About this file

This is a certification document issued by the U.S. Department of the Interior, Office of Surface Mining Reclamation and Enforcement, which pertains to the Garrison Cemetery Abandoned Mine Land (AML) Project in Cherokee County, Kansas, being procured by the Kansas Department of Health and Environment. The document establishes compliance requirements for prospective contractors and subcontractors participating in this federal grant-funded project. The certification addresses four primary compliance areas: debarment and suspension status, lower-tier covered transactions, drug-free workplace requirements, and lobbying activities. Contractors must certify that they and their principals are not currently debarred, suspended, or ineligible for federal transactions; have not been convicted of fraud or criminal offenses related to public contracts within the preceding three years; and are not presently indicted or criminally charged by any government entity. Additionally, contractors must agree to include required debarment and suspension clauses in all lower-tier subcontracts and solicitations.

For applicants who are not individuals, the certification mandates implementation of a drug-free workplace program that includes publishing anti-drug policies, establishing employee awareness initiatives, requiring employee drug-free statements, and establishing procedures for reporting drug-related convictions. The grantee must provide notice of employee convictions to the federal agency within ten calendar days and take corrective action, up to and including termination, within thirty days. For federal grants or cooperative agreements exceeding $100,000, the undersigned must certify that no federal appropriated funds have been or will be used to influence federal officials, Congress members, or congressional employees regarding the award. Any person who fails to submit the required certifications is subject to civil penalties ranging from $10,000 to $100,000 per violation. This certification consolidates five previous Department of Interior forms and is identified as form DI-2010, modified for OSM use in March 1995.
