The procurement encompasses seven line items of insecticide and fungicide products in various formulations and sizes: Insignia Intrinsic (30.5 oz bottle, 22 units); Insignia (122 oz., 9 units); Lexicon (21 oz., 52 units); Insignia Intrinsic (2.5 gallon, 1 unit); Honor Intrinsic (3 lbs., 12 units); Emerald (0.49 lb, 12 units); and Navicon Intrinsic (37 oz., 18 units), with varying quantities allocated to each location. Bids were due on November 8, 2019, at 1:30 p.m. ET, with written questions required by October 30, 2019, at 4:30 p.m. ET. Bidders were required to submit sealed, hard-copy bids to the Office of Procurement Services in Frankfort and provide manufacturers' safety data sheets and instructions for use and application with their submissions. The contract award was based on best value ranking, allocating 900 points to total cost offer and 100 points to delivery offer, with delivery performance measured in calendar days and one percent per day deducted from invoices for late deliveries. All bidders were required to provide Kentucky Tax Registration or evidence of existing Kentucky sales and use tax registration, and out-of-state vendors were required to provide a Certificate of Authority to transact business in Kentucky. Quotations were required on an F.O.B. Destination Freight Prepaid and Allowed basis with the vendor responsible for all freight charges.
Kentucky resident bidders received reciprocal preference in the evaluation process, and qualified bidders including Kentucky Correctional Industries and nonprofit organizations serving individuals with severe disabilities received preference equal to fifteen or twenty percent of maximum points. Bidders claiming qualified bidder status under 200 KAR 5:410(3) were required to submit the Qualified Bidder Affidavit, while those claiming resident bidder status under KRS 45A.494(2) were required to submit the Resident Bidder Affidavit with supporting documentation including Kentucky income tax filings, unemployment insurance contributions, and active workers' compensation policies. All bidders and offerors were required to submit the Annual Affidavit, certifying compliance with Kentucky's campaign finance laws, lobbying disclosure requirements, sales and use tax registration, and attestations regarding delinquent state taxes, boycott prohibitions, and violations of KRS 11A.236. The Commonwealth reserved the right to cancel the contract with thirty days' written notice and to reject bids that did not comply with specifications or to cancel the entire RFB if responses exceeded available funding. No specific budget range or award value was disclosed in the solicitation documents, and no incumbent vendors or existing infrastructure integration requirements were identified in the procurement materials.
