About this file
This is a standard warranty document from Agilaire, LLC, a Knoxville, Tennessee-based equipment and services provider, related to a Massachusetts Department of Transportation (MassDOT) procurement for proprietary equipment. The document outlines Agilaire's warranty terms for both products and services delivered under sales orders and contracts. For products, Agilaire warrants a twelve-month warranty period from delivery covering defects in material and workmanship when proper operation and maintenance procedures are followed. For services, Agilaire warrants thorough, workmanlike performance consistent with industry standards, with a 60-day window for customers to report and submit problems for resolution. Spare parts carry a separate ninety-day warranty from shipment.
The warranty procedure requires customers to contact Agilaire Customer Service to report defects, with initial troubleshooting conducted via telephone consultation. If defects require parts, Agilaire will ship necessary components with a return authorization number, with customers prepaying return shipping. Alternatively, customers may request on-site warranty determination and repair at no labor charge, though a purchase order covering Agilaire's travel expenses and time is required based on the company's Field Service Rates. The warranty excludes unauthorized repairs, damage from ordinary wear and tear, misuse, vandalism, or improper handling and storage. Agilaire's liability is limited to the cost of correcting defects, and the company disclaims liability for incidental or consequential damages. For international work, customers or distributors assume responsibility for local taxes, fees, tariffs, and importation charges.
