About this opportunity

The State of Utah, through the Division of Purchasing in conjunction with the Department of Human and Health Services, is issuing a Notice of Intent to Award a Contract Without Engaging in a Standard Procurement Process (JM26-97) for analytical laboratory equipment and service coverage from Agilent Technologies. This is a sole-source procurement for an Agilent ICPMS 8900 Triple Quadrupole ICP-MS system with associated equipment including a recirculating chiller for AAS/ICP-OES, one SPS 4 autosampler, one MXL1413HDS CPU kit with PC, and CrossLab Silver government and academia support services. The procurement additionally covers service coverage amendments to an existing agreement (Amendment 266171) to add coverage for three additional Agilent systems with varying service periods ranging from one to two years. The contract includes two consecutive one-year service terms commencing May 18, 2026, through May 17, 2028, with an initial equipment and support cost of $44,298.00 and a proposed contract amendment valued at $151,587.60. The posting was published on May 15, 2026, with a due date of May 22, 2026, for any challenges to the sole-source designation. Interested vendors may only submit challenges during the publication period and must submit all inquiries to the Division of Purchasing rather than directly contacting the Conducting Procurement Unit.

This procurement is being pursued as a sole-source award under the justification that standard procurement processes would be impractical and not in the best interest of the state, citing technical exclusivity, proprietary constraints, and Agilent's exclusive manufacturing rights to proprietary OEM parts, patented software, and diagnostic tools. Agilent Technologies is the identified incumbent vendor and exclusive provider for this specialized analytical equipment and associated support services. The procurement consolidates multiple expiring service agreements under a single master agreement to provide administrative efficiency, improved cost leveraging for bulk service rates, and continuity of service for critical laboratory infrastructure. Vendors wishing to challenge this sole-source designation must submit detailed documentation demonstrating competing sources and evidence that their firm can provide comparable or superior equipment meeting or exceeding specifications. All responding vendors must certify compliance with Utah Code 63G-27 et seq., confirming they are not engaged in economic boycotts or boycotts of the State of Israel. The total estimated contract value, including the proposed amendment, is approximately $195,885.60.

NOTICE OF INTENT TO AWARD A CONTRACT WITHOUT ENGAGING IN A STANDARD PROCUREMENT PROCESS The Division of Purchasing is publishing this notice pursuant to the Utah Procurement Code. The Conducting Procurement Unit submitted this form to the Division of Purchasing claiming that it intends to award a contract without competition if it is determined by the Division of Purchasing, in writing, that: - there is only one source for the procurement item; - transitional costs are a significant consideration in selecting a procurement item; or - the award of a contract is under circumstances, described in rules adopted by the applicable rulemaking authority, that make awarding the contract through a standard procurement process impractical and not in the best interest of the procurement unit. In the Files section the Conducting Procurement Unit has identified its justification for wanting to award a contract without engaging in standard procurement process. You MUST read all of the documentation in the Files.
