About this opportunity

The Kansas Department of Health and Environment is requesting proposals for construction of the Garrison Cemetery Abandoned Mine Land (AML) reclamation project in Cherokee County, with proposals due September 10, 2026 at 2:00 PM CDT, and mandatory in-person attendance at a pre-proposal conference on August 26, 2026 at 8:30 AM. Failure to attend the entire conference, complete the site walk-through, and sign in and out will result in bid rejection.

This is a federally-funded project under the Department of Interior's Office of Surface Mining Reclamation and Enforcement (OSMRE), subject to Davis-Bacon prevailing wage requirements and Build America, Buy America (BABA) domestic content standards. All iron, steel, manufactured products, and construction materials must be produced in the United States unless an approved waiver is obtained; manufactured products must contain at least 55 percent domestic content by cost.

The scope encompasses clearing and grubbing, earthwork operations including grading, rock toe, spillway, channel, and boat ramp construction, wetland construction, installation of corrugated metal pipe (CMP) culverts ranging from 48 to 84 inches in diameter, box culvert work, geotextile installation, boulder barricades, final grading, seedbed preparation, seeding, and erosion control measures across two distinct sites (northern and southern with channel and fill areas). Bidders must demonstrate a minimum of five years of continuous active participation in the applicable industry, provide three professional references from the past five years, and submit a detailed project schedule with monthly milestones and a comprehensive compliance and methodology plan addressing communication, quality assurance, safety, SWPPP compliance, and subcontractor information.

The contract is a lump sum award with a contract period from October 1, 2026 through June 30, 2027. A 5% bid guarantee is required, and 10% retainage will be held from each invoice. Liquidated damages of $2,500 per week apply if the project is not completed by June 30, 2027. Bidders must obtain a Kansas tax clearance certificate, submit immigration reform and control certification, sexual harassment policy acknowledgment, and Israel boycott certification. Eligible bidders may claim preference under Certified Business Bidder or Disabled Veteran Owned Business categories. Questions are due August 28, 2026. Interested vendors not initially invited must notify the Procurement Officer at least 24 hours before the closing date.
