About this file
This is an Annual Affidavit document required by the Commonwealth of Kentucky for bidders, offerors, and contractors participating in state and local contract opportunities. The affidavit serves as a mandatory compliance certification with an effective period of up to one year and must be notarized. All bidders and offerors must swear under penalty of perjury to compliance with Kentucky's campaign finance laws (KRS 45A.110 and 45A.115), confirm awareness of lobbying disclosure requirements and penalties outlined in KRS 45A.485, and certify proper registration with the Kentucky Department of Revenue for sales and use tax collection. Additionally, bidders must attest that they are not delinquent on state taxes or fees, are not engaged in boycotts of persons or entities in jurisdictions with which Kentucky maintains open trade as defined in Executive Order 2018-905, and have not violated prohibitions set forth in KRS 11A.236 during the previous ten years.
For non-bid contracts—including sole-source, not-practical-to-bid, or emergency contracts—contractors must provide additional certifications regarding campaign contributions. These include attestations that neither the contractor nor immediate family members with 10 percent or greater business interest have exceeded contribution limits to the gubernatorial slate elected in the preceding election (KRS 121.056), that the contractor and affiliated officers and employees have not contributed more than $5,000 in aggregate to the campaign of a candidate with jurisdiction over the contract award (KRS 121.330), and that neither the contractor nor affiliates have solicited contributions exceeding $30,000 in aggregate for such campaigns. The affiant must certify full knowledge of all statements' accuracy and acknowledge that non-compliance during the affidavit period requires immediate notification to the Finance and Administration Cabinet's Office of Procurement Services. The Commonwealth retains the right to request updated affidavits at any time and reserves remedies including contract termination and fund repayment for inaccurate disclosures.
