The Massachusetts Department of Transportation (MassDOT) is posting a due diligence notice of intent to accept a best value offer for proprietary air-quality monitoring equipment, with competing vendors able to submit comparable or better offers through August 19, 2026 by 3:00 p.m. via COMMBUYS.

MassDOT intends to procure Agilaire LLC Model 8872 Data Loggers and associated equipment to upgrade existing monitoring systems at 11 sites within the Central Artery Tunnel system. The equipment is a replacement for proprietary equipment not available under statewide contract. The initial contract term is three years with an option to renew for two additional years, totaling five years.

The notice is open to all qualified vendors capable of providing comparable or better value than Agilaire's offer. All responses must be submitted online through COMMBUYS; vendors must register with COMMBUYS to participate and maintain an active account throughout the contract duration. Upon award, the contractor must submit a W-9 form, Prompt Payment Discount Form, and Contractor Authorized Signatory Listing. The Supplier Diversity Program applies to procurements exceeding $250,000 in annual value for executive departments, requiring a minimum commitment of 1% of sales to certified diverse business partners unless exempted.

MassDOT will review all responses received by the deadline and determine whether to accept the Agilaire offer, withdraw the notice, accept an offer from another vendor providing comparable or better value, or accept multiple vendors offering similar value. All contracts are governed by MassDOT Terms and Conditions, which establish standard payment processing through the Comptroller's system, record-retention requirements of six years following final payment, and dispute resolution through Massachusetts law and Massachusetts courts, with mediation available through the Massachusetts Office of Dispute Resolution. Contractors must comply with all federal and state employment discrimination laws and fair employment practices.
