About this opportunity
The West Virginia Department of Environmental Protection, Office of Oil & Gas, is soliciting bids through an Agency Request for Quote (ARFQ 0313 DEP2300000026) for the Hanlon #1 Well Plugging Project located in Ritchie County, West Virginia. This construction and reclamation project seeks a contractor to plug an abandoned oil and natural gas well (API# 47-085-10441) and reclaim all disturbed land in accordance with West Virginia Code 22-6-23 and 22-6-24. The scope of work encompasses 55 line items including rig and crew services (minimum three-person crew at 130 hours), mobilization and demobilization, heavy equipment rental (bulldozers, excavators, skid steers, and vacuum water trucks at 40-50 hours each), specialized well-work tools (power tongs, pipe cutting equipment, and fishing tools), drilling materials (casing, drill collar, drill pipe, and tubing in specified sizes and quantities), three tri-cone drill bits of varying sizes, pumps and water storage, waste disposal services (gel, liquid waste, and solid waste), and site reclamation materials (aqua gel, cement, limestone gravel, and topsoil). The contract is structured as a time-and-materials fixed-price agreement with unit pricing and a maximum 3 percent administrative cost cap; 50 percent of mobilization and demobilization costs are due upon completion of mobilization, with remaining charges invoiced upon final completion. Bidders must attend a mandatory pre-bid meeting on November 3, 2022, at 11:00 AM Eastern Time on-site (failure to attend results in automatic disqualification); technical questions were due November 10, 2022, at 4:00 PM Eastern; and sealed bids must be submitted electronically through the wvOASIS Vendor Self Service portal by November 21, 2022, at 10:30 AM. The contract requires completion within 90 days of receiving a notice to proceed, with work scheduled Monday through Friday with a maximum 10-hour workday unless approved otherwise.
Bidders must comply with mandatory West Virginia requirements including submission of a 5 percent bid bond with surety power of attorney and seal, a valid West Virginia contractor's license number, a signed drug-free workplace affidavit complying with West Virginia Code 21-1D-5, and proof of federal and state debarment clearance. Prior to contract award, successful bidders must provide a performance bond and labor/material payment bond each equal to 100 percent of the contract value, maintain commercial general liability and automobile liability insurance with limits of not less than $2,000,000 per occurrence, and resolve any outstanding debt to the state or political subdivision and any workers' compensation or unemployment compensation delinquencies. The procurement is not subject to set-asides for disadvantaged enterprises and does not apply Davis-Bacon wage rates; however, vendors must comply with West Virginia's local labor market hiring requirement mandating that at least 75 percent of employees be hired from the local labor market for public improvement projects. No incumbent contractors are identified in the solicitation documents. The solicitation documents do not specify total contract value or award timeline; however, the project scope and 55 line items with unit pricing across labor, equipment, and materials suggest a substantial construction contract. All submissions are public documents subject to disclosure under West Virginia law and the Freedom of Information Act. Inquiries regarding the solicitation should be directed to Herminio David Robles, the procurement contact, at (304) 926-0499 or david.h.robles@wv.gov.
